Judge Throws Out Most Serious Charges in Penn State Hazing Case

The judge made his ruling after a pretrial hearing, dismissing a number of felony charges. Lesser charges were left intact.
A Pennsylvania judge on Friday dismissed the most serious charges against eight Penn State fraternity members indicted in the hazing death of a 19-year-old student, sharply and suddenly defanging prosecutors and setting the stage for a new legal battle in the high-profile case.
After a pretrial hearing that had stretched for days, Magisterial District Judge Allen W. Sinclair appeared Friday morning and, over the course of minutes, orally dismissed one serious charge after another — including involuntary manslaughter, aggravated assault and simple assault — against the men who faced them.
Judge Sinclair, who did not explain his reasoning, left intact the lesser charges, including recklessly endangering another person, hazing and furnishing alcohol to a minor. The men face trial on those charges, but the ruling, if it stands, vastly reduces the likelihood that any of the defendants will go to jail.
Stacy Parks Miller, the district attorney for Centre County, who had called the death “heart wrenching and incomprehensible, ” said Friday that the ruling was an “error of law” and vowed to refile at least the involuntary manslaughter charges before a different judge.
“This was disappointing, unexpected and in our view, not supported by the evidence, ” Ms. Miller said in a statement.
The death of the 19-year-old, Timothy Piazza, an engineering student from Lebanon, N. J., in February, after an initiation at the Penn State chapter of Beta Theta Pi, stunned a campus where fraternities are woven deep into the school’s social life.
Mr. Piazza, prosecutors said, was participating in a drinking gantlet in which fraternity pledges drank several kinds of alcohol, and he became intoxicated. At some point, they said, Mr. Piazza tumbled down a flight of stairs.
Chilling video played in court this year showed the fraternity brothers placing his limp body on the couch, plugging their nose at the smell of his vomit, and arguing over what to do. His chest was bruised and his eyes were shut, the indictment said. The brothers hovered over him for much of the night, and he eventually awakened, then passed out again.
The fraternity members did not call for an ambulance until 10: 48 a.m. on Feb. 3, court documents said — nearly 12 hours after Mr. Piazza’s ordeal began.
After Mr. Piazza’s death, Beta Theta Pi was banned from campus and the university’s president, Eric Barron, established new restrictions for Greek organizations, including the banning of liquor and beer kegs. And then, after a two-and-a-half month investigation, a grand jury handed down a sprawling indictment against 18 students. Eight faced involuntary manslaughter charges, and 10 others faced lesser charges.
Defense lawyers, who had argued that prosecutors had vastly overreached, welcomed Friday’s ruling.
“This is a clear and unmistakable signal that the commonwealth’s case, with respect to those charges, was absolutely and unequivocally eviscerated, ” Theodore Simon, a lawyer for Luke Visser, said. “Not every tragedy justifies or warrants criminal prosecution of such serious charges.”
Mr. Visser, who had faced charges including felony aggravated assault and involuntary manslaughter in addition to lesser charges, was relieved by the judge’s ruling, Mr. Simon said.
Hazing-related deaths have long troubled American universities. The Penn State case is among a number of tougher prosecutions that have tried to hold fraternity members and others criminally liable for college episodes that have in the past been seen as tragic — but not criminal.
Judge Sinclair’s decision on Friday is an indication of the hurdles those prosecutions could face, and drew swift rebukes from other lawyers who work on school violence cases.
“It’s a setback in attempting to try and change the culture and allowing this type of stuff to continue, ” said William S. Friedlander, an attorney who represents the family of Michael Deng, who died after a hazing ritual at Baruch College that prompted four men to plead guilty this year.
Mr. Friedlander said the ruling could give prosecutors pause in considering steep charges in similar cases. “It certainly is going to make them think twice, especially in that county, ” he said.
Fourteen of the 18 men originally charged in the case are still set to be tried on the lower charges, with a trial date scheduled for early December.

Сотрудники Главного следственного управления СБУ совместно с контрразведкой Службы задержали женщину, которая была незаконно назначена боевиками исполняющей обязанности директора ЗАО „Луганский патронный завод“ в июне 2014 году и снабжала их боеприпасами.
„Злоумышленница, выполняя незаконные указания вожаков „ДНР/ЛНР“, в частности Болотова и Стрелкова, произвела инвентаризацию более 14 млн зарядов для огнестрельного оружия, хранившегося на предприятии. Она также организовала на мощностях завода изготовление еще почти 2 млн зарядов разного калибра. Боеприпасы „директриса“ передала… представителям террористических организаций, которые использовали их во время боевых действий против сил антитеррористической операции“, – сообщается на официальном сайте СБУ в пятницу.
После очередной смены „руководства“ террористической организации „ЛНР“ злоумышленница была освобождена от должности и длительное время скрывалась от украинского правосудия на временно оккупированных территориях Донбасса и в РФ.
Сотрудники спецслужбы задержали женщину в г. Кременчуг Полтавской области. Задержанной объявлено о подозрении в совершении преступления по ст.258-3 Уголовного кодекса Украины (создание террористической группы или террористической организации) и избрана мера пресечения в виде держания под стражей. Ведется досудебное следствие.

WASHINGTON (AP) – The White House is still trying to decide who will get President Donald Trump’s pledged $1 million donation for Harvey storm relief efforts, one of the largest gifts ever given by a president but one that has evoked his checkered charitable past.
The president plans to make the donation, which is expected to come from his personal fortune, early next week, and it may be split among several groups doing relief work in storm-ravaged areas of Texas and Louisiana. White House press secretary Sarah Huckabee Sanders said Friday that the president hasn’t finalized where the money will go, raising some concern that charitable groups may end up competing for the money.
For the second straight day, Sanders invited reporters to make recommendations for which groups should get the money.
„If you have suggestions, he is very open to hearing those, “ Sanders said.
The president met with three relief groups – the Red Cross, Southern Baptist Relief and Salvation Army – in the Oval Office on Friday and pledged the nation’s support to those affected by Harvey.
„Families have given food and shelter to those in need. Houses of worship have organized efforts to clean up communities and repair damaged homes, “ Trump said during an earlier meeting with religious leaders. „People have never seen anything quite like this. Individuals of every background are striving for the same goal: to aid and comfort people facing devastating losses.“
Trump traveled to Texas on Tuesday and is scheduled to return Saturday to meet with storm survivors and inspect some of the destruction.
There has been some concern that, if Trump opted to donate to only one group or just a few, there could be intense competition among relief agencies for the money and the publicity that comes with it.
But Rick Cohen, communications director for the National Council of Nonprofits, said there’s already intense competition among organizations for Harvey donations.
„He should be looking to make an informed contribution, and it seems that he’s doing so, “ said Cohen, noting that the president has stayed abreast of conditions on the ground and is planning to see it first-hand.
White House officials said the donation would come from the president’s personal fortune and not his business, the Trump Organization, or his charitable foundation.
„You have to take him at his word, “ said Leslie Lenkowsky, a professor at Indiana University who focuses on philanthropy and who formerly headed the Corporation for National and Community Service. „If he wants to lead the way, that’s one of the things that a president’s supposed to do. … He does like the image of himself as a compassionate person.“
Trump’s history of charitable donations features bursts of generosity frequently overshadowed by failed promises and questions about the source of the gifts.
The president has claimed to be worth $10 billion while experts have pegged his fortunate at far less. But Trump reportedly donates a far smaller percentage of his dollars than many of his fellow billionaires. The exact extent of Trump’s charitable giving is not known since the president has broken with decades of tradition and not released his tax returns.
The Trump Foundation came under heavy scrutiny during the 2016 presidential campaign. It was revealed that Trump frequently did not follow through on his charitable promises. Records show that in the 15 years before his campaign, Trump made $8.5 million in pledges but paid out about $2.8 million, according to The Washington Post.
In January 2016, Trump held a high-profile fundraiser for veterans‘ causes, but it took him four months – and pressure from the media – to follow through on his pledge to donate $1 million of his own money to the cause.
Trump, one of the nation’s wealthiest presidents, has also pledged to donate his annual $400,000 salary to charity. His first two gifts from his presidential earnings were to the National Park Service and the Education Department.
Other presidents, including Barack Obama, would customarily donate a percentage of their income – including money from outside sources like book sales – to charity every year.

The tennis star has not played a match since winning her 23rd Grand Slam singles title at the Australian Open on Jan. 28.
Serena Williams has given birth to a girl, according to the United States Open’s official Twitter account and multiple media reports.
The highly anticipated announcement came late Friday afternoon as Serena’s sister Venus Williams romped over another opponent and into the fourth round of the major tennis tournament in Flushing, Queens.
Asked just before her match on Friday about reports of Serena having given birth and about becoming an aunt, Venus Williams told ESPN’s Pam Shriver she was “super excited, ” adding, “Words can’ t describe.”
She then proceeded to defeat Maria Sakkari of Greece in straight sets, 6-3,6-4.
Serena Williams, 35, has not played a match since winning her 23rd Grand Slam singles title at the Australian Open on Jan. 28. It was later discovered that she had been close to two months pregnant at the time, after a photograph was posted on the tennis superstar’s Snapchat story on April 19 that showed her posing sideways in a yellow bathing suit with what looked like a baby bump. The image, which appeared to have been taken in a mirror, was captioned “20 weeks” and was later deleted.
After a wild day of speculation, Williams confirmed she was pregnant. She had unexpectedly announced her engagement to Alexis Ohanian, a businessman and the co-founder of Reddit, months earlier, in December.
A spokeswoman for Williams, Kelly Bush Novak, previously told The New York Times that although Serena would miss the rest of the 2017 season, she intended to return to the circuit in 2018.

Шевченківський районний суд Києва заслухав обвинувальний акт щодо полковника ЗСУ Івана Без’язикова, передає Радіо Свобода. Генпрокуратура звинувачує його в державній зраді, а також в участі в терористичній організації. В обвинувальному акті зазначається, що Без’язиков в період з 25 серпня 2014 по 27 травня 2015 року, перебуваючи на непідконтрольній українській владі території, займав посаду так званого „заступника начальника розвідувального управління ДНР“, займався збором розвідувальної інформації про пересування українських військових підрозділів і брав участь в проведенні інформаційних операцій щодо дискредитації ЗСУ.
Сам Без’язиков заявляє, що не визнає себе винним в інкримінованих злочинах і не розуміє суті обвинувачення. Також суд встановив порядок дослідження доказів. Спочатку будуть розглядатися речові докази, будуть допитані свідки сторони обвинувачення, потім – сторони захисту, а потім в суді допитають обвинуваченого. Суд оголосив перерву в засіданні до 15 вересня. Як повідомляв Кореспондент.net, влітку 2016 року Івана Без’язикова звільнили з полону сепаратистів, в якому він перебував два роки. Але вже через кілька місяців полковника затримали за підозрою в роботі на ДНР. Слідчі СБУ повідомили Без’язикову про підозру у скоєнні державної зради. А 15 грудня суд заарештував його, регулярно продовжуючи запобіжний захід.

В українському зовнішньополітичному відомстві зазначають, що від початку анексії Російською Федерацією Криму на півострові здійснюється захоплення приміщень церкви, відбувається незаконне заволодіння її майном, проводяться обшуки у її приміщеннях, здійснюється тиск на священнослужителів.
«МЗС України вимагає від РФ негайно відновити безперешкодний доступ віруючих УПЦ КП до храму в Сімферополі, припинити релігійні гоніння та втручання у діяльність Кримської єпархії УПЦ КП та забезпечити виконання зобов’ язань у рамках міжнародного права», – наголошується у заяві.
Міністерство також звертається до міжнародної спільноти, зокрема Європейського Союзу та його країн-членів, до США, Канади та інших демократичних країн, міжнародних організацій, зокрема ООН, РЄ та ОБСЄ з проханням засудити напад на український храм у Сімферополі.

Астероид Флоренс 1 сентября пролетел в 7 млн км от Земли. Об этом сообщил канал CNN со ссылкой на Национальное аэрокосмическое агентство США (NASA) .
Как сообщали в NASA, диаметр космического объекта составляет 4,4 км. В агентстве отметили, что такие крупные астероиды еще не приближались так близко к Земле.
Астероид Флоренс открыли в 1981 году в австралийской обсерватории. Он проходил близко к Земле в 1890 году. В следующий раз он пройдет на таком же близком расстоянии от Земли после 2500 года.

Microsoft pushes Windows 10 for PCs build 16278 to the Slow ring

Today, Microsoft released this month’s Windows 10 for PCs Slow ring Insider Preview build, 16278. The build was originally released to the Fast ring just three days ago on August 29.
Today, Microsoft released Windows 10 for PCs build 16281 to the Fast ring of the Insider Program, but the Slow ring got some love as well, with the release of build 16278. Interestingly, that build was offered to the Fast ring just three days ago, which should speak to the stability of what’s coming out of the Redstone 3 Development Branch.
You won’t find a lot of new features; in fact, the only build that’s been released since then with some solid new front-facing features was build 16257. That contained the new Eye Tracking accessibility feature, Edge improvements, the ability to change the colors of the Console, and more.
Other than that, Microsoft is gearing up toward finalizing the Windows 10 Fall Creators Update. The company announced this morning that the new feature update will begin rolling out to the general public on October 17, and since Slow ring builds are typically monthly (the last one was 16251 on August 2) , the next one very well may be RTM.

Hurricane Harvey relief brings millions in corporate gifts

American corporations have pledged more than $130 million in relief donations since the storm hit south Texas
Corporate America is pitching in to help Hurricane Harvey relief efforts.
U. S. companies have committed more than $130 million for relief efforts in the week since Hurricane Harvey made landfall and deluged Houston, the nation’s fourth-largest city.
Companies in industries from energy to airlines are pitching in, led by pledges of $20 million from Walmart (WMT) , $10 million from Verizon (VZ) and dozens of $1 million promises.
Most are opting for cash and routing support primarily through the American Red Cross, but other companies are mixing it up to capitalize on their own expertise, or to engage employees and customers.
„Companies are really starting to leverage their core assets so it’s not just checkbook philanthropy, “ said Marc DeCourcey, senior vice president of the U. S. Chamber of Commerce Foundation.
FedEx (FDX) and UPS (UPS) , for instance, have pledged $1 million each, including the use of their delivery networks to help orchestrate relief efforts. Samsung split its $1 million commitment between cash to the Red Cross and $500,000 worth of washing machines, dryers and other household electronics for distribution by Texas nonprofits. In addition to cash gifts, Scholastic (SCHL) plans to donate books to help restock libraries.
Comcast (CMCSA) is pitching in cable airtime for flood-related announcements, alongside a $500,000 contribution split between the Red Cross and a relief fund set up by the Houston mayor. Teams of JetBlue (JBLU) employees trained in advance and are now deploying with the Red Cross. JPMorgan (JPM) gave $1 million to the Red Cross and waived late fees on mortgages and credit cards for customers affected by the storm.
Pharmaceutical company Abbott (ABT) had already positioned its products to be ready before the storm as part of an industry effort called Healthcare Ready that ensures access to medicines and supplies in disaster situations. Amgen’s (AMGN) pledge includes $20,000 to help dialysis patients displaced by the storm. The investment bank Jefferies pledged to donate $1 million, plus all trading commissions earned on Aug. 30, and gave employees an opportunity to donate their salary for the day.
The Chamber is tracking donation totals, DeCourcey said, but it’s too soon to predict whether the corporate relief efforts for Harvey will reach the $1 billion milestone recorded after Hurricane Katrina and Superstorm Sandy.
„This is the initial donation phase, “ DeCourcey said, noting philanthropic efforts will now shift to recovery and include deployment of on-the-ground volunteers representing companies large and small. „As more needs become apparent I think companies again will step up and donate additional funds and resources.“
Most companies angling to help out are opting for cash donations — as they should, said Ken Stern, former CEO of NPR and author of „With Charity for All: Why Charities Are Failing and a Better Way to Give.“
„Only a handful of companies can bring more value through their expertise than cash, “ he said.
In the aftermath of natural disasters, Stern added, it’s particularly important for companies and individuals to engage in „smart giving.“ The two biggest risks: Outright fraud (particularly egregious examples followed Haiti’s 2010 earthquake) , and well-intentioned charitable organizations that lack the infrastructure to fulfill their promises.
„A lot of people started charities just for (Hurricane) Katrina, and by and large they weren’t very successful, “ Stern said. „The work that goes into responding to a disaster requires infrastructure and logistics and knowledge of the local community. You don’t get that from a startup.“
Walmart’s pledge includes $10 million upfront to support Red Cross shelters and $2 million for the relief fund set up by Houston Mayor Sylvester Turner (and administered by the Greater Houston Community Foundation) . The retail giant also plans to pitch in products for storm cleanup and launch a matching program encouraging its customers to get involved.
The home-improvement chain Lowe’s pledged $500,000 to the American Red Cross and expedited cleanup supplies to its Texas stores. Home Depot split its $1 million gift between the Red Cross, Salvation Army, Convoy of Hope, Operation Blessing and Team Rubicon. It also plans to dispatch volunteers to help with cleanup and deliver supplies.
The airlines are getting in the act — with travel, of course. Southwest said it plans to give five million frequent-flyer points to cover relief-related travel for the Red Cross, veterans-service organization Team Rubicon and disaster-zone staffing nonprofit All Hands Volunteers.
American and United are giving bonus miles to customers who donate to selected disaster-relief organizations. Delta and JetBlue are matching donations of miles to select charities.
Other companies are making contributions inspired by their own mission. PetSmart promised $1 million for animal-welfare organizations in Texas that are working to reunite lost pets with their owners. The company is also pitching in pet food.
Most corporations also agreed to match donations from employees. In a twist on that model, Kohl’s — which gave $500,000 to the Red Cross — committed $1 million more to help its own employees affected by the storm. Fast-food chain Whataburger took a similar approach, setting aside $1 million to help its own employees, alongside major cash contributions to the Red Cross and local food banks.
Innovation in giving isn’t limited to corporate philanthropists.
Charities are getting in the act, too, with crowdfunding campaigns and Amazon Wish Lists that allow donors to buy specific supplies rather than making a cash donation, said Sara Nason, spokeswoman for the nonprofit watchdog Charity Navigator. The Red Cross, for instance, has asked for baby cribs.
Do-it-yourself donors, particularly if they’re considering lesser-known local charities, would be wise to research the organizations on a site like New Jersey-based Charity Navigator, which lists 30 highly-rated nonprofits that allow donors to designate gifts for Harvey relief. The site’s traffic is up 300 percent in the wake of Harvey, and most users are coming from Facebook and Twitter, Nason said.
„It’s a testament to the generosity of the American people that corporations, individuals and communities all are asking people to help, “ she said. „We believe everyone is a philanthropist, whether you give time, money or an in-kind donation.“
