Lawyers for Yunseo Chung, who came to the U.S. with her family from South Korea at the age of 7, filed a lawsuit seeking to block her arrest and deportation.
A federal judge has temporarily blocked the arrest and deportation of a 21-year-old Columbia University student and legal permanent resident who has been involved in pro-Palestinian protests.
U.S. Immigration and Customs Enforcement officials have been looking for Yunseo Chung, who came to the U.S. with her family from South Korea at the age of 7, since earlier this month, including by visiting her parents’ residence and telling her lawyer that there’s an administrative warrant for her arrest, according to a lawsuit filed Monday in federal court.
ICE issues so-called administrative warrants against noncitizens accused of immigration violations. They are not signed by judges.
On Tuesday, Judge Naomi Reice Buchwald, who was nominated in 1999 by President Bill Clinton, granted Chung’s attorneys a temporary restraining order, preventing her from being arrested or deported.
Buchwald also ordered that if the Trump administration tries to detain Chung «on any asserted basis other than pursuing her removal under 8 U.S.C. § 1227(a)(4)(C). Defendants-Respondents are ordered to provide sufficient advance notice to the Court and counsel, in order to enable Plaintiff Petitioner an opportunity to be heard regarding whether any such asserted basis for detention constitutes a pretext for First Amendment retaliation.
