AUSTIN — The Texas Supreme Court on Friday ruled the state can keep secret a supplier of execution drugs, overturning a lower court’s decision that the identity must be disclosed.
In their opinion, the justices agreed with the Texas Department of Criminal Justice that revealing the name of the pharmacy that supplied the state in 2014 could put them in danger.
„The information sought in this case is the source of drugs used in Texas executions by lethal injection,“ Justice Paul W. Green wrote on behalf of the full court. „We conclude, based on the evidence in the record, that disclosing the source’s identity would create a substantial threat of physical harm to the source’s employees and others, and therefore need not be disclosed.
