A federal judge in Texas temporarily halted a Biden administration program that offered legal status to undocumented immigrants married to U.S. citizens on Monday, ruling in favor of 16 Republican attorneys general who had filed a legal challenge arguing the program was unconstitutional and could incentivize unauthorized immigration.Key Facts
Federal Judge J. Campbell Barker issued an administrative stay and wrote in his ruling that the claims made by the states were “substantial and warrant closer consideration than the court has been able to afford to date.”
The stay will be in effect for at least 14 days, with the possibility of further extensions, blocking the Biden administration from approving any applications, although it can continue to accept them.
