CHESTERFIELD, Ind. – A man who until recently lived in Muncie will be charged with murder in a Muncie woman’s shooting death.
Madison County Sheriff Scott Mellinger said Saturday morning his office would request a murder charge be filed against Agapito Diaz III,32, in the Monday slaying of Jalynn N. Harmon.
Harmon, who had observed her 20th birthday three days earlier, was mortally wounded Monday evening in a shootout at Diaz’s house on Pass Street, southeast of Old Ind. 67 and Madison County Road 400-E.
She later died at an Indianapolis hospital.
Diaz – expected to face additional charges of attempted armed robbery, unlawful possession of a firearm by a serious violent felon and criminal recklessness, according to Mellinger – was also hit by gunfire, and was treated at an Anderson hospital.
The Anderson man Diaz allegedly traded shots with, 24-year-old Joshua Steele, is preliminarily charged with unlawful possession of a firearm by a serious violent felon, carrying a handgun without a license, dealing in a controlled substance and possession of marijuana.
Steele was arrested in Anderson soon after Monday’s shootings.
Diaz was twice convicted of robbery in Delaware County, in September 2016 and last month. Both convictions stemmed from crimes that took place in 2013.
Mellinger said the Pass Street home had been the recent target of complaints about alleged drug-related activity.
Both Diaz and Steele were being held without bond Saturday in the Madison County jail.
