東北新幹線大宮―上野間で架線を引っ張る重り設備が破断したトラブルで、JR東日本は 、故障リスクが少ない「バネ式」への交換を前倒しするなどの再発防止対策を発表した。緊急点検で重り設備計490カ所にひび割れは見つからなかったが、さらに微細な傷を見つけるための探傷試験を 末まで続けるという。
 現場では、重りを支える鉄製の棒「重錘(じゅうすい)ロッド」が破断。たるんだ架線に新幹線のパンタグラフが引っかかるなどして停電し、東北、上越、北陸新幹線が終日運休した。設備交換の目安は30年だが、このロッドは目視点検で異常がないとして38年間交換されておらず、ほかの重り設備も半数を超える251カ所が30年以上未交換だった。東海道・山陽新幹線は30年での交換を基本とし、このうち東海道はロッドを10年ごとに交換している。
 JR東は暫定的な再発防止策として、重り設備のうち、各新幹線が線路を共有する東京―大宮間は全7カ所のロッドを交換。また、本線上の全394カ所はロッドが破断しても架線がたるまないよう、重りの落下を防ぐ金具を取り付ける。さらに、全体の9割まで進んだバネ式への交換を急ぐという。
 復旧作業中に起きた感電事故対策としては、架線が垂れ下がっている場合は、停電させるまで線路に入らないことを徹底するという。(細沢礼輝)

Elon Musk had put together a multi-billion dollar compensation deal with Tesla, but a Delaware judge has voided it. Here’s the reason as to why.
In 2018, Tesla extended an unprecedented compensation deal to its CEO Elon Musk. He would work without drawing a salary for the next 10 years, help achieve a dozen targets, and scale the company’s market valuation past the $650 billion mark. If he meets all the goals, he will go home with a paycheck close to $55 billion. Today, a court in Delaware has ruled that Musk can’t be awarded the obscenely generous multi-billion dollar compensation after a shareholder brought a legal case against the whole idea.
Musk’s team argued that the compensation was “fair because its milestones were ambitious and difficult to achieve.” However, they also admitted that at least three of the targets were in line with the company’s own internal growth projections (some of them as high as 70%). At the same time, the company routinely missed internal projections. However, the main argument was that either the compensation grant was solely Musk’s proposal or he failed to disclose his close relations with multiple board members over whom the Tesla chief exercised maximum personal influence.
Notably, the court order also takes a shot at Musk juggling multiple brands and not being at Tesla full-time. “Defendants failed to prove that Musk’s less-than-full time efforts for Tesla were solely or directly responsible for Tesla’s recent growth, or that the Grant was solely or directly responsible for Musk’s efforts,” says the court order.A tricky road ahead for Musk’s enterprises
A compensation worth $55 billion was a historic one, and it could have made Musk even richer despite already leading the world’s richest person list for a healthy portion of time in the past couple of years. But now that the grant has been voided by the court because it was deemed unfair, Musk has one last opportunity left in the form of an appeal. If that fails, the board will have to come up with a new plan to pay him for the past five years of his service.

McCormick asked. Without the compensation factored into his cumulative wealth, Bloomberg estimates that Musk’s net worth would drop down to approximately $154.3 billion, putting him third on the list of the world’s richest individuals. 
It’s also worth noting that a majority of Musk’s wealth is tied to Tesla, where he owns close to a 13% share. Musk, on the other hand, has lately been eyeing up to a 25% stake in Tesla in hopes of landing more meaningful voting rights on the board. During a previous trial over the compensation plan in 2022, Musk told the court that it would help fund his plans for putting mankind on Mars and achieving interplanetary travel.

Die EU will am Donnerstag ein neues Hilfspaket von 50 Milliarden Euro für die Ukraine schnüren, damit diese trotz des russischen Angriffskriegs Gehälter und Renten zahlen sowie Krankenhäuser und Schulen finanzieren kann. Ungarns Regierungschef Orban hatte mit seinem Veto auf dem EU-Gipfel Mitte Dezember aber den nötigen einstimmigen Beschluss verhindert. Am Donnerstag soll auf einem Sondergipfel nun eine Lösung gesucht werden.
Orban bekräftigte kurz vor dem EU-Sondergipfel seine Ablehnung der aktuellen Pläne und nannte Bedingungen für eine Einigung. Ungarn sei bereit, Teil einer Lösung zu sein, sagte er in einem Interview des französischen Magazins “Le Point”. Voraussetzung sei allerdings, dass man jedes Jahr neu darüber entscheide, ob man weiter Geld schicken wolle oder nicht.
Die Ukraine stelle über den Konflikt hinaus “ein ernstes Problem für Europa dar, unabhängig vom Krieg”, sagte Orban weiter. Er erwähnte darin auch die “Einsamkeit” Ungarns innerhalb der EU, während die anderen 26 Mitgliedstaaten “immer noch glauben, dass es eine militärische Lösung gibt”.
Vorwürfe, dass er die anderen EU-Staaten mit einem Veto erpressen wolle, wies Orban zurück und verwies dabei auch auf die im Juni anstehenden Europawahlen. Jetzt für die Ukraine 50 Milliarden Euro für den Zeitraum bis Ende 2027 fest zuzusagen, könnte den Bürgern seiner Meinung nach den Eindruck vermitteln, dass ihre Stimme keine Rolle spiele.
Orban kritisierte zudem eine Analyse von EU-Beamten zur Wirtschaftslage in Ungarn, die vor dem EU-Sondergipfel offensichtlich Druck auf Ungarn ausüben soll. In dem von der “Financial Times” enthüllten Dokument wird darauf hingewiesen, dass im Fall eines Scheiterns des Gipfels wegen Orban andere Staats- und Regierungschefs einen Stopp sämtlicher EU-Zahlungen an Ungarn ins Gespräch bringen könnten. Dies könne dann wiederum zu sinkenden ausländischen Investitionen und zu einem weiteren Anstieg der Finanzierungskosten des Staatsdefizits und einem Währungsverfall führen.
Orban bezeichnete das Dokument am Dienstag als einen Erpressungsversuch und warnte, dass Ungarn nicht erpresst werden könne. “Wir werden unsere Interessen verteidigen”, schrieb er auf der Plattform X.
Über neue EU-Finanzhilfen für die Ukraine hätte eigentlich bereits beim EU-Gipfel im vergangenen Dezember entschieden werden sollen. Dort brauchte es allerdings einen Konsens und Orban verhinderte den Beschluss mit einem Veto. Er hatte zuvor mehrfach die Sinnhaftigkeit der Pläne infrage gestellt und in diesem Zusammenhang auch darauf verwiesen, dass die EU aus seiner Sicht zu Unrecht für sein Land vorgesehene Gelder aus dem Gemeinschaftshaushalt eingefroren hat.
Ob bei dem Gipfel am Donnerstag ein Kompromiss gefunden werden kann, ist unklar. EU-Staaten wie Deutschland und Polen haben nach Angaben von EU-Diplomaten zuletzt klar ausgeschlossen, dass Orban ein jährliches Überprüfungsrecht für die Ukraine-Hilfen eingeräumt wird.
EU-Ratspräsident Charles Michel ließ am Dienstag ankündigen, dass es bereits am Vorabend des Gipfels bei einem Essen informelle Gespräche geben solle. Zu diesen wurde auch der deutsche Bundeskanzler Olaf Scholz erwartet. Sollte dabei keine Lösung mit Ungarn gefunden werden, wollen die anderen EU-Staaten im 26er-Kreis – also ohne Ungarn – handeln.
Auch Polens Regierungschef Donald Tusk sprach sich für ein Ergebnis notfalls ohne die Zustimmung Ungarns aus. “Wir werden so oder so eine Lösung finden, mit oder ohne (Viktor) Orban, um die Ukraine zu unterstützen”, sagte Tusk am Dienstag. Orban sei der einzige europäische Politiker, “der so offen anti-ukrainisch ist”, sagte Tusk.
Polen gehört seit dem Beginn des russischen Angriffskrieges gegen die Ukraine zu den größten Unterstützern und Waffenlieferanten Kiews. Zuletzt gab es jedoch Streit über ukrainische Getreideexporte sowie die Tätigkeit ukrainischer Transportunternehmen in Polen. (dpa/AFP/tas)

New York to expand definition of rape after E Jean Carroll’s case against Trump

New York will expand its legal definition of rape to include various forms of nonconsensual sexual contact, under a bill signed into law by Governor Kathy Hochul on Tuesday.
The state’s current limited definition was a factor in writer E Jean Carroll’s sexual abuse and defamation case against Donald Trump. The jury in the federal civil trial rejected the writer’s claim last May that the former president had raped her in the 1990s, instead finding Trump responsible for a lesser degree of sexual abuse.
The current law defines rape as vaginal penetration by a penis. The new law broadens the definition to include nonconsensual anal, oral, and vaginal sexual contact. Highlighting Carroll’s case at a bill signing ceremony in Albany, the Democratic governor said the new definition will make it easier for rape victims to bring cases forward to prosecute perpetrators. The law will apply to sexual assaults committed on or after 1 September this year.
“The problem is, rape is very difficult to prosecute,” Hochul said. “Physical technicalities confuse jurors and humiliate survivors and create a legal gray area that defendants exploit.”
In Carroll’s case against Trump, which stemmed from an encounter at a Manhattan luxury department store, the judge later said that the jury’s decision was based on “the narrow, technical meaning” of rape in New York penal law and that, in his analysis, the verdict did not mean that Carroll “failed to prove that Mr Trump ‘raped’ her as many people commonly understand the word ‘rape’”.
While various states define rape in different ways, every state criminalizes oral, anal, and vaginal sexual contact that is nonconsensual, according to Sandi Johnson, a senior legislative policy counsel at Rape, Abuse, & Incest National Network. Prior to its new law, New York defined penetration of the vagina or other bodily orifices with anything other than a penis as “sexual abuse” rather than “rape”.
Many other states continue to place unwanted oral or anal sexual contact in a category other than rape.
Johnson said New York’s new guidelines validate what has happened to survivors. Calling a criminal sexual act anything other than rape “kind of sanitizes it”, she said.
At Tuesday’s bill signing, state senator Brad Hoylman-Sigal, who sponsored the legislation, said the new changes would also make it easier for members of the LGBTQ+ community to hold perpetrators of sex crimes accountable.
“We can’t have our laws ignore the reality that so many New Yorkers, particularly LGBTQ New Yorkers, among others, have experienced,” the Democrat said.
“Before today, many of those assaults wouldn’t be able to be classified as rape in New York state,” he said. “But now we fixed that language.”

The acquisition of Activision Blizzard is included in a Microsoft quarterly report for the first time.
It’s time for another round of quarterly reports (for October-December), with Microsoft being the first among major video game companies. As usual, they reported incredible revenue, reaching $62 billion in the quarter, of which $21.9 billion was net income. Considering that Activision Blizzard cost just under $70 billion, that means they recouped about a third of that purchase in three months.
The most interesting part for us is of course gaming, and that includes Activision Blizzard for the first time. This led to the division called Microsoft Gaming increasing its revenue by 49%, and thanks to this, gaming is now bigger for Microsoft than Windows (the biggest is still Cloud followed by Office).
It is worth mentioning that the cost of integrating Activision Blizzard into Microsoft was astronomical, and overall the gaming part of the company still made a loss during the quarter. Considering that 1900 people were laid off last week, mainly from Activision Blizzard, gaming is expected to be profitable already next quarter. Unfortunately, we did not receive any new figures for the number of Game Pass subscribers.

“Мой вывод: нам надо всем работать, чтобы встреча состоялась. Цель не просто встреча. Цель – говорить с соседями, если они не агрессоры, и делать все, чтобы у них была проукраинская позиция”, – отметил руководитель ОП.
Он напомнил, что также недавно состоялась “очень успешная” встреча премьер-министра Украины Дениса Шмыгаля с премьер-министром Словакии Робертом Фицо. Это, по мнению Ермака, продолжение политики Зеленского для объединение всего мира.

The U.S. has to respond to the attack in Jordan. But it shouldn’t attack Iran.

President Biden can’t avoid responding to the killing of three American soldiers in Jordan. But his response shouldn’t include a strike on Iran.
The attack Sunday by Iranian-backed militias against a U.S. facility in northeastern Jordan, which killed three U.S. troops and injured more than 30 more, has understandably caused shock and outrage in Washington. U.S. retaliation is assured, although we don’t know what form that retaliation will take. President Joe Biden said Tuesday that he has made a decision about how to respond, and it wouldn’t be a stretch to assume any U.S. military action will be broader in scope than the U.S. strikes against Iraqi and Syrian militia sites over the last three months.
Some pundits and lawmakers want Biden to include Iran itself on its list of targets. “The only thing the Iranian regime understands is force,” Sen. Lindsey Graham, R-S.C., wrote in a statement after the attack in Jordan. “Until they pay a price with their infrastructure and their personnel, the attacks on U.S. troops will continue.” Sen. Tom Cotton, R-Ark., said anything less than an attack on Iran itself would amount to cowardice on our part and embolden Iran’s leaders.
Underlying all of this chest-thumping is the assumption that U.S. military action would be so painful that Iranian leaders would respond the way we would like them to: by standing down and ordering their proxies in the Middle East to cease further attacks against U.S. troops and installations in the region. Unfortunately, this is a low-probability scenario. Iran’s reaction might confound our expectations. Embarrassed and angered after being struck by American bombs, Iran could up the ante and attack U.S. troops and bases. Washington’s extensive military presence in the region, while commonly viewed as a source of strength, may prove to be a vulnerability by providing Iran a long menu of targets to strike.
U.S. officials are quick to say the U.S. will act “at a time and place of its choosing.” But the U.S. doesn’t have a monopoly on choosing when and where to attack. If Iran were attacked, then it, too, would most likely take time to explore its options before responding, and that response might not be immediate. It also might not be what American leaders anticipate. The roughly 45,000 U.S. troops stationed in the Middle East would have to be placed on high alert for an extended period, if only to prepare for the worst. U.S. forces in Iraq and Syria, who have already been attacked more than 160 times since mid-October, would be at the most risk.
Iran’s retaliation could range from using ballistic missiles to strike U.S. bases in Iraq and Syria to stepping up its shipments of weapons to militias aligned with it. The commander of U.S. forces in the Middle East estimates that Iran possesses thousands of ballistic and cruise missiles, more than any other state in the region. At least some of those missiles can reach large U.S. bases, including Al Udeid Air Base in Qatar, the U.S. Navy’s Fifth Fleet based in Bahrain and Al Dhafra Air Base in the United Arab Emirates, as well as Jordan’s Muwaffaq Salti Air Base.
Iran could also retaliate more discreetly and decide not to go against the U.S. in a conventional conflict it would surely lose. While Iran’s conventional military power is lacking — its air force relies on parts from the 1970s, its land forces haven’t fought a war since the 1980s, its navy can’t project beyond a limited area and is primarily focused on defending Iranian territorial waters from foreign attack — Tehran’s proxy network is formidable and well-suited to using asymmetric tactics against a superior adversary.
Lebanese Hezbollah, for instance, possesses about 150,000 missiles, some precision-guided, that could reach all of Israel’s major cities; destroy civilian infrastructure, like airports, ports and the electricity grid; and essentially shut down the country during a full-scale conflict.
The Houthis, the militia-turned-de facto government in Yemen, have already demonstrated their resolve to fight by conducting dozens of attacks against commercial ships in the Red Sea, disrupting global supply chains and forcing large corporations like BP to stay clear. Even U.S. warships aren’t immune from Houthi anti-ship missiles.
Let’s set these details aside and return to the larger point. Those pressing for U.S. military action against Iran wrongly assume that Tehran would necessarily buckle under American pressure. Tehran’s behavior during the last five years invalidates this belief.
When the Trump administration withdrew from the Joint Comprehensive Plan of Action in 2018 and put maximum pressure on the Iranian economy, Iranian leaders retaliated by increasing the quality and quantity of their uranium enrichment and targeting oil tankers in the Persian Gulf. After Trump ordered the assassination of Iranian Gen. Qassem Soleimani in January 2020, Iran targeted a U.S. base in Iraq using ballistic missiles. (Miraculously, no Americans were killed.) And when Israel ratcheted up its attacks on Iranian vessels at sea, Iran mimicked Israeli tactics by going after Israeli-owned ships. 
President Biden can’t, of course, avoid a response to the killing of three American soldiers. But those advising him to go after Iran directly shouldn’t assume they know how Iran will react. Nor should they assume that the consequences of an Iranian response can be predicted or managed.
