The lawyer for Hannah Silbaugh, the 21-year-old Erie resident kicked by an Erie police officer during a protest downtown on May 30, is asking the Pennsylvania Attorney General’s Office to take over the criminal investigation of the case from Erie County District Attorney Jack Daneri.
The Erie police ended its internal affairs probe of the unnamed officer on Monday by suspending him for three days without pay. Silbaugh’s lawyer, Timothy McNair, said that situation creates a potential problem for Daneri, and McNair said he believes the police officer should be charged with aggravated assault.
“It has become apparent that turning further action on this matter over to the County District Attorney would put him in an untenable position, given the unanimity of the rank-and-file police officers and the support of their commanders to avoid responsibility for the officers involved and the fact that he must rely on these officers daily to discharge the duties of his office,” McNair said in an email.
