President Trump is trying to block sex assault accuser Summer Zervos from having her day in court by asking a panel of judges to stay her defamation case, lawyers for the former “Apprentice” contestant said in court papers filed Tuesday.
Trump wants to put the case on hold pending his appeal of a Manhattan Supreme Court judge’s ruling last month that he must face the claim because he’s not “above the law .”
Mariann Wang, an attorney for the former reality TV contestant, says Trump is “motivated by the desire to prevent Ms. Zervos from having her day in court, which could cause significant prejudice to her.”
“There is a real risk that memories will fade, or that evidence will be lost, if Ms. Zervos is deprived of the opportunity to begin discovery for months or longer,” Wang writes in a brief filed with Manhattan’s Appellate Division.
The appeal is scheduled to be heard in September.
Trump has argued that he’s too busy being president to defend the suit .
But Zervos counters that his “cable lawyers” will do most of the work.
Zervos sued Trump last year after he called her a liar for saying he rubbed his genital against her at the Beverly Hills hotel in 2007.
