NPR’s Robert Siegel speaks with Washington state Attorney General Bob Ferguson, whose case against the Trump administration’s travel ban led to Thursday night’s ruling by the 9th Circuit Court.
ROBERT SIEGEL, HOST:
A federal appeals court has made a ruling on President Trump’s executive order on immigration. They have denied the administration’s request to reinstate the ban. The president’s executive order issued just 13 days ago put a halt on travelers from seven majority Muslim countries along with all refugees worldwide.
After a lawsuit brought by the state of Washington, a federal judge in Seattle last week issued a temporary restraining order that put the policy on hold. The federal government looked to the appeals court, hoping for a stay. That request has been denied. In other words, the executive order is not in effect.
In a moment, we’ll hear from the Washington attorney general who brought the case, Bob Ferguson, and from our White House correspondent Scott Horsley with some news of the reaction there. But first, I’m joined by NPR justice correspondent Carrie Johnson. And Carrie, bring us up to speed. What has happened, and what happens now?
CARRIE JOHNSON, BYLINE: OK, Robert, this was a very narrow ruling by the three-judge panel that heard that extraordinary oral argument earlier in the week. This panel, which was two Democratic presidential appointees, one Republican presidential appointee, unanimously ruled that the Trump executive order on immigration and travel ban should remain halted for now.
They found that the White House – despite asserting a whole bunch of national security and immigration claims about presidential power, they found the court did have the authority to review those claims. They found not enough evidence to suggest that there’s a real national security threat here.
And in fact, the opposite – other people, people from Washington state, people from Minnesota, the plaintiffs in this case were suffering real hardship – separations from their families, not being able to get back to school – the public universities in those states – and the states themselves bearing a tax burden as a result of this executive order. The court found that these people’s due process rights were violated and that for this stage now, there was real harm to them and the halt – the stay should remain in place for now.
SIEGEL: So what happens next with this executive order, not to mention the temporary restraining order blocking it?
JOHNSON: Well, the court had a number of critical statements to make about the executive order, the implementation of the order, which was chaotic, as we all know, remembering those scenes from airports a couple of weeks ago, but also the way in which the White House changed position over time.
You’ll remember, Robert; the Department of Homeland Security, the State Department, the White House, the Justice Department all seemed to be of two minds about whether legal permanent residents or green card holders were subjected to this order. At first, at the border, they were. Their rights were being violated or implicated in some fashion.
Eventually, the White House counsel Don McGahn put out a statement suggesting that green card holders were exempt from this order. This court tonight found, Robert, that the White House counsel can’t just do that. You have to go back and have the president sign a new executive order or amend the one he already did.
SIEGEL: OK, Carrie, stay with us because right now we’re going to hear from the Washington state attorney general who brought this case, Bob Ferguson. We spoke a little while ago, and I started by asking him if he regards the 9th Circuit’s decision as an all-out win.
BOB FERGUSON: Let’s put it this way. I just sent a text message to my wife and sister, and I refer to it as a grand slam. It’s a complete win. We could not have written the opinion any better ourselves.
SIEGEL: When you say you couldn’t have written the opinion any better yourselves, do you see judgments here that addressed the substance of the Trump policy as opposed to just the need for a full hearing of it?
FERGUSON: No, this has never been about – at this stage – the substance. Although, to be clear, in order to prevail at the trial court, in order to get the temporary restraining order – which the hurdle is quite high – one thing the judge had to determine was, we had a high likelihood of success on the merits when he gets to that stage. So that’s already been established, and the federal government was not able to overcome that before the court of appeals.
SIEGEL: When do you go to court next?
FERGUSON: We don’t know. We’ll see what happens next. The ball is really in the federal government’s court to some degree to see if they wish to seek review by the U. S. Supreme Court. That said, what I think is going to happen ultimately now is it goes back to Judge Robart, the original trial court judge appointed by George W. Bush, who ruled in our favor.
What’ll happen is we believe that we’ll have discovery. We’ll take depositions. We’ll request emails from administration officials to look behind the thinking behind this executive order. And we’ll have a normal process and a review on the merits. But again, I remain confident at the end of the day that we will prevail before Judge Robart and back up through the appeals process again.
SIEGEL: Would you expect that you’d bump up against claims of national security as you try to get assessments of what threat is posed by immigrants from what countries?
FERGUSON: Sure, and we’re getting that now of course. And what the Department of Justice, what the president’s arguing is – and they argued this before the 9th Circuit – was, you cannot review the president’s actions. As the 9th Circuit wrote – they said – I’m quoting now – « there is no precedent to support this claimed unreviewability which runs contrary to the fundamental structure of our constitutional democracy.  »
That in one sentence underscores why I brought this litigation. No one’s above the law. That includes the president. And the notion somehow that the president can issue an executive order of this sweeping nature and have the Justice Department and the president say, hey, federal bench, you cannot look behind it, is quite candidly frightening.
SIEGEL: But do you think that you’re arguing in fact constitutionally uphill here, that in fact if you were to prevail in the long run and the policy were to be voided, that would be a new limitation on what presidents can do about immigration and national security?
FERGUSON: Absolutely not – to the contrary. When President Obama issued an executive order on immigration not that long ago, a Republican attorney general challenged that and had it struck down. It did not go into effect because of a legal challenge made by those attorneys general.
So it’s unusual, I grant you that. Getting a temporary restraining order is not easy. I recognize that what’s at stake is very significant, but the concept that can be stayed and ultimately declared unconstitutional is frankly not all that unusual.
SIEGEL: That’s the Washington State Attorney General Bob Ferguson, who brought this particular case against the president’s executive order. He spoke to us earlier this evening.

See a huge lizard hitch a ride on a chill dog's back

A very big lizard jumped aboard a patient pup during a foiled plot to steal chicken eggs.
If it weren’t for Australia, the world would be deprived of many fascinating and bizarre animal behavior stories. We now depart from the usual snake capers with the story of a goanna lizard and a patient dog.
Goannas are a type of monitor lizard that like to eat other lizards, birds and eggs. A goanna went after the eggs of chickens owned by Bev Stefanidakis in Queensland, but her pet dog Bella had other ideas.
Bella chased after the naughty lizard, which responded by jumping on the dog’s back. Noting how calm Bella was about the situation, Stefanidakis decided to film the caper and put it on YouTube on Tuesday. The goanna does its best impersonation of a backwards-riding cowboy while Bella barely seems to notice it.
Stefanidakis told 9News the goanna hung on for about 10 minutes. She unsuccessfully tried to push it off the dog’s back with a stick. It finally left when Bella sat down. The lizard then took the opportunity to run away.
The goanna situation joins a long lineup of recent oddball animal-related events, including the discovery of an elk in a basement in the US, a plague of chocoloate-stealing squirrels in Canada and the surprise appearance of a stowaway snake popping out of a car hood in the middle of a commute in Australia.

Cardiff University opens Twitter ‘cyberhate’ centre

Cardiff University researchers are to monitor Brexit-related hate crime on Twitter with funding from the Economic and Social Research Council
Cardiff University’s Social Data Science Lab is to open a Centre for Cyberhate Research and Policy to explore and monitor Brexit-related hate crimes on social media and help the government identify areas that require attention, and improve interventions to keep hate crime from spreading online.
The university has been awarded a £250,000 grant by the Economic and Social Research Council to support the work, which will focus on the development of a monitoring tool to display a live feed of the propagation of hate speech on Twitter.
“Hate crimes have been shown to cluster in time and tend to increase, sometimes significantly, in the aftermath of trigger events,” said Matthew Williams, co-director of the Social Data Science Lab, and principal investigator on the project.
“The referendum on the UK’s future in the European Union has galvanised certain prejudiced opinions held by a minority of people, resulting in a spate of hate crimes. Many of these crimes are taking place on social media.
“Over the coming period of uncertainty relating to the form of the UK’s exit, decision makers – particularly those responsible for minimising the risk of social disorder through community reassurance, local policing and online governance – will require near-real-time information on the likelihood of escalation of hateful content spread on social media. This funding will provide the system and evidence needed to achieve this,” said Williams.
The research team will not take a position on Brexit, but merely use it as a demonstration of how a certain trigger can cause a spike in hate speech related to religion, immigration and xenophobia.
Data will be collected from a 12-month period beginning on the date of the European Union (EU) referendum – 23 June 2016 – using machine learning technology to classify, analyse and evaluate tweets in real-time.
Eventually, it hopes to make its tools available to policy-makers and analysts that will show precursors to hate crimes, including the characteristics of social media users; the characteristics of their network, such as accounts followed; the type of hate speech expressed; what content they post; and other external factors, such as media reporting of events.
“We will be enhancing our existing language models using cutting edge computational methods to mine massive amounts of public reaction and provide meaningful insights into hateful and antagonistic commentary in minutes of an event occurring,” said Pete Burnap, computational lead on the project.
The centre will work closely with the UK head of the Cross-Government Hate Crime Programme and the National Police Chief’s Council, the London Mayor’s Office’s Online Hate Crime Hub, the Metropolitan Police and a number of charities.
Established in 2015, the lab has world-leading expertise on using social media to monitor online crime, and has worked with law enforcement in the UK and the US. It has already carried out preliminary studies of the spread of hate speech after the murder of fusilier Lee Rigby in Woolwich, south London, in 2013.

Премьер считает, что если бы не миграционный кризис, охвативший Европу, то решение по безвизу было бы принято еще в 2016 году.
В четверг, 9 февраля, премьер-министр Украины Владимир Гройсман заявил, что решение Европейского Союза о введении безвизового режима для граждан Украины может быть принято до июня текущего года, передает Интерфакс-Украина.
« Фактически сейчас каждый месяц будут происходить определенные технические процедуры, которые позволят ориентировочно, я думаю, до июня по срокам выйти на окончательное решение », – сказал премьер в эфире одного из украинских телеканалов.
Премьер считает, что если бы не миграционный кризис, охвативший Европу, то решение по безвизу было бы принято еще в 2016 году.
По его словам, до марта ЕС утвердит механизм приостановки безвизового режима.
« Возник вопрос, чтобы ввести « предохранитель ». Если будет в странах безвизовый режим, как быстро принять оперативное решение, чтобы приостановить этот режим… Я думаю, что уже в этом месяце это будет проголосовано. Я так думаю, потому что у меня есть соответствующая информация. И дальше мы выйдем на протяжении 3-4 месяцев на окончательное решение и по Украине, и по Грузии », – выразил свои убеждения он.
При этом Гройсман добавил, что Украина выполнила все необходимые условия для получения безвизового режима.
Как сообщал MIGnews.com.ua, в среду, 8 февраля, стало известно, что триалог по визовой либерализации для граждан Украины состоится 28 февраля.
По решению Совета Европейского союза, в случае предоставления визовой либерализации Украине, безвизовый режим вступит в силу только синхронно с введением в действие нового механизма ЕС по безопасности. Данный механизм включает в себя возможность приостановления действия безвизового режима Евросоюза с третьими странами.

В результаті вибуху хлопець отримав мінно-вибухові травми, осколкові поранення грудної клітки і кінцівок.
Повідомлення про подію надійшло в поліцію із маріупольської лікарні близько 17:45. Медики повідомили, що чоловік отримав поранення близько 13:00 і зараз знаходиться на операції.
За словами поліцейських, це перший такий випадок у цьому році. Зараз правоохоронці встановлюють обставини події.
Як повідомлялося, число постраждалих мирних жителів у результаті обстрілів Авдіївки зросло до 10.

В зоні АТО збили російський безпілотник

Українські військові вивчають ворожий дрон.
« Після ідентифікації об’єкта й одержання підтвердження, що літальний об’єкт не належить силам АТО, ні міжнародним організаціям, які здійснюють моніторинг обстановки поблизу лінії розмежування засобами безпілотної авіації, було прийнято рішення про його знищення », – повідомляє прес-центр.
Об’єкт був уражений зі стрілецької зброї. Зараз над ним працюють фахівці. За попередніми даними, аналогічний тип БПЛА використовується збройними силами Російської Федерації.
Раніше армія Росії офіційно прийняла на озброєння безпілотні літальні апарати « Орлан-10 », здатні « глушити » сигнали мобільного зв’язку, в тому числі 3G і 4G і взаємодіяти зі смартфонами користувачів. Такий безпілотник можна використовувати як базову станцію мобільного зв’язку.
