Twitter’s terms of service are suddenly making people freak out — but they’ re not new

Twitter is making some minor changes to its terms of service (ToS) for users outside of the U. S. this October and a lot of people are rather upset about them.
What seems to be the trigger here is that these “new” terms are going into effect for the rest of the world on October 2nd and Twitter is likely notifying its users of this update now. The new ToS takes out a few things specific to the U. S. and adds a new European address. That’s pretty much it, but because most users probably never read the old terms of service, they seem to assume that everything in the “new” terms of services is actually “new.”
The main issue here is over a section where the ToS mention Twitter’s ability to offer up the use of user-generated content and embedded tweets to other companies for promotion and distribution. This would apply to news organizations that may want to broadcast that content during a syndicated show, for instance, or really anybody who wants to embed a tweet.
Twitter user Richard de Nooy first pointed out the issue he had with Twitter’s terms, tweeting, “Your terms of service agreement is un-fucking-believable, Twitter. This is grotesque. Especially for users posting original content.”
Hundreds of other users tweeted back — either in agreement or to point out these terms are pretty normal.
But, as noted by Twitter user Alex Hern, the language here isn’ t new. We should also point out news organizations and other companies and individuals can already use content found on the site, as that content is public and is already considered fair use.
Changes that will actually go into effect with these new ToS include changes in the language around the right to remove content that violates Twitter’s user agreement, removal of certain limitations of liability such as Twitter user’s liability in access to “as-is” content that could be damaging and an addition of a 30-day notice of changes to the terms that impact others rights of others (which was previously only a promise) .
You can see all the changes, which will go into effect outside of the U. S. at the end of this month here to compare the old terms with the new ones.
If you want to write to Twitter in Europe, by the way, please note that while very little else in the ToS has changed, Twitter’s new address in Dublin is now “The Academy, 42 Pearse Street, Dublin 2, Ireland.”

They had no idea they would hear Kobe Bryant.
The former Lakers star, who retired in April 2016, took the stage to narrate “Dear Basketball, ” the letter he wrote in November 2015 when he decided to retire. The letter had been animated and, in a partnership of all-time greats, set to music by Williams, the composer of the most identifiable film scores of several generations.
Not that Williams is even remotely a basketball fan.
He explained Friday that years ago he got a message that Bryant wanted to meet with him, but Williams said he barely had watched basketball on any level. Bryant, however, wanted to talk about the creative process, as well as his daughters’ love of Williams’ “Harry Potter” music.
Williams said that much later, after Bryant retired with his 60-point farewell, Bryant reached out again to tell him that “Dear Basketball” had been animated and could use a little music.
The Southern California crowd already was buzzing but turned mostly ecstatic when Williams introduced his guest narrator: Bryant.
After Bryant left to another loud ovation, Williams launched into a three-song set from “Star Wars” and then left the stage for one of several curtain calls.
Only he was met before he could get to the wings of the Bowl by Bryant, who returned to the stage showing some deft moves with a red plastic light saber.

Two NASA astronauts slated to return from space to Houston after devastating floods

Imagine hovering 200 miles above earth while your family, friends and coworkers are tormented by a gruesome storm that took lives and destroyed homes.
Fisher was one of six astronauts on International Space Station. He looked down on his hometown of Houston — headquarters for NASA’s human spaceflight operations — as Hurricane Harvey wreaked havoc on the Gulf Coast.
« Harvey fills the window creating a path of destruction as it traverses the Gulf. Praying for the people there and hoping for sunshine,  » Fisher wrote on social media from aboard the ISS Wednesday.
On Saturday, Fisher, along with fellow NASA astronaut Peggy Whitson and one Russian cosmonaut, will return to Earth. The Americans will begin the trek back to a water-logged Houston.
Getting the astronauts on solid ground is the next great challenge for a small team of NASA flight controllers who have been hunkered down at Johnson Space Center in Houston for days. The flight controllers have been living at the NASA complex, riding out Harvey and providing critical support to the crew on board the space station.
It’s because of that ground-based team that astronauts were able to get updates on their families as Harvey pounded the city.
The center took « significant » damage, the agency said. At least two facilities at the space center experienced flooding and water damage, but the Mission Control Center remained operational.

The team there was able to keep things running relatively smoothly, despite Harvey, but their day to day life was anything but normal.
About 13 cots lined the walls of the complex. Staff caught naps between shifts. Flight director Royce Renfrew posted pictures on social media of the beds. A sign outside the makeshift bunk room reads, « SLEEPING QUARTERS shhh… »

« It takes an incredibly professional group of individuals to come in and sit down and fly the space station for nine hours, or some people had to take 13 hour shifts,  » NASA flight director Zeb Scoville told CNN. « Then they had to turn around, wake up and do it over again. »
Scoville, who is leading the ground-based team, said everyone is still dressed in business wear. It maintains « a level of respect » for the history of flight controllers before them, Scoville said.
Fisher and Whitson, along with Russian cosmonaut Fyodor Yurchikhin, are set to depart the space station Saturday in a capsule and splash down off the coast of Kazakhstan at 9: 22 p.m. ET.
Fisher and Whitson will travel to Germany, and from there the astronauts will board a plane to Houston. The final leg of their trip will happen a bit later than initially scheduled because of damage to Ellington Airport airport, a NASA and U. S. military flight hub, an agency spokesperson said.
Whitson — a seasoned astronaut who owns the record for the most cumulative time a NASA astronaut has ever spent in space — had to cancel her final press conference aboard the space station because of the storm.
She shared her thoughts on returning to a storm-ravaged city in messages posted to NASA.com.
« Our home is fine, but so many friends and co-workers have been impacted,  » she said. However, « any trepidations I might have about returning in the aftermath of a hurricane are entirely eclipsed by all those folks keeping our mission going and physically putting themselves out there to help folks who were less fortunate than us. »
In addition to the crew members holed up at the space center, various NASA workers have phoned in from home to lend more help.
They did this, « all the while worrying about the Sheetrock that needed to be torn out of their flooded house,  » Whitson said.
Scoville, the flight director, said, « It doesn’t matter what your job or title is. This affects a program manager, an astronaut, or a flight director just as well…and they’ve all been affected and have to deal with the destruction. »
But despite it all, Scoville added, morale is high.
« They’re going to keep [the space station] flying,  » he said.
The crew even has its own mission patch to commemorate their efforts to keep Johnson Space Center up and running in spite of Harvey. Its tagline is « ad astra per aqua. » It means, « to the stars, through water. »

Madonna moves to Portugal where she'll work on a new film and new music

The singer had been living in New York, but says Portugal makes her feel creative and alive.
NEW YORK (AP) — Madonna is heading overseas to a new home in Portugal.
The Michigan native had been living in New York. She said on Instagram Saturday that she finds the energy of Portugal inspiring, and it makes her feel creative and alive.
A spokesman for the singer said she fell in love with the country after ending a tour there in 2004. Madonna posted that she’ll be working on a film and new music in Portugal.
She said in her Instagram post: « It’s time to conquer the world from a different vantage point. »

Włoska agencja ANSA podała informację o zatrzymaniu kolejnego mężczyzny podejrzewanego o gwałt na polskiej turystce w Rimini.
W sobotę 2 września dwaj nastolatkowie z Maroka sami zgłosili się na komisariat policji i przyznali do zgwałcenia turystki z Polski. Po kilku godzinach włoskie media poinformowały o zatrzymaniu kolejnego z napastników. Oznaczałoby to, że na wolności przebywa jeszcze ostatni z czwórki mężczyzn, którzy napadli na polską parę, brutalnie kobietę i bijąc jej męża. Wyjaśnienia całej zatrzymanych są teraz sprawdzane przez śledczych. Kwestią czasu wydaje się zatrzymanie ostatniego z napastników.
Nagranie z kamer monitoringu
W tydzień po brutalnym zgwałceniu Polki na plaży w Rimini włoska policja zdecydowała się na ujawnienie wizerunków sprawców. Włoskie media podkreślają, że zdjęcia są „wyraźne”. Problem w tym, że na opublikowanych nagraniach z kamery monitoringu nie widać twarzy podejrzanych, a jedynie ich plecy. Jednego z nich prawie w ogóle nie sposób dojrzeć na nocnym nagraniu. Mimo to śledczy twierdzą, że są o krok od złapania całej czwórki napastników. Mają to być imigranci z Afryki Północnej. Włoska agencja informacyjna ANSA zapewnia, że policja posiada więcej wizerunków sprawców, w tym także zdjęcia ich twarzy.
Atak na polskie małżeństwo
O sprawie po raz pierwszy poinformowano w sobotę 26 sierpnia. W Rimini we Włoszech, czterej napastnicy zgwałcili Polkę na oczach jej męża. Małżeństwo wybrało się na spacer po plaży około 4 nad ranem. Nagle zostali brutalnie zaatakowani przez nieznanych napastników. Dotkliwie pobili oni mężczyznę, a później, na jego oczach, dokonali wielokrotnego, zbiorowego gwałtu na kobiecie. Dramatyczna sytuacja trwała do samego rana.
Policję na miejsce wezwał jeden z przechodniów, który zobaczył zakrwawioną i oszołomioną parę na promenadzie. Kobietę przewieziono do szpitala, gdzie towarzyszy jej mąż. Parę już przesłuchano. Zabezpieczono ubranie kobiety, w celu znalezienia na nim jakichkolwiek śladów prowadzących do sprawców. Minister sprawiedliwości Zbigniew Ziobro polecił wszcząć polskie śledztwo w tej sprawie.

President Donald Trump visited a relief center in Houston on Saturday to meet with victims of Harvey, the catastrophic storm that triggered severe flooding in Texas and presented his young administration with its most challenging domestic crisis.
Trump earlier landed at Ellington Field military base in Houston after a flight from Washington, dressed in a black rain jacket with no tie.
On his second visit to the devastated state this week, the president was accompanied by his wife Melania Trump, who wore a baseball cap emblazoned with the word “Texas, ” green khaki trousers and walking shoes.
The visit gave the president an opportunity to show a warm and empathetic side to victims of the worst storm to hit Texas in 50 years. Some have criticized him for staying clear of the disaster zone during a visit on Tuesday, when he said he did not want to hamper rescue efforts.

Windows 7 continues to stumble while Windows 10 ascends in market share

The latest statistics from separate firms indicate that Windows 7 is continuing to stumble in terms of market share while Windows 10 is steadily rising. Overall, Windows still dominates the market.
Last month, we reported that Windows 10 grew by almost one percentage point – according to NetMarketShare’s data – to claim 27.63% of the market. Although the increase isn’t as major this month, it’s still quite significant in terms of indicating the trend in OS market share.
According to the latest statistics provided by the aforementioned firm, Windows 10 has now grown to 27.99%, while Windows 7 has fallen to 48.43%. Although these changes may appear to be slight and within the margin of error, they do continue to follow the trend set in the past few months.
Similarly, Windows 8.1 usage decreased to 6.07% from the 6.48% reported last month. Windows XP also faced a slight decline and now commands the same market share as Windows 8.1.Apple’s macOS grew very slightly and now sits at 3.59%. The « Others » category, which also includes Linux distros, increased to 7.84%.
A separate firm, StatCounter, indicated similar trends as well. All iterations of the Windows operating system collectively command 83.53% of the market, while Apple’s macOS is now at 11.95%. The company has divided the 83.53% market share of Windows relative to individual versions of the operating systems as well, which can be seen below:
Using simple arithmetic (45.09 / 100 * 83.53) , where 45.09 is the Windows 7 market share, and 83.53 is the total Windows market share, it is easy to calculate that Windows 7 has fallen to 37.66%. On the other hand, Windows 10 has shown growth and risen to 31.63%. At the same time, Windows 8 / 8.1, and Windows XP command market shares of 9.71% and 3.74% respectively.
That said, it is important to note that this data from both the firms is derived from their partner websites and tracking codes, and as such, may not entirely depict the actual situation.

HOUSTON (AP) – A Texas city that lost its drinking water system to Harvey’s floodwaters struggled Saturday to restore service, and fire officials kept monitoring a crippled chemical plant that has twice been the scene of explosions and fires since the storm roared ashore and stalled over Texas more than a week ago.
Officials in Beaumont, population almost 120,000, worked to repair their water treatment plant, which failed Thursday after the swollen Neches River inundated the main intake system and backup pumps failed. The Army Corps of Engineers sent pumps, and an ExxonMobil team built and installed a temporary intake pipe in an effort to refill a city reservoir. Exxon has a refinery and chemical plants in Beaumont.
On Friday, people waited in a line that stretched for more than a mile to get bottled water.
In Crosby, outside of Houston, authorities were continuing to monitor the Arkema plant where three trailers of highly unstable compounds ignited in recent days, sending thick black smoke and tall flames into the air. A Harris County fire marshal spokeswoman said Saturday that there were no active fires at the facility, but six more trailers were being watched.
The soggy and battered city of Houston began burying its dead and taking steps toward the long recovery ahead. The storm is believed to have damaged at least 156,000 dwellings in Harris County, which includes the city.
Kim Martinez, 28, waited Saturday for insurance adjusters to come to her Southbelt/Ellington neighborhood, a devastated middle-class area of southeast Houston where fast-food restaurants, strip malls and churches line major streets.
The mother of two was hosting a watch party for the Floyd Mayweather-Conor McGregor fight last Saturday when floodwaters forced about 15 people to the attic. They escaped the next day. Seven children were rescued by a neighbor’s boat. The women and a 115-pound German shepherd used inflatable swim toys, and the men swam or waded through shoulder-high water.
« You can be prepared for anything but not a monster storm like Harvey,  » said her mother, Maria Martinez, 63.
President Donald Trump arrived in Houston for his second visit to the devastated region. He also will visit Lake Charles, Louisiana, to survey damage. The White House said he would to talk to people affected by the disaster and meet with volunteers. Those elements were missing from his first visit on Tuesday.
Trump has asked lawmakers for a $7.9 billion down payment toward Harvey relief and recovery efforts – a request expected to be swiftly approved by Congress, which returns to work Tuesday after its summer break.
Friends and family gathered Friday evening to remember 42-year-old Benito Juarez Cavazos, one of 43 people whose deaths are attributed to Harvey. Cavazos came to Texas illegally from Mexico 28 years ago and was in the process of getting his green card.
« It’s very unfortunate that right when he finally had hopes of being able to maybe go to Mexico soon to go see his family, it all went downhill,  » his cousin, Maria Cavazos, said. « Sadly, he’s going back to Mexico, but in an unfortunate way. »
Also Friday, Houston Mayor Sylvester Turner announced that ongoing releases of water from two reservoirs could keep thousands of homes flooded for up to 15 days.
Residents of the still-flooded western part of Houston were asked to evacuate due to the releases from two reservoirs protecting downtown. The releases were expected to keep some homes flooded that had been filled with water earlier in the week. Homes that are not currently flooded probably will not be affected, officials said.
Turner pleaded for more high-water vehicles and more search-and-rescue equipment as the nation’s fourth-largest city continued looking for any survivors or corpses that might have somehow escaped notice in flood-ravaged neighborhoods.
Search teams quickly worked their way down streets, sometimes not even knocking on doors if there were obvious signs that all was well – organized debris piles or full cans of trash on the curb, for instance, or neighbors confirming that the residents had evacuated.
Turner also asked the Federal Emergency Management Agency to provide more workers to process applications from thousands of people seeking government help. The mayor said he will request a preliminary aid package of $75 million for debris removal alone.
The storm had lost most of its tropical characteristics but remained a source of heavy rain. National Weather Service meteorologists expect Harvey to break up and merge with other weather systems over the Ohio Valley late Saturday or Sunday.
Harvey initially came ashore Aug. 25 as a Category 4 hurricane, then went back out to sea and lingered off the coast as a tropical storm for days. The storm brought five straight days of rain totaling close to 52 inches (1.3 meters) in one location, the heaviest tropical downpour ever recorded in the continental U. S.
Another storm was churning far out over the Atlantic. Hurricane Irma was following a course that could bring it near the eastern Caribbean Sea by early next week. The Category 2 storm was moving northwest at nearly 13 mph (20 kph) . No coastal watches or warnings were in effect.
