House Democrats on the Judiciary Committee asked if President Donald Trump “could murder the FBI Director and not face criminal charges,” in a Wednesday letter to White House Counsel Donald McGahn.
The question was in reference to Trump attorney Rudy Giuliani’s claim on Sunday that the president would be impeached rather than charged if he shot former FBI Director James Comey.
“I don’t know how you can indict while he’s in office. No matter what it is,” Giuliani told the Huffington Post.
The Democrats’ letter also questioned the president’s power to pardon himself and asked: “Do you agree with President Trump that he has the ‘absolute’ right to pardon himself, and if so, on what legal basis?” (RELATED: FACT CHECK: Can The President Pardon Himself?)
The letter touched on other questions regarding special counsel Robert Mueller’s investigation as well and questioned the claim that firing Comey could not be obstruction of justice “‘because it is a constitutional impossibility for the ‘chief law enforcement officer’ to obstruct himself.”
