Justice Kennedy retires from SCOTUS and the obstacles to Trump’s future high-court nominee to replace Justice Kennedy will come from supine, moderate Senate Republicans and not hard-left Democrats.
WASHINGTON: Justice Kennedy retires. While the Trump-Deranged left is in full melt-down mode over Supreme Court Justice Anthony Kennedy’s announcement, the political right shouldn’t begin celebrating just yet. The obstacles to Trump’s future high-court nominee to replace Justice Kennedy will come from supine, moderate Senate Republicans and not hard-left Democrats.
And the issue central to the nominee’s confirmation will be the possible threat he or she poses to the Supreme Court’s depraved 1973 ruling in Roe v. Wade.
It’s not unthinkable that as a last dramatic act of defiance, thus winning the undying admiration of The New York Times’ obituary writers, Sen. John McCain climbs out of his sickbed, is carried to the well of the Senate, and denounces Trump’s Supreme Court nominee as a threat to the nation’s most cherished right as debated by the delegates to the 1787 Constitutional Convention in Philadelphia – abortion.
Remember, it was McCain whose no vote kept Obamacare from being repealed.
And then there’s Maine’s RINO Republican, Sen. Susan Collins. In her praise of Justice Kennedy, Collins telegraphed to NBC News the kind of nominee she wants on the high court.
“What I most liked about Justice Kennedy is he did not identify with any ideological block on the court. But, rather, was the justice who evaluated every case not ideologically but based on its merits and adherents to the law and Constitution.”
In other words, a useless intellectual nonentity – like her.
And then there’s Alaska’s Sen. Lisa Murkowski, who said she “has sworn an oath to uphold the U. S. Constitution… The U. S. Supreme Court has ruled that the U. S. Constitution recognizes abortion.”
And that ruling has a lot in common with an earlier landmark decision.
The Supreme Court ruled in its 1857 Dred Scott decision that blacks were…
“… regarded as beings of an inferior order, and altogether unfit to associate with the white race, either in social or political relations; and so far inferior, that they had no rights which the white man was bound to respect; and that the Negro might justly and lawfully be reduced to slavery for his benefit.”
Millions of Americans died in the Civil War, with amendments added to our Constitution, to overturn the Supreme Court’s evil Dred Scott ruling, reestablishing the personhood of African-Americans and their rights under the Constitution.
116 years later, the Supreme Court struck another blow against humanity in Roe v. Wade:
“The Constitution does not define ‘person’ in so many words… the Fourteenth Amendment contains three references to ‘person.’ The first, in defining ‘citizens,’ speaks of ‘persons born or naturalized in the United States’… The word also appears both in the Due Process Clause and the Equal Protection Clause… But in nearly all these instances, the use of the word is such that it has application only post-natally. None indicates, with any assurance, that it has any possible pre-natal application.”
And with that, the high court created a new class of non-persons in America – the unborn.
GOP Senate Majority Leader Mitch McConnell said a Trump Supreme Court nominee will be considered for confirmation this fall. But it’s a real possibility the GOP’s liberal wing will scuttle it.
That’s because America’s Roe v. Wade death cult has plenty of adherents among the U. S. Senate’s feckless Republicans.
