On the same day the United States registered a record number of coronavirus cases, the Trump administration argued to the Supreme Court that Obamacare, the health insurance program serving over 20 million Americans, should be invalidated. For those wondering about the inconsistency of those two facts, perhaps the answer is more simple than many of us wish to believe:
Perhaps cruelty is the point?
Since its start, the Trump administration has been consistent in its argument against the Affordable Care Act (ACA), commonly known as Obamacare. Trump ran for election on a vow to “repeal and replace” the legislation. After failing to do so in the early days of his presidency, Trump’s administration, along with government officials from 20 states, has endeavored to convince the courts to invalidate it. In the filing in Thursday, the administration and a consortium of states, led by Texas, reaffirmed its position that Obamacare is illegal simply because Congress eliminated the individual tax penalty for failing to purchase medical insurance. The Supreme Court is expected to hear arguments in the related cases, referred to as State of California, et al., v. State of Texas, et al. (19-840) and State of Texas, et al., v. State of California, et al. (19-1019) in the fall, although it is uncertain if there would be a ruling prior to the November presidential election.
