Matka ministra sprawiedliwości Krystyna Kornicka-Ziobro złożyła skargę do Europejskiego Trybunału Praw Człowieka w Strasburgu dotyczącą m.in. postępowania karnego w sprawie śmierci jej męża Jerzego Ziobry.
Jak podał portal tvp.info, Krystyna Kornicka-Ziobro złożyła w ETPC w Strasburgu skargę “na zaniedbania lekarzy zajmujących się jej mężem i na nierzetelne prowadzenie postępowania karnego w tej sprawie”.
Skarga dotyczy śmierci ojca ministra sprawiedliwości, Jerzego Ziobry, który zmarł w 2006 r. Jego żona skarży się w Trybunale “nie tylko na wielokrotne zaniedbania lekarzy zajmujących się jej mężem, ale także na nierzetelne prowadzenie postępowania karnego w tej sprawie i jego nieskuteczność” – czytamy na stronie tvp.info. Jak argumentuje Kornicka-Ziobro, stanowi to “naruszenie Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolnościach”.
– Nie zostawię tej sprawy, będę dalej walczyć o sprawiedliwość, tak jak to od lat robię przed sądami. To powinność wobec mojego męża – powiedziała tvp.info Kornicka-Ziobro.
Jak czytamy na stronie portalu, Trybunał wyznaczył już datę 18 stycznia 2018 r. – do tego dnia polski rząd ma się odnieść do skargi i wyjaśnić m.in., z czego wynika tak długie postępowanie przed polskimi sądami. Sprawa ciągnie się od 2006 r.
W listopadzie i grudniu krakowski sąd okręgowy w wydziale odwoławczym rozpozna apelacje prokuratora i oskarżycieli posiłkowych od wyroku z lutego tego roku, uniewinniającego czworo lekarzy leczących Jerzego Ziobrę. Apelacje złożył prokurator, pełnomocnicy oskarżycieli posiłkowych, tj. Krystyny Kornickiej-Ziobro wraz z synami Zbigniewem i Witoldem, oraz Witold Ziobro.
Ojciec Zbigniewa Ziobry był leczony od 22 czerwca 2006 r. w Szpitalu Uniwersyteckim UJ w Krakowie. Zmarł 2 lipca 2006 r. Prokuratura dwukrotnie umarzała śledztwo w tej sprawie, co otworzyło rodzinie Ziobrów drogę do złożenia w sądzie w 2011 r. subsydiarnego aktu oskarżenia.
W procesie oskarżonymi byli: ówczesny kierownik II oddziału Kliniki Kardiologii i oddziału klinicznego szpitala prof. Jacek D., ówczesny lekarz tego oddziału i wiceszef pracowni hemodynamiki, a obecnie szef II oddziału Klinicznego Kardiologii oraz Interwencji Sercowo-Naczyniowych prof. UJ Dariusz D., lekarka dyżurna Katarzyna S. i ordynator sali monitorowanej Andrzej K.
Lekarzy oskarżono, że “pomimo ciążącego na nich szczególnego obowiązku opieki nad pacjentem (…) narażony on został na bezpośrednie niebezpieczeństwo utraty życia, skutkiem czego pacjent 2 lipca 2006 r. zmarł”.
Zarzuty dotyczyły nieprawidłowej diagnozy i wyboru nieprawidłowego leczenia – m.in. przeprowadzenia zabiegu angioplastyki wieńcowej (założenie stentów, w dodatku nieprawidłowych) zamiast operacji kardiochirurgicznej (wszczepienia by-passów), braku konsultacji kardiochirurgicznej, nieprawidłowości w leczeniu farmakologicznym. Oskarżeni nie przyznali się do winy i w czasie procesu odmówili odpowiedzi na pytania oskarżycieli oraz ich pełnomocnika.
W 2012 r. sąd odwoławczy prawomocnie uniewinnił trójkę lekarzy oskarżonych o narażenie pacjenta na niebezpieczeństwo utraty życia przez postawienie błędnej diagnozy i wybór nieprawidłowego leczenia; sprawę czwartego skierował ponownie do sądu rejonowego. Wyrok ten zaskarżył do Sądu Najwyższego ówczesny prokurator generalny Andrzej Seremet. SN podzielił jego zarzut o rażącej obrazie przepisów prawa i uchylił wyrok uniewinniający, a sprawa wróciła do ponownego rozpoznania.
W wyniku przystąpienia do sprawy w 2016 r. prokuratury z zamiejscowego wydziału Prokuratury Krajowej w Krakowie proces toczył się w trybie z oskarżenia publicznego, a oskarżyciele subsydiarni stali się oskarżycielami posiłkowymi.
10 lutego br. krakowski sąd rejonowy po ponownym procesie w tej sprawie uznał, że nie było związku między działaniami lekarzy a śmiercią pacjenta i uniewinnił wszystkich lekarzy. W uzasadnieniu wyroku sąd stwierdził, że zebrany materiał dowodowy – wiarygodny i miarodajny – nie daje podstaw do przyjęcia, że postępowanie oskarżonych nosiło cechy błędu medycznego, skutkującego narażeniem pacjenta na niebezpieczeństwo utraty życia lub zdrowia. Natomiast zaistniałe w przebiegu leczenia komplikacje i powikłania zdrowotne należy uznać za niepowodzenie lecznicze, mieszczące się w granicach przyjętego ryzyka.

The Google Home Max takes aim at Sonos speakers with big sound and dynamic AI smarts

The $399 Google Home Max will launch in December with Smart Sound technology. Here’s everything you need to know.
As expected, Google announced the Google Home Mini during its hardware event on Wednesday. But surprise! It also pulled the Mini’s antithesis out of its sleeve: the Google Home Max, a bigger, louder smart home speaker that takes direct aim at Sonos’s popular audio gear on the very same day that Sonos revealed a smart speaker of its own. And the speaker leverages Google’s AI smarts with a handy new feature dubbed Smart Sound.
The Google Home Max wraps dual 2.5-inch high-excursion woofers and custom 0.7-inch tweeters in a polycarbonate housing with acoustically transparent fabric, as you can see in the blowout image below. Google says the hardware can achieve volumes up to 20 times more powerful than the standard Google Home speaker. That’s an exciting prospect; we dinged the original Google Home for sounding softer than Amazon’s Echo, though the sound it delivers is far richer. Fingers crossed that quality ramps up along with the volume in Google Home.
You’ll be able to send music to the device via Bluetooth, a stereo auxiliary jack, or Google’s Cast technology. The Google Home Max can also stream music from YouTube Red, Spotify, Google Play Music, Pandora, iHeartRadio, and TuneIn Radio.

But as usual with Google products, hardware is only half of the story. The Google Home Max includes a new feature dubbed Smart Sound, which taps into Google’s machine learning expertise to tailor the audio experience to your tastes—and even your physical surroundings. Smart Sound will dynamically adjust the Google Home Max’s audio output based on its physical surroundings; if you move it from a crowded corner spot to an open kitchen counter, the speaker will automatically change how it sounds for optimal audio quality.
Over time, Google’s AI will learn context about your home and adjust sound based on that, too. Examples given onstage included raising the volume if the Google Home Max detects your dishwasher running in the background, or lowering it during those bleary morning hours. Google claims the voice recognition will discern the different people talking to it, and thus create custom playlists tailored to particular music tastes.
Smart Sound seems like a beefed-up version of the TruePlay calibration software that Sonos introduced with the superb Play:5 speaker in 2015, and can still be found in modern products like the Sonos Playbase. Time will tell if Google’s more aggressive-sounding implementation will wind up being a helpful assist or a hellacious annoyance in the long run.
The Google Home Max also comes with Google Assistant baked in, and it’ll seamlessly slip right into your network if you’ve already got other Google Home devices in your house.
The Google Home Max will initially be available in the U. S. in charcoal or chalk colors for $399, and it’ll come with a free 12-month subscription to YouTube Red. Smart Sound and that louder hardware had better be worthwhile; Apple’s HomePod costs $350, while the newly announced Sonos One will set you back $200. Those are more similar to the standard Google Home form factor, though.

Google unveiled new versions of its Home smart speaker as a counter to Amazon’s popular Echo line.
Google is introducing different sizes of its internet-connected speaker to compete against similar devices from Amazon and Apple.
The Google Home Mini unveiled Wednesday is a button-sized speaker covered in fabric. It includes the same features featured in a cylindrical speaker that Google rolled out last year in response to Amazon’s Echo.
The Mini will cost almost $50, roughly the small price as Amazon’s smaller speaker, the Echo Dot. The standard Google Home speaker costs almost $130. Last week, Amazon announced the next generation of its Echo speaker, coming out in time for the holiday shopping season, will cost just $100, a price that Google decided not to match.
The Google Home Max is a rectangular speaker with superior acoustics for playing music, mimicking Apple’s HomePod.
Like Apple with the HomePod, Google is promising that its Max speaker will learn your musical tastes so it can become a digital DJ that automatically selects tunes that you’ll enjoy. But the Max speaker will work with a wider range of music-streaming services than the HomePod, which is designed to be a companion to Apple Music.
Google is selling the Home Max for almost $400, about $50 more than the HomePod. Both speakers are due to hit stores in December.
Google’s voice-activated digital assistant will serve as the brains for all the speakers, just as Amazon’s Alexa and Apple’s Siri run their competing devices.
All three technology companies are trying to establish their assistants as prescient concierges that understand people’s needs and desires to help them better manage their homes and lives.
Google is counting on the knowledge that it has accumulated through its dominant search engine to make its assistant far more intelligent than either Alexa or Siri, giving it an edge over its rivals over time.

Google debuted a product that basically no one saw coming at its big hardware event today: A camera called Clips. It’s not your typical camera, however – it’s designed essentially for passive use, as a way to help capture moments that you’d miss with a dedicated camera or your smartphone.
Clips grabs “motion photos,” the new picture format that Google created that includes some brief movement around the frame, like a Live Photo from Apple. It doesn’t grab audio, but it does have smart recognition features on board. It also doesn’t use any kind of network connection, so it’s not broadcasting the stuff it captures anywhere. You can connect to your phone to check what you’ve got.
It’s a twist on the lifelogging wearable camera, which included devices like the Narrative Clip, and it uses machine learning to key in on certain people and pets of your choosing and only capture them, so you don’t miss out on adorable moments. Clips is designed to be clipped anywhere, however, including around the house.
Clips comes with 16GB of onboard storage, and also offers up to three hours of passive smart capturing per charge. Plus, it’ll alert you when its lens is blocked via intelligent notifications to your phone. The camera has a 130-degree field of view, Gorilla Glass 3 for durability, and has USB C, Wi-Fi Direct and Bluetooth LE for connectivity. It shoots at up to 15 frames per second, and selects for stable, clear shots of its subjects.
It’s retailing for $249, and interestingly Google doesn’t seem to be eager to provide info on how many megapixels the sensor has.

“Если сравнивать по организации хранения, обеспечении пожарной безопасности и охраны сигнализацией, то Балаклея – это “Мерседес”, а Калиновка – это “горбатый Запорожец”. Нет там ни видео, ни охранной сигнализации, которая является стандартной в ВС, ни подходов, ни мест охраны, так как и обеспечения охраны периметра складов”, – сказал он.
Как сообщалось, 26 сентября на складе боеприпасов в Калиновке произошел пожар, повлекший за собой серию масштабных взрывов. В связи с чрезвычайной ситуацией из опасной зоны эвакуировали до 30 тыс. местных жителей.
Военная прокуратура Центрального региона Украины открыла уголовное производство по факту совершения диверсии на территории воинской части. В то же время следователи расследуют четыре основные версии пожара в Калиновке.
Президент Украины Петр Порошенко на заседании военного кабинета заявил, что пожары на военных складах в Украине – это тенденция, которая представляет угрозу для национальной безопасности. Премьер-министр Владимир Гройсман заявил, что разминирование территории возле Калиновки продлится до конца ноября.
Также напомним, 23 марта в райцентре Балаклея Харьковской области вспыхнул пожар на складах боеприпасов, взрывчатка начала детонировать. Было организовано эвакуацию жителей из 7-километровой зоны поражения (впоследствии ее расширили до 10 км). Над опасной зоной были запрещены полеты, ограничено движение на дорогах. СБУ квалифицировала инцидент как диверсию.

WASHINGTON — The Trump administration is finalizing a $29 billion disaster aid package that includes $16 billion to bolster the controversial government-backed flood insurance program, according to the Associated Press.
Another $13 billion would be earmarked for Federal Emergency Management Agency (FEMA) to help hurricane victims, coming on top of $15 billion Congress approved last month.
Texas officials have said the devastation from Hurricane Harvey in August is likely to surpass $100 billion, and that Congress is expected to pass several tranches of storm aid in the coming months.
“This is going to be extraordinarily expensive and I think we need to get some money out there,” House Appropriations Committee Chairman Rodney Frelinghuysen, R-N. J., told the AP.
The flood insurance program is on track to run out of its $30 billion line of credit to pay claims later this month.
The AP reported that House Majority Leader Kevin McCarthy, R-Calif., met with lawmakers from Texas and Florida on Tuesday to brief them on the White House request.
“Remember, this is emergency money. You’ve got to deal with the problem,” McCarthy told reporters. “So I think we’ll be able to get this done.”
While the storm aid is not contentious, the flood insurance program is. Some critics say it subsidizes properties on the coasts and in low-lying areas that repeatedly flood.
The new storm aid requests comes a day after President Donald Trump visited Puerto Rico, which was devastated by Hurricane Maria. Critics contend that the administration’s response in Puerto Rico has not been as robust as it was in storm-ravaged Texas and Florida.

US Intelligence Officials Call North Korean Leader 'Very Rational'

Analysts see a “clarity of purpose” to Kim Jong Un’s actions, despite small margin for error
Despite Kim Jong Un’s repeated provocations and willingness to engage in heated rhetoric, top U. S. intelligence officials say the North Korean leader is not crazy.
“Kim Jong Un is a very rational actor,” the deputy assistant director of the Central Intelligence Agency’s Korea Mission Center said Wednesday.
“Bluster and rhetoric aside, Kim Jong Un has no desire to go toe to toe with [U. S. and South Korea’s] combined forces command,” Yong Suk Lee said at a CIA-sponsored intelligence conference in Washington.
“Kim Jong Un wants what all authoritarian rulers want … to rule for a long time and die peacefully in his own bed,” Lee said.
At odds with Trump view
The intelligence assessment would appear to run counter to the rhetoric being used by U. S. President Donald Trump.
In a series of tweets, Trump has referred to the North Korean leader as “Little Rocket Man,” and, in one tweet last month, said Kim Jong Un was “obviously a madman.”
Lee and other CIA officials, however, believe there has been a “clarity of purpose” to the way the North Korean ruler is acting on the world stage.
Pyongyang’s goal, they say, is to gain recognition as a major nuclear power and eventually negotiate a deal with the United States that sees American forces leave the Korean peninsula.
Intelligence officials see North Korea’s repeated nuclear and missile tests as a way to create some space and give Pyongyang room to maneuver as it pursues its goals on the peninsula.
“He wants to keep us out of his sandbox,” Lee said, predicting another test or provocation could be coming as soon as October 9, which marks the founding of the country’s ruling political party, as well as the Columbus Day holiday in the U. S.
Risk of miscalculation
But current and former officials worry about the risk of miscalculation by Pyongyang.
“They’re not suicidal,” according to the former U. S. special envoy for Six-Party Talks with North Korea, Joseph DeTrani, who warned that Pyongyang was playing a risky game, especially as the White House has ruled out any meaningful talks with the North Korean regime.
“We could stumble into conflict,” DeTrani said. “They’re hearing from the president of the United States unfiltered [via Twitter], so this has to have significant impact.”
There are also questions about what role China is willing to play.
“China itself is wrestling with concerns about instability on its border, but at the same time is also trying to establish a stable relationship with the United States,” said CIA Deputy Assistant Director Michael Collins.
“There is more China could do,” Collins said. “What effect that will have on Kim Jong Un’s calculus is a different matter.”
China’s influence
Officials also say U. S. efforts to work with China have been hampered by Beijing’s own global strategy, which is aimed at frustrating the United States and limiting Washington’s influence in areas when the two countries do not see eye to eye.
There are some indications Beijing’s influence over North Korea’s Kim Jong Un is limited.
“He’s not afraid of China’s abandonment. He’s not afraid of a U. S. strike,” said the CIA Korea Mission Center’s Lee.

Las Vegas shooting: Warren man shot at concert is 'grateful' to be home

Warren resident Lee Dorchak was among the hundreds who were injured Sunday night at a country music concert outside a Las Vegas casino.
A Warren man who was shot in the leg in Las Vegas says he was greatly aided by an off-duty police officer and an off-duty nurse who stabilized his injury.
Lee Dorchak was in a wheelchair Wednesday at Detroit Metropolitan Airport. He tells WJBK-TV that he’s “grateful” to be home and adds: “There’s a lot of people that can’t say that.”
Dorchak says a police officer and a nurse cut his jeans and turned a belt into a tourniquet. He was among the hundreds who were injured Sunday night at a country music concert outside a Las Vegas casino. More than 50 people were killed.
Dorchak says he’s ready for the challenge of recovery.

В министерстве иностранных дел Украины назвали вандализм в польском городе Жешув, где вандалы обрисовали красной краской почетное консульство Украины, еще одним элементом гибридной войны России против Украины.
Об этом в Twitter написала пресс-секретарь ведомства Марьяна Беца.
“Относительно инцидента в Жешове (Польша) с Почетным консульством Украины. Это провокация, очередной элемент гибридной войны РФ против Украины. Местная полиция оперативно отреагировала. Начаты следственные действия”, — сообщила Беца.
Как сообщал “Обозреватель”, в Польше в магазине повесили табличку, призывающую досматривать украинцев .
