Qualcomm Inc (QCOM. O) confirmed an earlier report that the chipmaker had filed lawsuits in China, seeking to halt the manufacture and sale of Apple Inc’s (AAPL. O) iPhones in the country.

Qualcomm filed the suits in a Beijing intellectual property court, claiming patent infringement and is seeking injunctive relief, a company spokeswoman confirmed on Friday, but did not provide further details.
Bloomberg had earlier reported about the lawsuits in China. ( bloom.bg/2z6qMwu)
Apple’s shares were marginally up, while Qualcomm shares were marginally down in late-afternoon trading.
The iPhone maker has always been willing to pay fair and reasonable rates for the patents it uses, Apple told Reuters in an email.
“In many years of ongoing negotiations with Qualcomm, these patents have never been discussed and in fact were only granted in the last few months,” Apple said.
Apple is waging a global legal battle on Qualcomm’s long-held practice of charging a percentage of the total price of iPhones and other Apple devices as a licensing fee for its patents.

What are the Obamacare subsidies that Trump is trying to eliminate, and why do they matter?

Trump has moved to wipe out some $7 billion in annual payments to insurance companies that the federal government makes. What are these cost-sharing reduction payments? What’s the impact of eliminating them? Why does Trump want to do this? Answers to some frequently asked questions.
The Trump administration announced Thursday night that it would stop making what are called cost-sharing reduction payments to health insurance companies under the Affordable Care Act. Trump says the payments were improper. Patient advocates, insurance regulators and lawmakers, including some Republicans, say the move will send premiums soaring and could destabilize insurance markets. “It’s going to hurt people, it’s going to hurt kids, it’s going to hurt families,” Nevada Gov. Brian Sandoval, a Republican, told the Nevada Independent.
The Affordable Care Act set up insurance marketplaces in which Americans who don’t get coverage through an employer can shop among health plans that must all cover a basic set of benefits.
Low- and moderate-income consumers — people with annual incomes between 100% and 400% of the poverty line, so about $12,000 to $48,000 for single people — qualify for subsidies that offset the cost of their monthly insurance premiums.
In addition to those subsidies, the law has another, less well-known, way of reducing costs. Consumers who make between 100% and 250% of the poverty line can get this additional assistance to reduce co-pays and deductibles if they select certain health plans on the Obamacare marketplaces.
Insurers lose money by reducing deductibles and co-pays. The government pays them to make up that cost. Those are the cost-sharing reduction payments.
This year, the CSR payments will cost the federal government about $7 billion, according to the nonpartisan Congressional Budget Office .
Someone who might face an annual deductible of $2,000 or more would potentially have no deductible at all.
This additional assistance can be especially important because many health plans with low premiums require consumers to pay high deductibles before their medical care is covered.
The Obama administration initially sought congressional approval for the payments. After the Republican majority in Congress did not act, the administration determined that the healthcare law gave it the authority to make the payments without an explicit appropriation measure passed by Congress.
Starting in 2014, the government has made payments to insurers every month.
Republicans went to court saying this usurped Congress’ authority over spending. Last year, a federal judge agreed with them. The judge suspended her order while the case was being appealed. The appeal remains pending.

Health insurers and other experts have been warning for months that eliminating the payments could destabilize the Obamacare marketplaces and cause some insurers to stop offering health plans.
If the payments are stopped, insurers would still be required to give low-income consumers plans with small deductibles and co-payments. But insurers would no longer be able to get financial help for the costs they are bearing.
Some insurance companies would likely decide that it was no longer worth selling health plans on the marketplaces. Others might conclude that they have to raise premiums across-the-board to cover the additional losses.
Insurance regulators predict that premiums nationwide will go up an average of 12% to 15% because of Trump’s decision. But the increase in some areas could be much larger.
No. Remember, all this only applies to people who get insurance on the individual market, not to people who get coverage on the job or through a government program.
Even for those on the individual market, people whose incomes are low enough to qualify for subsidies wouldn’t feel much impact because their subsidy would go up as their premium does.
The people who would be hit hardest are those who get insurance on the individual market, but whose incomes are too high to receive subsidies. Ironically, that population tends to lean Republican.
No. Because subsidies go up as premiums rise, the Congressional Budget Office estimates that the net impact of eliminating the cost-sharing subsidies would be to increase the cost to the taxpayers.
The cost would be almost $200 billion over 10 years, the budget office estimated in August.
The president and other administration officials have described Trump’s move as a way to put pressure on Congress to agree to some of Trump’s priorities.
“The Democrats ObamaCare is imploding. Massive subsidy payments to their pet insurance companies has stopped. Dems should call me to fix!” Trump wrote Friday in a message on Twitter.
Attorneys general from several Democratic states say they will challenge Trump’s move in court. Some insurers may as well.
In Congress, a bipartisan group of lawmakers already has been trying to negotiate a bill that would give explicit congressional approval for the payments. Whether Trump would sign such legislation remains unclear.

NAIROBI, Kenya (AP) — Police in Kenya shot and killed two opposition protesters who allegedly stormed a police station with farm tools and rocks in the western part of the country, while police used tear gas on rallies in the capital and elsewhere demanding reforms ahead of the new presidential election.
At the same time, opposition leader Raila Odinga told The Associated Press he’s willing to return to the race if the government is „ready to do business and deal“ on reforms.
Three other protesters had gunshot wounds in the confrontation in the Odinga stronghold of Siaya County, Bondo police chief Paul Kiarie said.
The demonstrations defied a new government ban on opposition protests in the central business districts of Kenya’s three largest cities, while concerns rose again about election-related violence in East Africa’s largest economy.
The State Department urged Kenya’s security forces not to use „unnecessary force“ and called for demonstrations to be peaceful.
In the capital, Nairobi, police fired tear gas as opposition supporters tried to march to the central business district. In Kisumu city, local television showed running battles with stone-throwing youth. Police also used tear gas in Mombasa, said opposition legislator Abdulswamad Shariff Nassir.
The government on Thursday banned the protests, citing „imminent danger of breach of peace.“ Human rights groups protested, with some pointing out that police have killed at least 37 people in demonstrations since the results of the August election were announced.
The Supreme Court annulled that vote, citing irregularities, and called for a new one. It is set for Oct. 26.
„This ban, announced just two weeks ahead of a fraught repeat presidential election, is likely to become a basis for heavy-handed police crackdowns,“ said Michelle Kagari, a deputy regional director with Amnesty International.
Opposition coalition Chief Executive Officer Norman Magaya said police have allowed government supporters into the banned protest areas and that they were attacking opposition supporters.
Opposition leaders have called for daily demonstrations. Odinga, whose legal challenge led the court to nullify President Uhuru Kenyatta’s re-election, this week said he has left the race because no reforms to electoral commission have been made.
But in an interview in London, Odinga told the AP he’s willing to return if that changes. If the government and electoral commission are „ready to do business and deal, we are ready to jump in the field,“ he said.
The election commission has said the new vote will go ahead with all eight candidates who ran in August and that Odinga is still considered a candidate as he has not formally withdrawn. No candidate aside from Odinga and Kenyatta received even 1 percent of the vote.
Kenyatta’s Jubilee Party has pursued changes to the electoral law that the opposition says will make it more difficult for the Supreme Court to nullify a presidential election and will reduce safeguards against electoral fraud. On Friday, Kenyatta received the Parliament-approved amendments. He has 14 days to sign them into law.
Opposition legislator James Orengo said the law will lower safeguards against vote-rigging by making the preferred system of transmitting election results a manual one. Kenya adopted an electronic system following the flawed 2007 election which sparked ethnic violence that left more than 1,000 people dead.

China Would Be In Favor Of U. S. Aggression Against North Korea If Certain Conditions Are Met

Major world powers find themselves engaged in a game of give-and-take as it relates to the issue of the development of nuclear weapons in North Korea. The United States and China look to be seeking last-minute discussions on how to respond to the rogue regime. While China has shown resistance toward America’s heavy-handed approach to the matter, China cannot actually prevent the United States from going after North Korea with military force. China has, however, been attempting to impose conditions on any use of such force, either to minimize the impact on Chinese security or to make sure the outcome is one it desires.
If those desired conditions are met, China may give the United States its stamp of approval in regard to any military force the U. S. wishes to use North Korea.
At present time, China continues to stress dialogue and negotiation as the most effective way to handle the crisis, as Hua Chunying, spokeswoman of China’s Ministry of Foreign Affairs, stated on Monday.
Should China change its stance on what is the best way to handle North Korea, it would do so if two specific conditions are met: to have North Korea remain as a buffer zone and to remove the source of trouble. In other words, while China would not abide by the U. S. invading and occupying North Korea, it would also not accept incomplete military action — such as limited air strikes — that leaves the Kim Jong-un regime and its nuclear weapons intact.
The conditions that Trump’s administration leave North Korea as a buffer zone for China while eliminating Kim Jong-un and the nuclear weapons that the rogue nation has in its possession are likely to be viewed as acceptable by the U. S. as well.
Should China’s proposed conditions be met, the United States military would no longer have a reason to station forces in South Korea, and at this stage, the U. S. is not seeking unification of the Korean Peninsula due to the severe economic burden it would place on South Korea and other countries.
An operation to carry out aggressive, large-scale air strikes over a short period of time, with the sole purpose of dismantling North Korean leadership and its ability to mount a counter-offensive, might also satisfy those conditions. The use of Special Forces to kill or capture Kim Jong-un and destroy nuclear facilities is also highly likely simply because aerial bombardment alone would not guarantee the desired outcome. Even so, such actions would make an invasion by ground troops unnecessary.
China has long desired to convince North Korea to embrace policies of reform and has wanted Kim Jong-un’s nation to strive for social stability but has seen its advice fall on deaf ears as North Korea has, instead, opted to brandish nuclear weapons and become a threat to China’s safety. So, if the United States was to only go forward with a limited air strike, Kim Jong-un and his nuclear arsenal would, in all likelihood, survive, and end up becoming hostile toward China once it is revealed that China had been the one that allowed the U. S. to use military force.
For this reason, if the U. S. does employ military force, China wants it to be quick and decisive, in the form of a large-scale bombing campaign. This will ultimately allow both powers to decide on the use of military force against North Korea and its handling thereafter.

Now you can order food without ever leaving Facebook

New service lets you access ordering sites for restaurants like Five Guys and Chipotle straight from the app.
Facebook really wants to make sure you never leave its site, and to that end, it’s now offering a service that lets you order food through the app or website itself. This extends to both takeout and delivery.
But rather than competing with similar online services such as GrubHub, it’s merely partnering with some of them, including Delivery.com, DoorDash, ChowNow, Olo, Zuppler, and Slice.
That means that when you click on the new “Order Food” tab under Explore, you’ll find listings for local eateries. Click on “Start Order” for your preferred restaurant, and you’ll then visit your preferred existing service — such as Delivery.com — and order through there.
Nor is Facebook just partnering with delivery and takeout aggregators. If you’re craving something from a nationally recognized chain such as Chipotle, Jimmy John’s, Five Guys, Jack in the Box, Papa John’s, Panera, El Pollo Loco, TGI Friday’s, Denny’s, or Wingstop, you’ll order your food through their own portals.
In essence, Facebook’s main role is cutting out the step of actively visiting another app or website apart from Facebook to make a food order.
It’s still slightly inconvenient because you end up visiting the external site anyway, but at least Facebook isn’t just trying to make the concept its own and put its smaller competitors out of business, right?
Facebook already rolled out the service to a limited number of customers earlier this year, but today marks the first time it’s been widely available in the US. earlier this year
“We’ve been testing this since last year, and after responding to feedback and adding more partners, we’re rolling out everywhere in the US on iOS, Android and desktop,” said Alex Himel, Facebook’s VP of local, in the official announcement . “People already go to Facebook to browse restaurants and decide where to eat or where to order food, so we’re making that easier.” official announcement
Facebook makes no money off of the service, according to TechCrunch. It’s apparently an act of sheer goodwill (and keeping you within the app and seeing Facebook’s own ads). Trump Tried Reality-TV Tricks in His Iran Announcement

But the substance was unmistakable: aggressive posturing accompanied by a punt on most of the major points.
As late as a few hours prior to Donald Trump’s speech announcing his intentions on the Iran deal, GOP senator and chairman of the Senate Foreign Relations Committee Bob Corker told CBS reporter Kylie Atwood, “Things can adjust between now and the speech, and maybe even during it.” Indeed, some major uncertainty remains even after the president gave the speech. At least one major action item — whether the U. S. would be designating Iran’s Revolutionary Guard Corps a terrorist organization — was left obscure in Trump’s remarks, a kind of who-shot-J. R. cliff-hanger.
If the theatrics of today’s speech reminds you more of a reality-show season premiere than high diplomacy, it’s not accidental. Trump and his team are stage-managing Iran policy as if it were an episode of The Apprentice. He intentionally built drama for weeks — from his September taunt to the United Kingdom, our closest ally, that he’d made a decision but wasn’t willing to share it, to a steady drip of leaks and time changes in the lead-up to today’s announcement. European ambassadors were called to the State Department days ahead of time, then told the State Department had nothing to tell them.
Tune in for the season opener, right?
But international diplomacy doesn’t thrive on “reveals” — in fact, it tends to fall apart over them. Even so, today’s remarks from Trump just reinforced the White House’s established line on foreign policy: an intense desire to shift responsibility to Congress and other countries — and an administration at war with itself.
Trump didn’t take either of the big steps he’d threatened. He declined to certify that Iran is in compliance with the six-party deal to halt Iran’s nuclear-weapons program — but did not pull the U. S. out of the deal, and didn’t offer any new evidence of Iranian noncompliance. And after administration officials said he would designate Iran’s Revolutionary Guard Corps (the branch of Iran’s military that takes the lead in supporting extremists overseas) as a terrorist organization, his remarks failed to make clear whether he would do that or not. As part of his new strategy, he promised to work with allies, place additional sanctions on the regime and the Revolutionary Guard, address problematic regime actions, and deny the regime paths to a nuclear weapon. But he punted stronger action to Congress.
From a diplomatic perspective, it was a confused and isolating message. Former White House staffer Colin Kahl referred to the Trump policy rollout as “Obama minus” — the minus being the loss of international consensus around the nuclear deal. Leading European voices criticized the administration for “putting in question” U. S. willingness to keep the agreements we make.
Either because they desperately want the speech to mean something positive, or because policy wonks simply abhor a vacuum, experts from across the spectrum have quickly offered up new plans for how the administration and Congress can rally Europe to enact additional sanctions, and triggers for even more sanctions, that will supposedly constrain Iranian support for extremist groups and missile development while strengthening the nuclear agreement.
But there are good reasons to question whether this approach, even if it worked, really serves U. S. interests. Following this path would amount to decisively taking the side of Iran’s archnemesis Saudi Arabia in the region’s ongoing power struggle, and elevating the Kingdom’s interests above everyone else’s in the Middle East. It would further alienate Iran’s 82 million people and make it harder, rather than easier, to get help from Iran in keeping Iraq stable, eliminating ISIS, and winding down the bloodletting in Syria. While it purports to be “pro-Israel” — whatever that means — it is opposed by key Israeli military and security leaders.
But never mind that. Let’s just consider the question of pure mechanics. A stronger coordinated Iran policy would depend on better-coordinated American diplomacy. First, it requires a Republican Party that can’t deliver votes for its own signature initiative — replacing Obamacare — delivering majority support for a changed Iran deal. And then it demands convincing the rest of the world to go along. What are the chances that an administration led by a president who mocks his secretary of State on social media in the middle of negotiations over North Korea’s actual nuclear weapons is capable of that ?
But in the days leading up to the Trump announcement, key allies and global figures could not have been more clear: They do not intend to go along. They intend to maintain the deal. They do not wish to be seen negotiating with Trump, having watched the embarrassments Mexico and Canada have been subject to on NAFTA talks.
The parallel to reality television is all too excruciating. The best scenes were in the trailer. The president’s tried to keep us all hooked by reminding us that he can unilaterally terminate the agreement and threatening that he would do so if Congress does not act. But will he? Tune in next season to find out — but Russia, China, and even Europe would probably suggest checking out what’s on their channels instead.
