Supreme Court Justice Samuel Alito declined to recuse himself from cases involving former President Donald Trump and the Capitol riot after calls to do so amounted earlier this month, claiming that “reasonable” people aren’t questioning his ability to remain impartial.
Questions about whether Alito’s opinion could be considered unbiased arose when The New York Times published photos of an upside-down flag—used at the time by some Trump supporters to contest the election results that showed Joe Biden was the winner—flying on Alito’s lawn in Alexandria, Virginia, on January 17, 2021.
