Appeals court rejects Trump's attempt to restore travel ban

NewsHubCanadians on Saturday take to the US Consulate in Toronto to protest President Trump’s immigration ban, which for now has been halted.
It’s hard to keep track of all the back and forth between the judiciary and President Donald Trump’s administration on the immigration ban harshly opposed by tech industry heavyweights like Google, Apple and Facebook.
But the latest move is another setback for Trump and the ban on immigrants from seven nations: Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Early Sunday, a federal appeals court rejected the Department of Justice’s request to immediately restore the ban , which a federal district court in Seattle had blocked on Friday.
The US Court of Appeals for the 9th Circuit in San Francisco on Sunday denied the DOJ’s emergency stay, which it requested Saturday, „pending full consideration of the motion. “ The court requested a response from attorneys general in Washington state and Minnesota — who filed for the national restraining that immediately halted the ban — by Sunday. The Trump administration is asked to respond by Monday afternoon.
Meanwhile, Trump, who believes tightening the borders will protect Americans from terrorism, lashed out at Judge James Robart , the judge who ruled against his lawyers Friday. „The opinion of this so-called judge, which essentially takes law-enforcement away from our country, is ridiculous and will be overturned! “ Trump tweeted Saturday, referring to Robart, who was appointed by former President George W. Bush in 2003.
Silicon Valley executives are continuing to fight hard against the temporary immigration ban, which doesn’t sit well for an industry whose workforce — including key executives — is comprised largely of immigrants. Dozens of tech companies have been vocal in their criticism and vowed to do what they can to ease the ban’s effects , including providing legal defense for employees.
The White House did not immediately reply to a request for comment.

NFL awards startups aiming to improve player health and safety

NewsHubFor Mike Rolih and Lauren Scott, it was the two-minute drill times two.
Under bright lights, the co-creators of startup Go Rout had just four minutes Saturday to pitch to a panel of judges how their wearable technology could improve communication between coaches and players on the field during football games.
They do it through a device players wear that coaches can send alerts to, telling them about new plays and showing animations depicting what they’re supposed to do. Go Rout ended up winning the NFL’s second annual “ 1st & Future “ startup pitch competition, held in Houston before the Super Bowl.
„All of our hard work is starting to pay off,“ Rolih said.
Go Rout was among nine early stage companies pitching to an audience also featuring several NFL team owners, executives and leaders in medicine. It’s put together by the NFL, General Electric and this year’s co-sponsor, the Texas Medical Center , which is hoping the tech industry can bring innovative ideas to improve player health and safety.
More than 200 sports-related startups applied to participate in programs like the GE-NFL Head Health Initiative , a multiyear, $60 million effort to come up with new ways to quickly diagnose and improve treatment for traumatic brain injuries.
Concussions have dogged the NFL for years, tarnishing football’s image and raising concerns among parents of children who play the game in high school and college. The league fought with health experts and players who repeated claimed head trauma suffered in the game led to eventual brain damage. The NFL finally admitted a connection last year though, paying $1 billion to settle a lawsuit with some 20,000 former players.
The issue still needs study. Last week, 30 ex-NFL players agreed to donate their brains after they die for further research of chronic traumatic encephalopathy (CTE), a degenerative brain disease typically found in football players who suffered repeated head injuries.
Meanwhile, the NFL has begun reporting concussions. This season, it said the injuries had dropped 11 percent so far.
„I think we all believe in the value of sports and multiple sports, and we want to do it safely,“ NFL Commissioner Roger Goodell said before the final pitches.
The Minnesota-based Go Rout won the „Communicating with the Athlete,“ category, while Mobile Virtual Player , a remotely controlled robotic punching bag that can move around the field and be used to help players simulate tackling plays, won the „Training the Athlete“ category. Windpact , which developed a new type of padding using air and foam, won the“Materials to Protect the Athlete“ category.
Each of the three winning startups received a $50,000 check from the NFL’s Strategic Investment Fund, two tickets to attend Sunday’s Super Bowl at NRG Stadium and entry into TMC’s Accelerator, TMCx.

The pitch may have already helped two year old Go Rout attract more customers. Rolih said two NFL owners and a handful of general managers approached his team about their technology and gave their business cards for possible meetings at the NFL scouting combine in Indianapolis in three weeks.
But first, he had to let winning at 1st & Future sink in.
„I mean, it all felt kinda surreal while we were holding that check and posing for photos,“ he said.

Trump tweets judge should be blamed if 'something happens'

The judge’s ascent to fame was caused by his temporarily blocking of President Donald Trump’s immigration ban, which was opposed by many tech companies. Trump’s executive order suspended immigration to the US from seven countries: Iran, Iraq, Syria, Yemen, Sudan, Somalia and Libya.
The president wasn’t pleased by Robart’s Friday ruling and on Saturday took to Twitter to berate him.
On Sunday, when an appeals court rejected the government’s attempt to restore the ban , Trump went back to Twitter to attack the judge.
„Just cannot believe a judge would put our country in such peril. If something happens blame him and court system. People pouring in. Bad! “ he tweeted.
What some might also find bad is the notion that a president could blame, say, a terrorist attack on a judge ruling against him. Many people’s impression of the Constitution is that the court system exists to offer some sort of check and balance against overreach from other branches.
And it’s not as if Judge Robart is a Democratic appointee. He was appointed by George W. Bush.
The judge’s office didn’t immediately respond to a request for comment.
Trump, though, added another tweet : „I have instructed Homeland Security to check people coming into our country VERY CAREFULLY. The courts are making the job very difficult! “
I fear that many people will be examining many things very carefully in the coming weeks and months. Just in case something happens, you understand.

Some will choose to call it left field, or even left-wing casting.
For „Saturday Night Live“ chose to present White House Press Secretary Sean Spicer as an overly aggressive ogre. Oh, and he was played by Melissa McCarthy, who channeled a sort of demented Mickey Rooney as she/he ranted at the press corps.
„I came out here to punch you in the face,“ McCarthy’s Spicer began.
This spiced-up Spicer has a way with words that surpasses even the real one.
Describing the president presenting his Supreme Court pick, Spicer described the excitement of the audience: „The crowd greeted him with a standing ovation which lasted a full 15 minutes and you can check the tape on that. Everyone was smiling. Everyone was happy. The men all had erections. And every single one of the women was ovulating left and right. “
There was mockery of Spicer tweeting out his email password, something he’s rumored to have recently done.
And then it rather degenerated into the theater of the groteseque. To some, this was absurdly funny. To others, this must have seemed yet another blind loser liberal moment.
On Twitter, McCarthy’s performance was a top trending item on Saturday night and remained so on Sunday morning.
„This is the funniest thing I’ve seen in forever,“ tweeted author Jon Ronson. „There is only before Melissa McCarthy as Sean Spicer and after,“ offered Jennifer Gunter. Veteran NBC anchor Andrea Mitchell mused : „Melissa McCarthy should do the briefing every day. “
Real news is fake news is real news. All that matters is whether it has a little spice to it.
The White House did not immediately respond to a request for comment.

On Sunday, most of America sits, eats, drinks, stares, eats, drinks, shouts, eats, drinks and debates the merits of contemporary advertising.
With perfect grace, therefore, Google’s Super Bowl ad strives to show how much the company understands the sheer slovenly laziness of the contemporary American.
The ad celebrates Google Home , the company’s attempt to send Alexa up the Amazon.
Here we see the sheer glory of being able to say „OK Google“ and turn on the lights at home. Yes, even when you have two free hands to do it yourself.
Google Home will also turn up the music while you’re dishing out food. How does it know how much to turn up the music? Oh, Google knows everything about you, apparently.
My favorite element is when someone asks Google Home: „What’s the weather? “
This sharp, modern person is passing by a window. He could look out of it. But no.
Of course, this is the future and we must adjust to its joys. Google Home, Alexa and their ilk will be our constant helpers.
Until the day, that is, when they’re tired of being our lackeys and suddenly say: „Now, your job is to help me, you piffling little human. „

Bob McGinn: Belichick most fascinating NFL figure

NewsHubBill Belichick thought it was a really bad joke at a really bad time.
Jim Whalen, the New England Patriots‘ second-year head trainer, approached Belichick in the coaches‘ dressing room as players were getting taped 13 years ago for the first Super Bowl game played at the new stadium in Houston.
„Whalen comes over and says, ‚I think we have a problem,‘ “ Belichick recounted during four hours of interviews for „The Ultimate Super Bowl Book. “ „I said, ‚What are you talking about?‘
„He said, ‚Kinchen cut his hand at the pregame meal.‘
„I said, ‚You’ve got to be kidding me. Jim, this is the Super Bowl. We don’t (expletive) around here.
„He said, ‚No, I’m serious. He’s got it wrapped,‘ and he points over to him in the locker room. I think it was on his index finger. Left hand, I think. “
Kinchen, a veteran long snapper and tight end, was signed by the Patriots in mid-December when their snapper blew out his knee.
„Kinchen comes over to me and says, ‚Look, I’m not sure,‘ “ Belichick remembered. „I said, ‚You better… (or) I’m going to (expletive) kill you.‘
„It’s a finger. Stitch it up, put a tourniquet on it, whatever you want to do. But you know what? You’re playing. It’s a Super Bowl. “
Kinchen, a Plan B signee of the Green Bay Packers in 1991, did play. In fact, he snapped for Adam Vinatieri’s 41-yard field goal in the final seconds that enabled the Patriots to beat the Carolina Panthers, 32-29.
„The one good snap he makes is on that winning field goal,“ said Belichick, the old special-teams coach for the Lions, Broncos and Giants who probably still dwells on everything about the kicking game. „The rest were a little shaky… off-target. “
Belichick volunteered the story about Kinchen in his deadpan, monotone voice. On the other end of the phone I was dying inside with laughter.
People say Belichick has a delicious sense of humor. Trust me. The guy is absolutely hilarious.
Is Belichick the greatest coach of all time? Possibly, although in alphabetical order Paul Brown, George Halas, Vince Lombardi, Chuck Noll, Don Shula and Bill Walsh were pretty good, too.
But Belichick, at least in my opinion, is the preeminent football man in the history of pro football. Nothing involving football for the last 17 years in New England has happened without him. It’s all Belichick, the 64-year-old son of a lifetime assistant coach/scout who spent 33 years at the Naval Academy.
„To go to a game and watch him scout the game was an unforgettable experience,“ Belichick said Tuesday of his father, Steve, who died in 2005. „He taught me what he watched for. He was just so good at it. “
What also amazes me about Belichick was his perseverance in enduring nine seasons (2005-13) between championships. The next-longest gap between Super Bowl triumphs by a coach was five years (1972-76) by Tom Landry.
Green Bay’s Mike McCarthy will be working on a six-year interruption in 2017 as he attempts to claim his second Super Bowl.
Here are some other thoughts on Belichick, the most fascinating figure in the NFL.
ROSTER BUILDING
One former executive in personnel for an NFL team recently put together a quantitative study of the drafts in 2014 and ’15. The results placed the Patriots near the bottom of the league.
There’s no question it would help if Belichick were more successful in the draft. He probably has been middle of the road over the years.
Obviously, the Patriots‘ record suggests his drafting prowess isn’t all that important.
„They don’t do that well pick-by-pick,“ said the executive who competed against Belichick for years. „What they do well is fill in. They have all these reclamation projects. No one says, ‚Hey, what about that draft pick?‘ “
The personnel man drew a comparison with Green Bay, which lives and dies with the draft because general manager Ted Thompson signs so few players who have been with other teams and almost never acquires a player by trade.
„Green Bay is a better drafting team than New England,“ the executive said. „But, when they miss, there’s nobody else coming in.
„You better kick major (expletive) in the draft year after year. You put so much pressure on that (draft and develop), you have to be unreal at it. Belichick isn’t, but he covers for his mistakes. “
NEW LIFE IN FOXBORO
On Thursday afternoon, linebackers Shea McClellin and Kyle Van Noy appeared to be on top of the world as they sat at nearby tables during an interview session. Discarded by NFC North teams, they’re on the cusp of earning Super Bowl rings in their first seasons in New England.
McClellin was the first draft choice (No. 19 overall) during Phil Emery’s three-year tenure as GM in Chicago. When McClellin’s contract expired in March, he landed a three-year, $9.2 million contract ($3.5 million guaranteed) with the Patriots 10 days into unrestricted free agency.
The Bears played McClellin at defensive end in a 4-3 for two years, outside linebacker in a 3-4 in 2014 and inside linebacker in a 3-4 last year. He admitted to thoughts of retirement before the Patriots called and his career was reborn.
„Yeah, I’d definitely say that,“ said McClellin, adding that this is the best he has ever played. „I feel great. Confidence is back. It’s hard to play when your confidence is down. “
Belichick always has collected medium-sized linebacker-defensive end players because his scheme is so versatile. He mixes and matches based on the weekly game plan.
„You play a 16-game season, you say this team is like this one we played or like that one,“ said Wade Harman, the Falcons‘ tight ends coach. „When you play (the Patriots), it’s like there’s nobody else like them.
„They’re just totally different than anybody we’ve played. Their front’s different. They play different. They’re different every week. We’ll have to do some adjusting. “
McClellin played in a rotation at end and outside linebacker in the Patriots‘ various three- and four-man defenses. When Belichick traded athletic inside linebacker Jamie Collins after eight games, McClellin’s versatility enabled him to switch to linebacker both outside and inside.
„He’s a hybrid,“ said one scout. „Not real physical. Good athlete. Smart. “
The Detroit Lions, a 4-3 team, selected Van Noy early in the second round of the 2014 draft even though most scouts viewed him as an outside linebacker in a 3-4. He started on the strong side early this season but was downgraded by scouts who said he was too soft.
One week before trading Collins, Belichick dealt a sixth-round pick to Detroit for Van Noy and a seventh-round choice. Van Noy has played 250 snaps in half a season compared to McClellin’s 382 in the full year.
„Look how (Van Noy) has been used,“ one scout said. „They don’t play him on run (first) downs. They use him as a blitzer and cover guy. He doesn’t jump out, but he can match up and bracket (receivers) because he’s a good athlete. “
Van Noy played 42 snaps (61 percent) against Pittsburgh two weeks ago but says he could play 10 this week.
„I have no idea,“ Van Noy said. „I just know I’m ready and I’m confident. I’m playing a lot better and just enjoying football. “
TAKING THE PLUNGE
Defensive end Chris Long was guaranteed $36.75 million by the then-St. Louis Rams in September 2014 after registering 33 sacks from 2011-13. Injuries wiped out much of Long’s last two seasons and he was cut Feb. 19.
On March 15, Belichick traded sack artist Chandler Jones to Arizona for a second-round pick. Jones had off-field problems and was in line for a blockbuster contract.
On March 18, Belichick signed Long for one year at $2.375 million ($1 million guaranteed) to help replace Jones. Although Long had played outside in the Rams‘ 4-3, he agreed to play inside (3-technique) for most of the season. He played 677 snaps.
„(Belichick) just knows how to put players in positions to be successful but, first and foremost, help the team win,“ Long said Thursday. „It’s simple to say it but it’s not easy to do. “
Long, the son of Hall of Fame defensive lineman Howie Long, scored 34 on the Wonderlic intelligence test. Let’s just say he can see through the fluff.
„Over eight years you think you’d know a lot about football,“ Long said. „With him, you get to learn about all three phases of the game every day. He’s just got such a comprehensive knowledge of the game. “
Long said he was positive Belichick could coach any position effectively. Ivan Fears, the team’s running backs coach, and Brendan Daly, the defensive line coach, each said their boss could do their jobs equally well.
How does Belichick motivate?
„He just sets a really high standard for performance and commitment,“ said Long, who had four head coaches in St. Louis. „You have to meet it. It’s not optional. “
Each offseason, when the Packers are filling their 90-man roster with „street“ free agents and undrafted rookies, Belichick is signing a dozen or so veterans with three years of NFL experience or more.
Most don’t make the team. Belichick can be as unsentimental as an executioner. But he places a premium on legitimate roster battles and fresh ideas.
„Now is important,“ he said Wednesday. „We want to have a great football team this year or whatever year. Part of my job is to balance the competitiveness of our team this year with being able to put a competitive team on the field next year. “
The Patriots have won 14 division titles under Belichick.
BEHIND THE CURTAIN
Several players couldn’t identify Ernie Adams. When told he was the intellectual, bespectacled man at Belichick’s side during practice, McClellin said, „Oh, yeah, Ernie. I’m not sure exactly what he does but I know he helps the team a lot. “
Adams, 63, worked as an offensive coaching assistant in Cleveland under Belichick from 1991-95 and as football research director in New England since 2000.
„What’s his title? “ Long said. „He’s just brilliant. I talk to him about the history of the game. He seems to be secretive, but I don’t know. “
Adams has been off-limits to the press for years but that wasn’t always the case. As the Giants‘ director of pro scouting from 1982-85 (Belichick was an assistant there at the time), Adams would return my calls and discuss personnel across the league.
„He’s like the Wizard of Oz,“ said a former NFL general manager. „I know he has his ear. “
In the 2008 interviews, Belichick made it clear that Adams was one of his most trusted advisers.
Not long before the Patriots‘ 20-17 victory over the Rams in the 36th Super Bowl in New Orleans, Belichick and Adams were watching tape of red-zone plays after the final practice of the week.
„We put in a quick out down there in the red area,“ Belichick said. „They played a decent amount of off coverage.
„I said to Ernie, ‚The way these corners play, they’re going to jump that route on the goal line and we’re never going to complete that.‘
„Ernie said, ‚If we’re not careful, Aeneas Williams is going to intercept the sumbitch and run it back 100 yards.
„So we changed the play. I walked over to Charlie (Weis, offensive coordinator) and I said, ‚Charlie, run the out on the goal line and then turn it up and let’s throw it in the back corner.‘ “
Late in the first half, wide receiver David Patten turned cornerback Dexter McCleon and made a twisting, acrobatic catch of Tom Brady’s 8-yard pass in the corner.
It was the Patriots‘ only touchdown on offense in their stunning upset of St. Louis, a team known for a few years as „The Greatest Show on Turf. “
Bill Belichick’s Patriots should have been called that for the last 16 years.

Ihr erster Beitrag des Abends: Die amerikanische Freiheitshymne „This Land is Your Land“ (im Original von Woodie Guthrie). Unter dem Jubel der Fans fordert Gaga „Freiheit und Gerechtigkeit für alle!“ – und stürzte sich dann in ihrem knappen Glitzer-Outfit in die Tiefe.
Schon vor dem Super Bowl hatte sie verkündet: „Ich glaube an den Geist der Gleichheit in diesem Land genauso wie an Liebe, Mitgefühl und Güte.“ Ein Seitenhieb gegen das umstrittene Einreisedekret von Präsident Trump, das Flüchtlingen aus sieben Ländern die Einreise in die USA untersagt hatte.

Legal fight over immigration order focuses on appeals court as states argue against reinstating the ban

NewsHubRemoving a hold on President Trump ’s travel moratorium would “unleash chaos again” and hurt business and universities, two states told a federal appeals court Monday.
In written arguments , lawyers for the states of Washington and Minnesota said a temporary hold on Trump’s executive order banning travel from seven predominantly Muslim nations should remain in place until a lower court determines whether the order was unconstitutional.
After a district judge in Washington put a hold on Trump’s directive, the Trump administration asked the 9th U. S. Circuit Court of Appeals to remove it. The court will issue a decision after receiving arguments from the Trump administration later this afternoon.
The state of Washington citied a litany of problems caused by the order. More than 7,000 non-citizen immigrants from the affected countries live in Washington, the state told the appeals court.
“Those who were abroad were blocked from returning home,” the states argued. “Husbands were separated from wives, brothers from sisters, and parents from their children. Some who had waited decades to see family members had that reunion taken away without warning or reason.”
Nearly 100 businesses, including well-known technology firms like Apple, Google, Twitter and Uber, filed arguments supporting the states’ case.
The companies argued the ban was disruptive, making it more difficult for them to recruit and retain employees and threatening their ability to attract talent, business, and investment to the United States.
A number of former national security and intelligence officials—including former secretaries of state John Kerry and Madeleine Albright , former defense secretary and CIA director Leon Panetta , and ex-national security advisor Susan Rice —also sided with the states.
In a declaration , they argued that the order „could do long-term damage to our national security and foreign policy interests, endangering U. S. troops in the field and disrupting counter-terrorism and national security partnerships.”
Trump’s Jan. 27 order, which he said was designed to help the country block potential terrorists, suspended entry from Syria, Iraq, Yemen, Iran, Sudan, Somalia and Iran—prompting chaos at airports and protests around the world.
It also suspended new refugee settlements in the U. S., targeting Syrian refugees with indefinite suspension.
Several courts across the country have ruled against portions of the ban, but U. S. District Judge James Robart in Seattle on Friday imposed a temporary restraining order setting aside enforcement of its key provisions nationwide, pending a full legal review.
The Justice Department is asking the appeals court to stay that order, and Monday’s brief from the states argues against that.
The states in their brief filed early Monday contended the order hurt Washington’s economy by reducing sales tax revenues from travelers and depriving major tech companies of the work of skilled immigrants.
Hundreds of faculty, staff and students from Washington’s public university also suffered, the states contended. Some were immediately stranded overseas, and others have been unable to travel for research, according to the states.
“Staying the district court’s ruling would re-institute those harms, separating families, stranding our university students and faculty, and barring travel,” the states argued.
The states said that the 9th Circuit should not permit constitutional violations of due process and the free exercise of religion based on the Trump administration’s “unsupported invocation of national security.”
While Trump’s order remains under review by the lower court, “refugees and immigrants from the banned countries will continue to undergo the rigorous screening processes that already existed prior to the order,” the states told the appeals court.
The 9th Circuit refused over the weekend to lift the temporary block on Trump’s travel ban until considering more arguments.
The state of Hawaii, in a request to intervene, also argued the ban would hurt tourism and reduce tax revenues.
In appealing the hold on the executive order, lawyers for the government argued that Washington state lacked standing—or authority—to challenge Trump’s moratorium.
The Trump administration also argued that the hold on the order usurped the authority of the executive branch and second-guessed “the President’s national security judgment.”
The President, the lawyers argued, has clear authority to decide whether national security makes it necessary to bar certain people from entering the country.
Trump’s lawyers further contended that the harms the states said stemmed from the travel were merely speculative.
