Japan’s Supreme Court rejects ‘right to be forgotten’ case against Google

NewsHubJapan’s Supreme Court has rejected a man’s demand that news search results of his arrest on sex charges be deleted from Google, ruling that to do so would violate freedom of expression. Japanese media said it was the first decision by the nation’s top court involving the “right to be forgotten” relating to internet searches. “The deletion [of references to the charge] can be allowed only when the value of privacy protection clearly outweighs that of information disclosure,” the court said in a statement posted on its website. Tuesday’s decision came after the Saitama District Court, north of Tokyo, in December 2015 upheld a temporary injunction against Google ordering it to delete search results about a man convicted on charges related to child prostitution and pornography. The Tokyo High Court last July had overturned the lower court decision, saying there was no such legally protected right. While the top court set strict conditions for allowing the deletion of certain references, it did not mention the “right to be forgotten” recognised in 2016 in overhauled EU rules on Internet data protection. The Supreme Court said conditions for deleting search engine results include factors such as the degree of damage caused to privacy, how broadly specific searches can be carried out and the social standing of individuals in question. Tomohiro Kanda, the man’s lawyer, called the decision “disappointing,” saying that ensuring a crime is remembered differs from having the name of a person associated with it “passed on for many years”. The Japanese office of Google welcomed the ruling. “We’re pleased that with these latest rulings, the Supreme Court has unanimously recognised… that any decision to delete information from search results should prioritise the public’s right to information,” it said in a statement.

Washington – The Republican-controlled Senate on Wednesday confirmed Rex Tillerson to be secretary of state, a crucial member of President Donald Trump’s national security team.
Tillerson was quickly sworn in during a ceremony in the Oval Office, where Trump showered him with praise.
“You understand that the job of our diplomats and the mission of the State Department is to serve the interests of the United States of America to make our nation safer, our country more prosperous and our country much more secure,” the president told him. “I do believe we can achieve peace and stability in these very, very troubled times. ”
Senators voted 56-43 to approve the former Exxon Mobil CEO after Democrats mounted a vocal yet unsuccessful campaign to derail the bid. They said they feared his four-decade career at the energy giant meant he’d view the world only through the lens of a corporate executive and questioned whether he would confront Trump when he believes the president is wrong.
Close relationship with Putin
But Republicans rejected the complaints and declared Tillerson highly qualified for the job. He’ll have his hands full as soon as he’s sworn in, grappling with many of the same geopolitical dilemmas his predecessors did. As senators cast their ballots, the Trump White House put Tehran “on notice” after the Iranian military tested a ballistic missile and allied rebels in Yemen attacked a Saudi naval vessel in the Red Sea.
Tillerson also will have to deal with any fallout stemming from Trump’s executive order on immigration and travel that halts entry for 90 days to citizens from seven majority-Muslim nations.
“I am confident Rex Tillerson has the ability to be the effective leader the State Department needs,” said Sen. Bob Corker, R-Tenn., chairman of the Foreign Relations Committee.
Corker cast Tillerson’s experience at Exxon Mobil as a plus, saying he led a global enterprise with 75 000 employees and forged “deep relationships” with world leaders.
One of those, with Russian President Vladimir Putin, alarmed his opponents on Capitol Hill who believed he was too cozy with the Russian leader and wouldn’t push back aggressively enough when Moscow acted against US interests. Tillerson received an honourific — the Order of Friendship — from Putin’s government in 2013.
Trump’s ‘yes man’
Wednesday’s vote to confirm Tillerson came exactly three weeks after a rocky confirmation hearing before the Foreign Relations Committee. Sen. Marco Rubio, R-Fla., clashed with Tillerson, bridling at his refusal to label Putin a “war criminal” and his failure to condemn human rights violations in Saudi Arabia and the Philippines in strong enough terms. He chided Tillerson over the need for “moral clarity. ”
But in the end, Rubio fell in line again and backed the nomination.
Rubio had unsuccessfully opposed Trump for the GOP nomination last year before coming around to support him.
Democrats pressed their case against Tillerson right up until the vote. Sen. Ben Cardin of Maryland, the top Democrat on the Foreign Relations Committee, said Tillerson is unlikely to steer Trump away from pursuing an “unstable, reckless foreign policy. ”
Cardin said Tillerson’s “timid equivocation on American values” throughout his confirmation process led him to predict Tillerson will be a “yes man” to Trump, unable to prevent “the risky, chaotic whims of a demagogue president who is leading us on a march of folly. ”
Three Democrats — Joe Manchin of West Virginia, Heidi Heitkamp of North Dakota and Mark Warner of Virginia — cast their ballots for Tillerson. So did Sen. Angus King, a Maine independent. Manchin, Heitkamp and King face re-election in 2018. Trump carried West Virginia and North Dakota last year.

Iran official opts out of Asian election for FIFA position

NewsHubIranian soccer official Ali Kafashian has dropped out of an election to join the FIFA Council, and officials from South Korea and Philippines have entered.
The Asian Football Confederation says four men are competing for three seats on the ruling council at a rescheduled election on May 8 in Bahrain. The contenders are Zhang Jian of China, Sheik Ahmad Al Sabah of Kuwait, Mariano Varaneta of Philippines and Chung Mong-gyu of South Korea.
The original election meeting in September was stopped after the FIFA ethics committee barred Saoud Al-Mohannadi of Qatar from running. Then, AFC vice president Kafashian was a candidate.
Sheik Ahmad, an influential IOC member, is seeking to retain his FIFA position despite Kuwait’s suspension from world soccer and the Olympic movement since 2015 because of government interference.

Nestle Japan on Thursday opened a new Chocolatory in Tokyo’s Ginza area, unveiling their mind-blowing sushi KitKat as well as brand-new Valentine’s KitKat items. 
Nestle Japan never ceases to amaze with their innovative ideas in producing chocolate sweets in a variety of forms. Their KitKat Chocolatory, whose idea was developed by Chef Yasumasa Takagi from Le Patissier Takagi, has attracted over 1.5 million people in Japan since the opening of its first shop in 2014.
The idea of sushi KitKat goes back to last year’s April Fools’ Day, when the company jokingly posted on SNS a photo of a KitKat put on sushi rice—a joke which they found was unexpectedly well-received. Swiss sanction RBS unit over lapses linked to Malaysian fund

NewsHubSwitzerland’s financial markets regulator on Thursday sanctioned a private bank linked to Royal Bank of Scotland for having “seriously breached” money laundering rules in connection with indebted Malaysian sovereign wealth fund 1MDB.
Regulator FINMA said Coutts & Co. Ltd, a wealth manager with over three centuries of history, failed to fully monitor and report glaringly suspicious business activity through 1MDB that included tens of millions of dollars spent on casinos, yachts and private jets.
It has ordered Coutts to hand over to the Swiss government “unlawfully generated profits” of 6.5 million Swiss francs ($6.6 million), and said it is considering enforcement measures against the employees responsible.
Investigators in Singapore, Switzerland, Hong Kong and the U. S. have been probing allegations that people close to Malaysian Prime Minister Najib Razak stole more than $1 billion from 1MDB, or 1Malaysia Development Bhd.
FINMA cited “serious deficiencies” in the anti-money laundering processes at the Swiss arm of Coutts, the first local bank to accept assets from individuals with what would become the Malaysian fund. It said a total of $2.4 billion in 1MDB-related assets moved through Coutts accounts in Switzerland.
“Coutts & Co. Ltd. has seriously breached money laundering regulations by failing to carry out adequate background checks into business relationships and transactions associated with Malaysian sovereign wealth fund 1MDB,” FINMA said in a statement .
It faulted Coutts’ Swiss operations for failing to report suspicions inside the bank to authorities until the spring of 2015 despite “the existence of substantive evidence. ”
In particular, FINMA cited the case of one unspecified Malaysian businessman who started doing business with Coutts in Zurich in mid-2009, with indications that his family would transfer $10 million into an account. Months later, some $700 million was transferred in from 1MDB, FINMA said, and documents provided in support of the transaction contained “obvious mistakes” — including mixing up of identities.
“A member of the bank’s compliance unit noted in an internal email: ‘It would be the first time in my career that I would see a case where (in) an agreement over the amount of $600 million or so, the role of the parties has been confused,'” FINMA said. Coutts’ own legal services unit even cited the risk of a “total fabrication,” FINMA added.
FINMA said numerous “high-risk transactions” continued through early 2013. And that at one point, Coutts “took no action to clarify the use of $35 million for visits to casinos and the purchase of a range of luxury services” like the chartering of yachts and private planes.
In a statement, RBS welcomed the end of the probe and regretted “any historic failings” in its anti-money laundering processes.
RBS has been winding down Coutts’ international operations after selling the majority of its assets to Swiss private bank Union Bancaire Privee last year in hopes of converting Coutts into a Britain-focused bank.
Aside from Coutts, FINMA has launched proceedings against five other banks and announced action against BSI Bank and Falcon Private Bank AG last year.
Regulators in Singapore last month fined the local Coutts branch 2.4 million Singapore dollars ($1.7 million) for inadequate customer due diligence on “politically exposed persons. “

US investigating more possible civilian deaths in Yemen raid on al Qaeda

NewsHubThe U. S. military said on Wednesday it was looking into whether more civilians were killed in a raid on al Qaeda in Yemen on the weekend, in the first operation authorized by President Donald Trump as commander in chief.
U. S. Navy SEAL William “Ryan” Owens was killed in the raid on a branch of al Qaeda, also known as AQAP, in al Bayda province, which the Pentagon said also killed 14 militants. However, medics at the scene said about 30 people, including 10 women and children, were killed.
U. S. Central Command said in a statement that an investigating team had “concluded regrettably that civilian non-combatants were likely killed” during Sunday’s raid. It said children may have been among the casualties.
Central Command said its assessment “seeks to determine if there were any still-undetected civilian casualties in the ferocious firefight. ”
U. S. military officials told Reuters that Trump approved his first covert counterterrorism operation without sufficient intelligence, ground support or adequate backup preparations.
As a result, three officials said, the attacking SEAL team found itself dropping onto a reinforced al Qaeda base defended by landmines, snipers, and a larger than expected contingent of heavily armed Islamist extremists.
The Pentagon directed queries about the officials’ characterization of the raid to U. S. Central Command, which pointed only to its statement on Wednesday.
“CENTCOM asks for operations we believe have a good chance for success and when we ask for authorization we certainly believe there is a chance of successful operations based on our planning,” CENTCOM spokesman Colonel John Thomas said.
“Any operation where you are going to put operators on the ground has inherent risks,” he said.
The U. S. officials said the extremists’ base had been identified as a target before the Obama administration left office on Jan. 20, but then-President Barack Obama held off approving a raid ahead of his departure.
A White House official said the operation was thoroughly vetted by the previous administration and that the previous defense secretary had signed off on it in January. The raid was delayed for operational reasons, the White House official said.
The military officials who spoke to Reuters on condition of anonymity said “a brutal firefight” killed Owens and at least 15 Yemeni women and children. One of the dead was the 8-year-old daughter of Anwar al-Awlaki, a militant killed by a 2011 U. S. drone strike.
Some of the women were firing at the U. S. force, Pentagon spokesman Captain Jeff Davis told reporters.
INTELLIGENCE GATHERED
The American elite forces did not seize any militants or take any prisoners offsite, but White House spokesman Sean Spicer said on Wednesday the raid yielded benefits.
“Knowing that we killed an estimated 14 AQAP members and that we gathered an unbelievable amount of intelligence that will prevent the potential deaths or attacks on American soil – is something that I think most service members understand, that that’s why they joined the service,” Spicer said.
A senior leader in Yemen’s al Qaeda branch, Abdulraoof al-Dhahab, and other militants were killed in the gunbattle, al Qaeda said.
One of the three U. S. officials said on-the-ground surveillance of the compound was “minimal, at best. ”
“The decision was made… to leave it to the incoming administration, partly in the hope that more and better intelligence could be collected,” that official said.
As Sunday’s firefight intensified, the raiders called in Marine helicopter gunships and Harrier jump jets, and then two MV-22 Osprey vertical takeoff and landing aircraft to extract the SEALs.
One of the two suffered engine failure, two of the officials said, and hit the ground so hard that two crew members were injured, and one of the Marine jets had to launch a precision-guided bomb to destroy it.
Trump traveled to Dover Air Force Base in Delaware on Wednesday in an unexpected visit to meet the family of Owens, who had been a chief special warfare operator.

Police investigating after man shot, killed on Detroit's west side

NewsHubDETROIT (WXYZ) – Detroit police are investigating after a 34-year-old man was shot and killed on the city’s west side this morning.
It happened outside of a motorcycle club on Woodrow Wilson around 4 a.m.
Several bullet casings could be seen on the ground.
Police say the victim was involved in a verbal altercation with another person before he was shot.
No word on any arrests.
