Conservative justices seemed to find favor with the Biden administration\u2019s argument Wednesday that the Boston federal appeals court which vacated the 28-year-old convict\u2019s sentence last year did so in error. That court had ruled evidence was withheld showing Tsarnaev was heavily influenced by his older brother, who died in the aftermath of the deadly attack at the world famous race\u2019s finish line. Tamerlan Tsarnaev was driven over by his younger brother, then 19, after being gunned down during a shootout with police. The First U. S Circuit Court also took issue with how the judge in Tsarnaev\u2019s case vetted jurors who may have been influenced by extensive media coverage of the marathon bombing. The Supreme Court\u2019s three conservative justices appeared more sympathetic to Tsarnaev\u2019s current life sentence. His guilt is not in question. Justice Amy Coney Barrett, the court\u2019s newest member, was the sole justice to note the Biden administration\u2019s pursuit of a capital sentence for Tsarnaev seems at odds with the president\u2019s call to end federal executions. She argued Tsarnaev would be \u201cliving under a death sentence the government doesn\u2019t intend to carry out.\u201d There is currently a halt on federal executions. The Kyrgyzstan native could face a new sentencing hearing, which the federal government argued would be unfair to the people of Boston trying to get past the horrors of April 15, 2013. Tsarnaev was convicted of 30 charges \u2014 almost all of which were upheld by the appeals court.
