Patagonia goes to war against Trump over national monument plans: 'The President Stole Your Land'

The White House has just announced the biggest-ever reduction in size of US national monuments.
Visitors to Patagonia’s website are being greeted with a stark message: “The President Stole Your Land.”
The lifestyle clothing company has launched a scathing attack on the Trump administration’s decision to drastically reduce the size of two national monuments, and says it plans to sue over what it describes as an “illegal move.”
On Monday, it was announced that the Bears Ears National Monument in Utah is being decreased by 85% — the largest-ever reduction of a national monument. The Grand Staircase National Monument is also being reduced.
Trump has framed the move as a response to government overreach: “I have come to Utah to take a very historic action: to reverse federal overreach and restore the rights of this land to your citizens,” he said .
But some environmental campaigners and brands have reacted with fury. “Americans have overwhelmingly spoken out against the Trump Administration’s unprecedented attempt to shut down our national monuments,” Patagonia CEO Rose Marcario said in a statement obtained by Ad Age, signaling the company intends to sue.
“We’ve fought to protect these places since we were founded and now we’ll continue that fight in the courts.”
Patagonia has previously been vocal in its support for protecting public land, and is now calling on customers to support advocacy groups including Grand Staircase Escalante Partners, Alaska Wilderness League, and Wild Salmon Center.
“Removing protections for these wild places to open them up for development will not make us energy independent, and history shows that when states control these lands, they are sold to the highest bidder,” it says . “This is not a chance we are willing to take.”

Two of the state’s top law enforcement officials say they’re prepared to investigate sexual misconduct allegations against the husband of Democratic Massachusetts Senate President Stan Rosenberg.
Attorney General Maura Healey and Suffolk County District Attorney Daniel Conley, both Democrats, are asking anyone with information about the allegations to contact either of their offices.
The two said in a written statement Monday that they are committed to providing every survivor of sexual assault with what they called “a safe, respectful, victim-centered environment.”
Earlier Monday, Rosenberg, a Democrat, agreed to step aside as leader of the chamber during an investigation into the allegations surrounding his husband, Bryon Hefner.
Several men told The Boston Globe that Hefner sexually assaulted or harassed them.

Rosenberg had previously planned to remain on as Senate President but recuse himself from all matters related to the investigation. But on Monday he informed colleagues just prior to a Democratic caucus that he would not serve as president during the probe, though he will remain in the Senate.
The Senate is likely to vote Monday to authorize the appointment of an independent investigator whose focus likely would be on whether Rosenberg knew about Bryon Hefner’s alleged behavior, or if Hefner had any clout when it came to Senate matters.
Rosenberg has not been accused of wrongdoing.

The cool reception suggests the $550 billion newcomer will need to trim its margins and ramp up stock selection in the world’s No. 12 economy, and eased the market’s worst fears about its potential to devastate brick-and-mortar incumbents.
While Amazon.com.au was generally competitive on price, analysts found some items were more expensive on the U. S. company’s website. An iPhone 7 Plus was selling on Amazon for A$1,345 ($1,027.71) compared with A$1,199 at electronics rival JB HiFi.
“Amazon’s not materially cheaper on a wide basket of items than the retailers,” said Vertium Asset Management portfolio manager Daniel Mueller.
“The retailers are rallying. It’s a realization that Amazon is not going to kill Australian retail, at least not today.”
Shares of JB HiFi and larger electronics retailer Harvey Norman Holdings Ltd jumped 5 percent, clawing back most of their declines since Amazon announced its Australia plans in April. The broader market was down 0.2 percent.
Shares of No. 1 department store chain Myer Holdings rose 2 percent, still down more than a quarter since April. Myer and Amazon carried the same dress from Australian fashion designer Sass & Bide on Tuesday, but Myer advertised 78 items from that maker compared to Amazon’s eight.
Helping the positive sentiment toward retail stocks, the country’s retail sales bounced in October after months of lukewarm demand, according to official data. Online sales account for less than 10 percent of the A$300 billion retail sector.
Citi analysts described Amazon’s initial Australian offering as “patchy,” adding in a note to clients: “We expect Amazon will not be disruptive to Australian retailers this Christmas.”
Jim Power, consumer analyst at broker Martin Currie Australia, said that while Amazon had focused on price, range and customer experience, their initial Australian offer “doesn’t appear compelling.”
Until Tuesday, Amazon-registered sellers in Australia had been limited to sending goods offshore because the Seattle conglomerate did not have a warehouse in the country of 24 million people. This also meant Australians had to wait longer and pay more for shipping.
The company has now set up a massive distribution warehouse on the outskirts of Melbourne city, on the country’s east coast where four-fifths of the population live, and hopes to cut delivery time to as little as a day.
It also has said it would offer free shipping nationwide for purchases over A$49.
Amazon’s Australia country manager, Rocco Braeuniger, said in a statement on the eve of the launch that the U. S. company hoped to “earn the trust” of Australian shoppers and, over time, create “thousands” of jobs.
Braeuniger was not immediately available for comment after the launch.

New York’s attorney general says there are at least 1 million fake comments found on the net neutrality public record. He and 28 senators are calling for a delay of the net neutrality vote expected later this month.
New York Attorney General Eric Schneiderman on Monday called for the FCC to delay its net neutrality vote after the AG office found fake comments on public record debating the 2015 law, done so through identity theft.
Schneiderman and FCC Commissioner Jessica Rosenworcel said at a news conference on Monday that at least 1 million fake comments were found. According to The Hill, 28 senators are petitioning the FCC to delay its vote on repealing its net neutrality rules citing fake comments as a concern.
“A free and open internet is vital to ensuring a level playing field online, and we believe that your proposed action may be based on an incomplete understanding of the public record in this proceeding,” the senators wrote in a letter to FCC chairman Ajit Pai. “In fact, there is good reason to believe that the record may be replete with fake or fraudulent comments, suggesting that your proposal is fundamentally flawed.”
The FCC is expected later this month to repeal net neutrality. “Under my proposal, the federal government will stop micromanaging the internet,” Pai said in November.
“Specifically, for six months my office has been investigating who perpetrated a massive scheme to corrupt the FCC’s notice and comment process through the misuse of enormous numbers of real New Yorkers’ and other Americans’ identities,” Schneiderman wrote in a statement on Medium. “Such conduct likely violates state law — yet the FCC has refused multiple requests for crucial evidence in its sole possession that is vital to permit that law enforcement investigation to proceed.”
Last week, the NY AG office set up a website for people to find any comments that may have misused their identity.
The senators on Monday asked the FCC to cooperate with state and federal level probes, and to investigate the source of the comments.
“At today’s news conference, they didn’t identify a single comment relied upon in the draft order as being questionable,” Tina Pelkey, a spokeswoman for the FCC, told the Washington Post . “This is an attempt by people who want to keep the Obama Administration’s heavy-handed internet regulations to delay the vote because they realize that their effort to defeat the plan to restore internet freedom has stalled.”

WASHINGTON (AP) – President Donald Trump gave embattled GOP Senate candidate Roy Moore a vigorous formal endorsement Monday, looking past allegations of sexual misconduct with Alabama teenagers as Republican leaders in Washington, once appalled by Moore’s candidacy, began to come to grips with the ever-clearer possibility of his victory.
Buoyed by the taste of his own success in Congress as the Republican tax bill inches closer to passage, Trump telephoned Moore to offer encouragement as well as support and also argued in a pair of tweets that Moore’s vote was badly needed to push the president’s policies forward.
In addition, Senate Majority Leader Mitch McConnell, who was initially among several national Republicans to urge Moore to drop out of the race, said Sunday it was up to Alabama voters to decide whether the former state Supreme Court chief justice should be elected.
Weeks ago, when accusations of sexual misconduct with teenagers first surfaced, Trump’s spokesman had said the president believed Moore would “do the right thing and step aside” if the allegations were true.
Top Republicans vowed to expel him from the Senate if he won his Dec. 12 special election. And, publicly and privately, GOP leaders described the allegations against Moore as credible and insisted there were no circumstances under which he should serve in the Senate.
Trump’s tweets on Monday showed his thinking has evolved as Moore has rejected his party’s appeals and doggedly remained in the race.
In the phone call, Moore said, Trump offered “his full support and said he needs a fighter to help him in the US Senate.”
Moore tweeted that the president told him: “Go get ’em, Roy!”
Trump’s move was somewhat symbolic: He had already all but endorsed Moore, repeatedly criticizing Democratic rival Doug Jones on Twitter and planning a campaign-style rally in Pensacola, Florida, on Friday, less than 20 miles from the Alabama border and just four days before voters head to the polls.
Still, Trump’s decision to do away with any pretense of distance made clear he is increasingly confident in Moore’s chances of victory despite the continued unease of some other Republican leaders.
A Moore victory would set up a potentially explosive clash with fellow Republicans in Congress, some of whom have resoundingly called on him to quit the race. While some have softened their rhetoric recently, others have said they still will try to expel him if he is elected.
Moore’s campaign was wounded by accusations this fall of sexual misconduct, decades ago, made by women who were then teenagers. One of the women alleges he initiated sexual contact when she was 14.
Moore denies it all, saying “I do not know any of these women. I did not date any of these women I did not engage in any sexual misconduct with anyone.”
Trump, who has repeatedly noted Moore’s denials, took a more political stance on Monday.
“Democrats refusal to give even one vote for massive Tax Cuts is why we need Republican Roy Moore to win in Alabama,” Trump tweeted. “We need his vote on stopping crime, illegal immigration, Border Wall, Military, Pro Life, V. A., Judges 2nd Amendment and more.”
In that same vein, longtime Alabama Sen. Richard Shelby said Trump’s endorsement didn’t surprise him. He said of the president, “I think he’s interested, a lot of us are, in the numbers, being a Republican.”
And Sen. Orrin Hatch, who traveled with Trump on Monday to Hatch’s home state of Utah, said he realistically didn’t have any choice. Hatch said, of Moore, “That’s the only Republican you can possibly get down there at this time.”
Trump first appeared to back Moore after his first choice, Sen. Luther Strange, lost the GOP primary for the seat once held by Attorney General Jeff Sessions. But the president went silent after The Washington Post reported on the allegations of sexual misconduct with two teens, ages 14 and 16, and efforts to date several others while Moore was a local prosecutor in his 30s.
By late last month, however, with pressure mounting from his former chief strategist Steve Bannon and other corners of his base, Trump was making clear that he preferred Moore, raising doubts about the candidate’s accusers and criticizing Democrat Jones as the “liberal puppet” of Democratic leaders Chuck Schumer and Nancy Pelosi.
Meanwhile, Moore himself was strongly criticized by top Republicans, including Cory Gardner of Colorado, chairman of the Senate GOP campaign apparatus known as the National Republican Senatorial Committee.
“If he refuses to withdraw and wins, the Senate should vote to expel him, because he does not meet the ethical and moral requirements of the United States Senate,” Gardner said three weeks ago. He said last week he stood by that statement.
Jones, the Democrat, sidestepped questions about Trump’s endorsement while suggesting the support of national Republicans like McConnell could do more harm than good in Alabama.
“Our campaign is going straight to the people of the Alabama because that’s who my voters are. It’s not the president, it’s not Mitch McConnell,” Jones told reporters outside a steel mill in suburban Birmingham. “Obviously Mitch McConnell has very little credibility in this state anyway, so I’m not worried about him at all.”
Expelling a senator is no easy task. The Senate Ethics Committee would have to investigate, and a recommendation of expulsion could take years.

House Republicans have voted to move ahead on negotiating with the Senate on their far-reaching overhaul of the nation’s tax code.
The House voted Monday night to begin a House-Senate conference to work out the differences between the two bills. The House passed its version of the $1.5 trillion measure last month. The Senate narrowly passed its own bill Saturday.
Both bills would slash the corporate tax rate from 35 percent to 20 percent, eliminate some popular deductions and double the standard deduction used by most taxpayers.
Republican leaders are upbeat about resolving their differences and finishing a bill in time to send the measure to President Donald Trump by Christmas

Significant differences separate the massive tax packages passed by the House and Senate on estate taxes, health care and a prized deduction for home mortgage interest.
But Republican leaders are confident none is insurmountable.
Republicans are trying to pass the biggest rewrite of the tax system in more than 30 years.
Senate GOP leader Mitch McConnell says “we’re looking forward to getting a final bill to the president’s desk, soon.”
Both versions would cut taxes by about $1.5 trillion over the next decade while adding billions to the deficit. But they take different approaches.
And it will be up to lawmakers to try to reconcile differences in the competing versions.

Key US allies warn Trump about Jerusalem announcement

Two major US allies registered their concern about reported plans by President Donald Trump to recognize Jerusalem, in whole or in part, as the capital of Israel.
“Any announcement prior to a final settlement would have a detrimental impact on the peace process and would heighten tensions in the region,” Prince Khalid bin Salman, the Kingdom of Saudi Arabia’s ambassador to the US, said in a statement to CNN.
In a phone call with Trump on Monday, French President Emmanuel Macron expressed similar thoughts, according to a readout provided by the French Foreign Ministry.
The French President shared his concern about the possibility that the United States might unilaterally recognize Jerusalem as the capital of Israel, according to the statement.
Macron reaffirmed the standard international position that the status of Jerusalem should be resolved through peace negotiations between Israelis and Palestinians, “and particularly those relating to the establishment of two states, Israel and Palestine, living side by side in peace and security with Jerusalem as their capital,” the statement said.
White House deputy press secretary Hogan Gidley, briefing reporters aboard Air Force One on Monday, addressed the question of whether Trump will act to move the US Embassy from Tel Aviv to Jerusalem but didn’t take up the question of recognition.
“The President has been clear on this issue from the get-go that it’s not a matter of if but a matter of when. No action, though, will be taken on the waiver today. And we will declare a decision on the waiver in the coming days,” Gidley said.
The Jerusalem Embassy Act of 1995 requires the embassy to be moved to Jerusalem or face the financial penalty of losing half the State Department’s appropriated funding for the acquisition and maintenance of buildings abroad. Every six months, however, presidents can sign a waiver to avoid these penalties on national security grounds.
The Saudi ambassador added that Saudi Arabia was working with the Trump administration on a possible Mideast peace settlement and remains committed to a solution “based on the 1967 borders including east Jerusalem as the capital of a Palestinian state. We are working with the President’s peace negotiation team to achieve a fair and just settlement.”

Q&A: Bid pushes CVS deeper into consumers’ lives

How acquisition of Aetna by CVS would affect health care consumers
A drugstore chain that used to hawk cigarettes behind the front counter now wants to offer nutrition advice and work with your doctor to keep you healthy.
CVS Health says it wants to use its roughly $69 billion acquisition of the insurer Aetna to dive deeper into managing customer health, with its nearly 10,000 stores becoming “front doors” for care. The companies plan to expand the health services offered through CVS locations and get more involved in helping patients stay on their medicines or manage their chronic conditions.
The deal announced Sunday will pair the second-largest U. S. drugstore chain with the third-largest health insurer. Here’s how it will likely play out.
The company already has started testing vision and hearing aid centers at 15 and 32 locations, respectively. It also does blood draws and monitor chronic conditions like high blood pressure at certain stores.
The company might add to the 1,100 clinics it operates, expand into selling more medical equipment or offer nutritionists to counsel customers.
CVS leaders think its vast footprint – nearly 70 percent of the U. S. population lives within three miles of a CVS pharmacy — gives it an opportunity to build a deeper relationship with customers.
Q: Are they trying to replace my family doctor?
A: CVS wants to complement doctor care, CEO Larry Merlo said Monday during a conference call to discuss the deal.
For example, Merlo said people with diabetes typically see their doctor several times a year, but may have trouble sticking with a treatment plan. The company said it can help patients stay on a plan, using its network of pharmacists, clinics and other future services.
“We’re in the community, we’re seeing those patients. We’re becoming part of their daily lives and routines,” he said.
Q: Will this make my prescription drugs cheaper?
A: Not in the near term, according to Edward Jones analyst John Boylan.
The deal doesn’t change how drugs are priced. It just puts key players in that negotiation – drugstores and pharmacy benefits managers — under the same roof as an insurer, Boylan said.
CVS processes more than a billion prescriptions annually as one of the nation’s largest pharmacy benefit managers, running prescription drug coverage for large clients like Aetna.
Over time, a bulked-up CVS may gain some negotiating power over prescription prices, but it’s hard to say whether that will translate to lower prices for consumers.
The deal could make other care elements cheaper, especially for Aetna customers who might get incentives like no co-payments to encourage use of CVS clinics for basic, non-emergency care.
Q: What’s the business case for this deal?
A: Buying Aetna gives CVS a way to better compete with other huge national health care companies like UnitedHealth Group Inc. The nation’s largest insurer also runs a big pharmacy benefit management business and operates clinics and doctor offices.
Aetna will operate as a separate brand inside CVS. The deal also will help CVS keep competitors from poaching its 22 million customers.
Retailers like CVS face growing online competition, especially for the consumer products they sell outside store pharmacies. By adding more services, the drugstores will be selling something customers cannot buy online.
CVS also hopes to get customers to use its stores and services more. Drugstores have learned that customers aren’t particularly loyal to one chain and will fill their prescriptions where their coverage tells them or where they can get the best deal.
“I’m not going to leave my job just because they took CVS out of my network,” Jefferies analyst Brian Tanquilut said.
Q: When will this deal close?
A: The companies expect that to happen in the second half of next year. However, it still has to pass federal anti-trust scrutiny.
Aetna has a rough record with that. The Department of Justice sued to stop its roughly $34-billion acquisition of fellow insurer Humana. That deal fell apart earlier this year.
CVS and Aetna both offer Medicare Advantage prescription drug coverage, and some of that may have to be sold to address anti-trust concerns. Overall, the businesses of Woonsocket, Rhode Island-based CVS Health Corp. and Hartford, Connecticut-based Aetna Inc. have much less overlap than other deals that have been swatted by regulators.

We’re not sure how Skullcandy crammed such excellent-sounding drivers into such a cheap headset, but somehow, some way, it absolutely did. The Skullcandy Grind is one of our favorite wired on-ear headphones – it’s cheap, sounds incredible and looks awesome. Also, while most headphones make a statement using a logo, branding on these headphones is subtle, with a small logo stamped onto each of the sidearms. While Skullcandy isn’t super transparent about the specs of its headsets, the Grind offers exquisite sound quality, complete with beefy bass response and articulate delivery of mids and highs. We tried a wide variety of music samples to see if we could find a weak point in these cans and, nope, we couldn’t. The only weak point here is that it doesn’t have volume controls built-in. But that’s not a huge bummer.
Awesome-sounding in-ear headphones for under $20
We rigorously test cheap headphones – I mean, we really put these thing through their paces. And after testing dozens of in-ears, the two that stood head and shoulders above the rest were the RHA S500 and the Creative EP-630. While you could shell out $40 for the RHAS500 your money might be better spent on the EP-630, considering it will set you back less than $20. Why should you pick the Optoma NuForce BE Sport3 instead of the Momentum In-Ear, because it’s one of the cheapest (and best-sounding) in-ear headphones we’ve ever found. And, good news, it’s usually on sale to boot. Not only are these earbuds IP55 rated, making them rain, dust and sweat resistant, but they also have really balanced sound that works well for every genre and incredible noise isolation. They’re perfect for the gym because they weigh just 18 grams and don’t need to connect to your phone via a dangling, easy-to-knock off cable. Optoma says the frequency response goes from 20 to 20,000Hz, and it has a sensitivity of 102dB +/-3dB at 1kHz. On the debit side, though, there are some horror stories out there of the BE Sport3’s batteries being a bit difficult to work with, so keep that in mind.

You may know Marshall for its guitar amplifiers, often used on stage by rock stars and amateurs alike, but the company does way more than just amps. In the past few years, Marshall’s produced several lines of headphones, a Bluetooth speaker or two and even a smartphone. When it comes to headphones, the general consensus is that you very much get what you pay for. But with AKG’s K92, what you’re getting is so much more. That being said, these are some of the largest cans you might ever find, and therefore might not be the best choice for anyone out there who has a petite noggin. Specs-wise, however, it’s all good. The K92’s professional 40mm drivers offer an extended 16 – 20,000Hz frequency response with a 113 dB SPL/V sensitivity level. It has a cable length of about 9 feet (3 meters) and weighs around 200 grams.

When the BackBeat Sense first launched a few years ago, it was way too expensive for the everyday audio listener. Sure, these headphones are good, but were they $200/£150 good? Probably not. Thankfully, it’s possible to find them for a much more reasonable price if you shop around. The design yields comfort and appeal. Its sound performance, battery life and features all deliver without a hitch. There are one or two problems here, but for a sweet set of headphones at this low of a price point we can’t be harsh on ’em. There’s a lot about the AirPods that we like. They sound great, their battery life and charging speeds run laps around the competition, and it’s hard to overstate just how seamless the pairing process is. Unfortunately, they can be rather expensive if you don’t get them on sale. Expensive, but good-sounding name brand headphones
The Beats Solo 3 Wireless ace their wireless tech, with very solid Bluetooth, good range and class-leading battery life. There’s a huge difference here compared with often-flaky cheap Bluetooth sets. Their bass response is sure to be a crowd-pleaser, too – it’s not meant to be neutral or accurate, but by providing meaty thuds without major boominess, the Solo 3 Wireless do what a Beats headphone should.
