Supreme Court questions federal law banning state-sponsored sports betting

The Supreme Court on Monday appeared skeptical of a 1992 federal law outlawing state-sponsored sports betting in nearly all 50 states, suggesting Congress violated states‘ rights in the highly anticipated case that could quickly unleash bookmaking of professional sports in New Jersey and as many as 30 other states in the next five years.

New Jersey argued that the Professional and Amateur Sports Protection Act, which Congress enacted to preserve the wholesome nature of sporting events, encroached on the state’s power under the 10th Amendment to institute a policy that was passed by its state legislature and directly approved by voters in a 2014 referendum.
The state has repealed its own ban on sports betting but has been repeatedly rebuffed by courts citing the federal law in its bid to allow betting on sporting events, even if only at the state’s racetracks and casinos.
“It leaves in place a state law that the state does not want, so the citizens of the State of New Jersey are bound to obey a law that the state doesn’t want but that the federal government compels the state to have,” said Justice Anthony M. Kennedy. “That seems commandeering.”
The National Collegiate Athletic Association, joined by the NFL, NHL, NBA, the Office of the Commissioner of Baseball and the federal government, defended the federal act.
“The problem that Congress was confronting was state-sponsored and -sanctioned sports gambling schemes. It didn’t care if I bet with my buddy on the Redskins game or we had an office pool. It wasn’t going after all sports gambling,” said Jeffrey Wall, deputy solicitor general for the Justice Department.
But Chief Justice John G. Roberts Jr. and Justice Stephen G. Breyer seemed skeptical of the federal government’s argument.
“It’s a very odd way to phrase something. It’s illegal if it’s pursuant to state law,” Chief Justice Roberts said.
“In other words, if the state law says you can do it, that’s the only situation in which it’s illegal. If the state law doesn’t say anything about it, well, feel free, you can do it.”
Justice Sonia Sotomayor, though, questioned why the federal government couldn’t regulate commercial activity by a state.
Roughly 20 states are backing New Jersey, and Michelle Minton, a senior fellow at the Competitive Enterprise Institute, said they want to have the choice whether to tap into the black market that already exists.
“It’s a job creator, a tax creator,” said Ms. Minton. “They will have an opportunity to regulate this market that already exists.”
Gov. Chris Christie, a Republican who will leave office in January, sat in the front row of the courtroom during arguments at the high court and said afterward that if justices side with the state, the bets could be “taken in New Jersey within two weeks of a decision by the court.”
If the justices strike down the law, 32 states would likely offer sports betting within five years, according to a report by a California research firm.
Ms. Minton said Europe has successfully legalized sports betting, allowing bookies to work with leagues to help control corruption. But in America, “the bookies cannot even go to the cops if something’s going on.”
Geoff Freeman, CEO of the American Gaming Association, said the federal law has enabled an illegal sports betting market and is preventing states from realizing large tax revenue.
His organization said Americans wager roughly $150 billion every year on sports.
“I heard a court that was suspicious of the federal government’s overreach,” Mr. Freeman said of the justices. “We are one giant step closer to a sports betting market.”
New Jersey state Sen. Ray Lesniak is predicting that the Supreme Court will hand the state a victory in its yearslong efforts to legalize sports betting.
Mr. Lesniak said after listening to Monday’s arguments in Washington that he thinks the court will rule 7-2 or 6-3 in New Jersey’s favor. The Democrat sponsored the bill that legalized sports betting in the state, prompting the lawsuit from the four major U. S. sports leagues and the NCAA that ultimately made its way to the Supreme Court .
Mr. Lesniak said the likelihood of a ruling in the state’s favor is “not quite a slam-dunk, but it’s about Tiger Woods and a 5-foot putt.”
He says sports gambling will be a “lifeblood” for the struggling casinos in Atlantic City and for New Jersey’s racetracks.

Fear mongering over the Republican tax plan is getting ridiculous

„People will die!“
In 2013, Republican Congresswoman Michele Bachmann said on the House floor of Obamacare, “let’s repeal this failure before it literally kills women, kills children, kills senior citizens!” Republican Senator Lindsey Graham once said that a failure by the U. S. to go to war with Syria would result in Charleston, South Carolina being nuked. Donald Trump said last year, “Thousands of Americans have been killed by illegal immigrants.”
Bachmann was referring to health rationing or “death panels” some Obamacare opponents feared, which actually do exist under other government-run health care systems. Graham was worried about Syria’s chemical weapons. Trump is not wrong that illegal immigrants committing murder has happened.
But does framing debates over health care, foreign policy and immigration using extreme scenarios really help anyone? Does this kind of fear mongering actually represent what’s at stake?
Is it remotely accurate?
Does such hyperbole– PEOPLE WILL DIE!!! –do anything to advance productive discussion about public policy?
Right now, far too many are taking the same approach to Republicans’ tax reform plan. Exhibit A: Former economist Larry Summers said Monday that 10,000 people will die due to tax reform.
10,000? Wow. How does Summers know this?
He doesn’t. No one could possibly know this or make such a prediction. Summers is just spouting off numbers.
The former Bill Clinton and Barack Obama adviser believes that the repeal of the individual mandate—the federal government not forcing private citizens to purchase health care—means some people won’t have adequate care and might die sooner than they would have otherwise.
They will die at some point. All of us will eventually. Obamacare could have also actually established death panels.
But is either of these examples central to the primary arguments over tax and health care policy, or are they more accurately viewed as outrageous claims designed to distract?
It’s hand-wringing for its own sake.
Comedian Patton Oswalt seems to think that with the Republicans “#TaxBillScam,” America is over.
“Is there any going back after this #TaxBillScam? To America?,” Oswald tweeted Saturday. “Does it matter now if Trump is impeached? There’s no America now. Not the one we knew. Sorry, feeling real despair this morning.”
I’m not sure which part of the tax plan has upset Oswalt, but what is a more likely scenario?: That the Republican tax plan (or Obamacare, or Syria, or illegal immigrants) will end America as we know it? Or that the country will still remain relatively unaltered as has happened pretty much every time someone left or right claims the other side’s policies will obliterate us all?
The truth is that the tax plan, like health care, foreign policy, and immigration, are more often complex in detail than most bumper sticker-sized texts and tweets will allow. For every story you read about how the GOP tax will hurt people, you can usually find a counterargument as to why it would help them. Either side could be right or wrong. Perhaps each is right in part and wrong in part. Determining what’s true and what’s false is the entire point of political debate.
But just constantly scaring people is not debate.
In June, libertarian comedian Remy made a hilarious video for Reason demonstrating how politicians love to frame passing new laws as life or death decisions.
The video begins will Democratic Senator Elizabeth Warren claiming that “ people will die ” due to a GOP House health care bill. Remy then mocks her statement, pretending to be various congressmen (with names like “Sen. Max Hyperbole” and “Sen. Guy Knowsbedder”) who push for mandatory organ donation legislation, new speed limit laws, mandatory helmet bills, alcohol prohibition, life in prison for any crime (since some murders are committed by repeat offenders), and even whipped cream bans.
Remy ends every mock proposal by saying anyone who opposes them simply wants “people to die!”
It’s comical, but on point. How often is our discourse legitimate political debate, and how often is it just a competition to see which side can out-fear monger the other?

Target launches Wallet for in-store mobile payments

Target’s REDcard users can pay with the Target app and apply discounts from the company’s coupon program.
Target is the latest to jump on the trend, as today the mega retailer announced its new Wallet for mobile payments, which can be found on both the iOS and Android versions of the Target app.
As with many other mobile payment systems, Wallet is a way of checking out with your smartphone at the register. At Target (as with Walmart), this is essentially the only way you can do this as the retailer doesn’t accept Apple Pay or Android Pay. (Samsung Pay reportedly works at Target for some users because it’s not based on NFC.)
The main appeal of Wallet, though, is that it allows users to both pay with the app and scan coupons from the company’s Cartwheel program and automatically apply the discounts. Paying for items and applying Cartwheel discounts used to take two different steps, but the Wallet allows Target shoppers to simplify those multiple steps into one.
The catch, for now, is that you need to have one of Target’s REDcards for debit or credit purchases to use the app, but Target plans to extend the service beyond RED members at some point in the future.
Target’s announcement post plays up how much faster this process is compared to „other payment types,“ which presumably refers to traditional swipe and chip-and-PIN methods. Naturally, it neglects to mention that Apple Pay and Android Pay would be faster still as they remove the extra step of having to open an app.
You also can’t use gift cards with the Wallet feature at the moment, but that feature will be coming „soon.“
Whether users gravitate to Wallet is another question, but Target is certainly doing what it can to stay up to speed with rivals.

Это позволит оперативно регулировать информационное пространство и не допускать никаких безнаказанных заявлений или любой информационной политики, которая отрицает территориальную целостность Украины или подвергает сомнению такие выдающиеся события, как Революция достоинства“, – говорится в сообщении.
Напомним, активисты в балаклавах вечером в воскресенье, 3 декабря, начали блокаду офиса телеканала NewsOne в Киеве из-за сепаратистских высказываний владельца канала.
Позже стало известно, что офис телеканала блокируют активисты, связанные с партией Братство Дмитрия Корчинского.

Офіційно влада РФ не визнає участі у збройних конфліктах за кордоном співробітників приватних військових компаній – за російським законодавством це потрапляє під статтю «найманство». Але і на Донбасі (де, за версією російської влади, взагалі немає солдатів РФ), і в Сирії (розмір російського військового контингенту невідомий), як розповідали очевидці і родичі загиблих росіян, брала участь у боротьбі велика кількість співробітників приватних компаній, пов’язаних з російською владою. «Тепер на них чекає наступне відрядження: до Судану, де вже воюють «добровольці» з Росії», – йдеться в публікації.
«Я чув, що люди туди поїхали і вже навіть повернулися з важкою формою малярії, – підтвердив ВВС керівник приватної військової компанії «РСБ-Групп» Олег Криницин. – У нас інтереси там є, але ми там не воюємо і не беремо участі… там уповільнений прикордонний конфлікт». Співробітники «РСБ-Групп», за його словами, до Судану не поїхали і «знаходяться на місцях своєї дислокації».
Колишній «міністр оборони» терористичного угрупування «ДНР» Ігор Стрєлков (Гіркін), який воював на боці проросійських сепаратистів, також сказав ВВС, що чув про нові відрядженнях до Судану.

1. President Trump was in Utah, where he signed proclamations drastically reducing the size of two national monuments there: Bears Ears, above, and Grand Staircase-Escalante.
That could open up millions of acres of protected land to oil and gas extraction, mining, logging and other commercial activities.
Native American groups and environmentalists have vowed to fight the move in court, and the legal battle could alter the course of American land conservation.

2. Earlier in the day, President Trump tweeted that the F. B. I. had ruined the life of Michael Flynn, his former national security adviser who has pleaded guilty to lying to the bureau. He also accused Hillary Clinton, his former electoral opponent, of lying “many times” to the F. B. I.
And the president formally endorsed Roy Moore, the Republican candidate for Senate in Alabama. Mr. Moore, above, has been accused of inappropriate sexual contact with underage girls.

Collection of eight Mega Man X games coming to consoles and PC in 2018

If it wasn’t enough that Capcom was releasing Mega Man 11, along with its Legacy Collection on Switch, the firm will also bring the Mega Man X series collection to consoles next summer.
It was more than a decade ago that Capcom released the Mega Man X Collection exclusively in the United States for the PlayStation 2 and GameCube. Now, the publsiher has revealed that a new collection for the Mega Man X series will be coming to modern consoles in summer of 2018.
While some might not be familiar, the Mega Man X series offered a similar experience to the original Mega Man series, but added some interesting moves to the character like wall riding, air boosts, and more. Mega Man was also able to upgrade parts of his armor permanently by finding hidden capsules. All of these new skills were in addition to the core component of the game, where Mega Man could defeat a boss and assimilate its skill into his own repertoire.
The new collection will be coming to the Nintendo Switch, PlayStation 4, Xbox One and PCnext summer. Capcom also announced that its Legacy Collection would be coming to the Nintendo Switch, along with a new Mega Man game.

Immigration officers will be taught basic Mandarin to help them communicate with Chinese travelers visiting the Philippines, according to the Bureau of Immigration.
The agency has partnered with the University of the Philippines (UP) Diliman, which will provide language tutors to more than 50 immigration officers.
“We hope to address the language barrier by teaching our immigration officers the basics of conversational Chinese,” said Grifton Medina, personnel section chief of the bureau.
Foreigners may not be allowed to enter the country if they cannot satisfactorily answer questions, such as their travel itinerary, intended length of stay and purpose of travel.
They may also be barred from entering the Philippines if they are deemed undesirable aliens and would end up as a burden to the state.
Chinese tourists are the second biggest group of visitors to the country. From January to November, the Bureau of Immigration recorded 796,487 Chinese visitors.
A number of them do not speak or understand English. “They speak only Chinese. So when we ask them the purpose of their travel and other questions, there’s a misunderstanding with our immigration officers. We want to address that,” Medina said.
The Bureau of Immigration tried to solve the problem last year by hiring 12 Chinese-speaking interpreters. But Medina said this would not be enough since the interpreters would be working 24/7.
“It’s better for the immigration officers to be equipped with Mandarin so they could communicate better with the Chinese nationals,” he said.
He recalled instances of Chinese tourists not being allowed entry due to their failure to answer the immigration officers’ questions satisfactorily because of the language barrier. They would later return to the Philippines, with complete documents to prove the legality of their travel to the country.
“We want to prevent these instances of misunderstanding due to the language barrier,” Medina said.
The immigration bureau signed a memorandum of agreement with UP officials in October, with the training of some 50 immigration officers to begin in January.
Immigration officers will be taught conversational Mandarin and how to ask questions pertaining to immigration formalities.
First to undergo the training are the immigration officers assigned to Ninoy Aquino International Airport. Those in other international airports will be trained later.

Кабінет міністрів направив до Верховної Ради доопрацьований проект закону про державний бюджет на 2018 рік.
На офіційному сайті Верховної Ради сказано, що 4 грудня проект закону №7000 надійшов на розгляд бюджетного комітету, керівництва парламенту, а також направлений у тираж.

Як повідомлялося, на засіданні 1 грудня Кабмін затвердив проект бюджету на 2018 рік з поправками для розгляду Верховною Радою у другому читанні.
Згідно з проектом, доходи загального фонду держбюджету збільшилися на 28,1 млрд грн – до 839 млрд грн у порівнянні з початковим варіантом, спеціального – на 8,4 млрд грн, до 73 млрд грн.
Передбачені у допрацьованому документі витрати держбюджету зросли порівняно з попередньою редакцією на 40,5 млрд грн – до 988,634 млрд грн. У тому числі, видатки загального фонду пропонується підвищити на 23,8 млрд грн – до 906,65 млрд грн, а спецфонду – на 12,3 млрд грн, до 81,984 млрд грн.

Як повідомлялося, на засіданні 1 грудня Кабмін затвердив проект бюджету на 2018 рік з поправками для розгляду Верховною Радою у другому читанні.
Згідно з проектом, доходи загального фонду держбюджету збільшилися на 28,1 млрд грн – до 839 млрд грн у порівнянні з початковим варіантом, спеціального – на 8,4 млрд грн, до 73 млрд грн.
Передбачені у допрацьованому документі витрати держбюджету зросли порівняно з попередньою редакцією на 40,5 млрд грн – до 988,634 млрд грн. У тому числі, видатки загального фонду пропонується підвищити на 23,8 млрд грн – до 906,65 млрд грн, а спецфонду – на 12,3 млрд грн, до 81,984 млрд грн.
