Trump forges ahead on Jerusalem-as-capital despite warnings

U. S. officials say President Donald Trump will recognize Jerusalem as Israel’s capital on Wednesday and instruct the State Department to begin a multi-year process of moving the American embassy from Tel Aviv to the holy city.
President Donald Trump will recognize Jerusalem as Israel’s capital on Wednesday despite intense Arab, Muslim and European opposition to a move that would upend decades of U. S. policy and risk potentially violent protests.
Trump will instruct the State Department to begin the multi-year process of moving the American embassy from Tel Aviv to the holy city, U. S. officials said Tuesday. It remains unclear, however, when he might take that physical step, which is required by U. S. law but has been waived on national security grounds for more than two decades.
The officials said numerous logistical and security details, as well as site determination and construction, will need to be finalized first. Because of those issues, the embassy is not likely to move for at least 3 or 4 years, presuming there is no future change in U. S. policy.
To that end, the officials said Trump will sign a waiver delaying the embassy move, which is required by U. S. law every six months. He will continue to sign the waiver until preparations for the embassy move are complete.
The officials said recognition of Jerusalem as Israel’s capital will be an acknowledgement of « historical and current reality » rather than a political statement and said the city’s physical and political borders will not be compromised. They noted that almost all of Israel’s government agencies and parliament are in Jerusalem, rather than Tel Aviv, where the U. S. and other countries maintain embassies.
The U. S. officials spoke to reporters on condition of anonymity Tuesday because they were not authorized to publicly preview Trump’s Wednesday announcement. Their comments mirrored those of officials who spoke on the issue last week.
The declaration of Jerusalem as Israel’s capital is a rhetorical volley that could have its own dangerous consequences. The United States has never endorsed the Jewish state’s claim of sovereignty over any part of Jerusalem and has insisted its status be resolved through Israeli-Palestinian negotiation.
The mere consideration of Trump changing the status quo sparked a renewed U. S. security warning on Tuesday. America’s consulate in Jerusalem ordered U. S. personnel and their families to avoid visiting Jerusalem’s Old City or the West Bank, and urged American citizens in general to avoid places with increased police or military presence.
Trump, as a presidential candidate, repeatedly promised to move the U. S. embassy. However, U. S. leaders have routinely and unceremoniously delayed such a move since President Bill Clinton signed a law in 1995 stipulating that the United States must relocate its diplomatic presence to Jerusalem unless the commander in chief issues a waiver on national security grounds.
Key national security advisers — including Secretary of State Rex Tillerson and Defense Secretary Jim Mattis — have urged caution, according to the officials, who said Trump has been receptive to some of their concerns.
The concerns are real: Trump’s recognition of Jerusalem as Israel’s capital could be viewed as America discarding its longstanding neutrality and siding with Israel at a time that the president’s son-in-law, Jared Kushner, has been trying to midwife a new peace process into existence. Trump, too, has spoken of his desire for a « deal of the century » that would end Israeli-Palestinian conflict.
U. S. officials, along with an outside adviser to the administration, said they expected a broad statement from Trump about Jerusalem’s status as the « capital of Israel. » The president isn’t planning to use the phrase « undivided capital, » according to the officials. Such terminology is favored by Israeli officials, including Prime Minister Benjamin Netanyahu, and would imply Israel’s sovereignty over east Jerusalem, which the Palestinians seek for their own future capital.
Jerusalem includes the holiest ground in Judaism. But it’s also home to Islam’s third-holiest shrine and major Christian sites, and forms the combustible center of the Israeli-Arab conflict. Any perceived harm to Muslim claims to the city has triggered volatile protests in the past, both in the Holy Land and across the Muslim world.
Within the Trump administration, officials on Tuesday fielded a flood of warnings from allied governments.
The Jerusalem declaration notwithstanding, one official said Trump would insist that issues of sovereignty and borders must be negotiated by Israel and the Palestinians. The official said Trump would call for Jordan to maintain its role as the legal guardian of Jerusalem’s Muslim holy places, and reflect Israel and Palestinian wishes for a two-state peace solution.
Still, any U. S. declaration on Jerusalem’s status ahead of a peace deal « would harm peace negotiation process and escalate tension in the region, » Saudi Arabia’s King Salman told Trump Tuesday, according to a Saudi readout of their telephone conversation. Declaring Jerusalem as Israel’s capital, the king said, « would constitute a flagrant provocation to all Muslims, all over the world. »
In his calls to Palestinian President Mahmoud Abbas and Jordan’s King Abdullah II, Trump delivered what appeared to be identical messages of intent. Both leaders warned Trump that moving the embassy would threaten Mideast peace efforts and security and stability in the Middle East and the world, according to statements from their offices. The statements didn’t speak to Trump’s plans for recognizing Jerusalem as Israel’s capital.
Ahmed Aboul-Gheit, the head of the Arab League, urged the U. S. to reconsider any recognition of Jerusalem as Israel’s capital, warning of « repercussions. » Turkish President Recep Tayyip Erdogan told his Parliament such recognition was a « red line » and that Turkey could respond by cutting diplomatic ties with Israel.
French President Emmanuel Macron said he reminded Trump in a phone call Monday that Jerusalem should be determined through negotiations on setting up an independent Palestine alongside Israel. Meeting U. S. Secretary of State Rex Tillerson in Brussels, EU foreign policy chief Federica Mogherini said actions undermining peace efforts « must be absolutely avoided. »
Despite Trump’s comments to world leaders, U. S. officials said an embassy announcement wasn’t seen as imminent. Instead, they said Trump on Wednesday would likely sign a waiver pushing off any announcement of moving the embassy to Jerusalem for another six months.
Trump also will give wide latitude to his ambassador in Israel, David Friedman, to make a determination on when a Jerusalem embassy would be appropriate, according to the officials. Friedman has spoken in favor of the move.
Majdi Khaldi, Abbas’ diplomatic adviser, said Trump’s recognition of Jerusalem as Israel’s capital could end Washington’s role as mediator.
« This would mean they decided, on their own, to distance themselves from efforts to make peace, » Khaldi told The Associated Press in perhaps the most sharply worded reaction by a Palestinian official. He said such recognition would lead the Palestinians to eliminate contacts with the United States.
Changing Jerusalem’s status would be « a stab in the back, » Husam Zomlot, the Palestinians’ chief delegate to Washington, told the AP.
Palestinian political factions led by Abbas’ Fatah movement called for daily protest marches this week, starting Wednesday. East Jerusalem, now home to more than 300,000 Palestinians, was captured by Israel in 1967 and then annexed in a move most of the international community has not recognized.

Smoke obscured the sky in Ventura, about 60 miles northwest of Los Angeles, leading James and Josie Ralstin to don masks Tuesday as they carried some belongings from their home in view of a burning residence.
Fires are not common in December but can break out when parched vegetation and a lack of rain combine with the region’s infamously dangerous Santa Ana winds. Hardly any measurable rain has fallen in Southern California in the past six months.
The speed of the flames served as a reminder of the wildfires in Northern California wine country eight weeks ago that killed 44 people and destroyed thousands of homes and other buildings.

Destiny 2: Curse of Osiris brings some great new Exotics along with it, including the Crimson – a hand cannon that is clearly intended as the spiritual successor to Destiny 1’s Red Death.
The new expansion is out now, so we’re getting to see some of the cool new gear that Guardians can now get their hands on.
The Red Death, the “ deadliest rifle in Destiny “, has been reborn as a handgun with a 3-round burst. The Crimson has a very similar design, right down to the bayonet on the front, and it has some pretty great perks to it. The Crimson is one of several new Exotics added for Curse of Osiris – you can see them all on our Exotics page, which is part of our enormous Destiny 2 guide.
The video below, from Arekkz, digs into the weapon in depth and shows what it is capable of in the right hands.
The Crimson is an Exotic engram drop, so you’re going to need good luck to get your hands on it. Keep farming until you nab it. It’s a handgun with a 3-round burst and a 24 round magazine, and while it has quite a bit of kickback it’s super satisfying to use.
The Crimson’s intrinsic perk is ‘banned weapon’, which is the source of its burst fire. Its other perks are super handy too:
Cruel Remedy is extremely handy, especially in dark zones, and precision kills reload from your magazine, not just your reserve, meaning that you can chain together several kills and avoid reloading for a while if you have extremely good aim (compensating for the kickback can be a challenge).
Arekkz reports that the gun is a lot of fun in PvE, but hasn’t been able to try it in PvP. The video also shows off the weapon’s ornament, which is extremely ostentatious, coating the gun in silver and washing out all the bloodstains.

Trump’s attorney asks judge to dismiss defamation lawsuit by former Apprentice contestant

Last October, shortly after the Access Hollywood tape became news, former Apprentice contestant Summer Zervos accused Donald Trump of kissing her and grabbing her breast during a meeting in his office that took place in 2007. Trump called those accusations “totally false” and in January of this year, attorney Gloria Allred sued Trump for defamation claiming his denial was a lie. Now jump forward 11 months to today when Trump’s private lawyer Marc Kasowitz was in a New York courtroom arguing that the case should be dismissed. From the ABC News:
Marc Kasowitz, a lawyer for the president, spoke during oral arguments in New York Supreme Court this afternoon, saying the lawsuit brought by Summer Zervos would impede the ability of the president to do his job. An attorney for Zervos, Marian Wong, said the person holding the office of president is not above the law. The hearing was adjourned without any immediate decision as the judge took both attorneys’ arguments under advisement…
Kasowitz said his motion to dismiss Zervos’ defamation claim “has nothing to do with putting anyone above the law.” He said it’s about “protecting the ability of the president to do his constitutionally-mandated job.”
Kasowitz added that he believes the New York State Supreme Court in Manhattan has no jurisdiction over the president while he is in office.
“State court can’t exercise any control over the president under any circumstances,” Kasowitz told Judge Jennifer Schechter.
The LA Times notes that the arguments made by Kasowitz today are the same ones Bill Clinton in the late-90s. Also similar, the potential pitfalls should Trump be forced to give a deposition under oath:
Being required to testify under oath could be particularly dangerous for Trump, given his history of saying things that are untrue, said Naomi Mezey, a Georgetown University law professor.
“For those people who are interested in this case as a path to impeachment, the chances of perjury in a Trump case are possibly greater than in a Clinton case,” Mezey said. “Testifying in a lawsuit takes a huge amount of discipline. If there’s one characteristic that seems absent from the Trump personality, it’s verbal discipline.”
In a twist of history, Kasowitz has invoked the same legal argument that attorneys for Clinton did 20 years ago, when he was accused of sexual harassment by Jones — that a sitting president is immune from lawsuits regarding his conduct before he took office.
Bill Clinton eventually lost his battle to shield himself from a lawsuit while in office. In 1997 the Supreme Court ruled he was not immune from a civil suit. His deposition in the Paula Jones lawsuit (everyone remembers Clinton’s parsing of the word “is”) eventually became the grounds for his impeachment, so the potential danger of a case like this is real. That’s especially true when Democrats are already eagerly pushing for impeachment.
Judge Jennifer Schecter hasn’t issued a decision based on today’s hearing yet but if she agrees to let this case go forward, you can count on this becoming the basis of a new round of speculation about President Trump’s imminent downfall.

Trump Sued for Slicing Up National Monuments

WASHINGTON, DC, December 5,2017 (ENS) – President Donald Trump Monday signed proclamations to shrink the boundaries of two national monuments in Utah – Bears Ears National Monument and Grand Staircase-Escalante National Monument. The proclamations result in five distinct monument units within the two monuments.
Conservation groups and native American tribes warn that by shrinking these national monuments, their cultural, paleontological and wilderness resources will be left exposed to oil, gas and coal leasing and development, as well as the location and development of new uranium mining claims. They have gone to court to try and block Trump’s move, saying he has illegally overreached the power of the presidency.
“No one values the splendor of Utah more than the people of Utah – and no one knows better how to use it. Families will hike and hunt on land they have known for generations, and they will preserve it for generations to come.” said President Trump, announcing the shrinking of these monuments in Salt Lake City, Utah.
“The Antiquities Act does not give the Federal Government unlimited power to lock up millions of acres of land and water, and it’s time we ended this abusive practice,” Trump said. “Public lands will once again be for public use.”
But national monuments do not “lock up millions of acres of land and water.” Instead, in all U. S. national monuments, people can go camping and backpacking, hunting and fishing, cycling and horseback riding. They can ride motorized vehicles on designated roads
National monuments protect “existing rights,” meaning, whatever people did there before it was protected as a national monument, they can probably still do after it is designated. This includes previously existing: oil and gas leases, access to private property, valid mining claims, roads and utility infrastructure and livestock grazing.
Bears Ears National Monument, located in San Juan County in southeastern Utah, was established by President Barack Obama by presidential proclamation under the Antiquities Act on December 28,2016.
The monument protected 1,351,849 acres of public land surrounding the Bears Ears, a pair of mesas.
President Trump’s proclamation reduced its size by 85 percent to a total of 201,876 acres divided into two monument units.
The Grand Staircase-Escalante National Monument protected 1,880,461 acres of land in southern Utah, the largest land area of all U. S. National Monuments.
President Bill Clinton designated the area as a national monument in 1996 using his authority under the Antiquities Act.
Trump’s proclamation reduces the monument’s size by almost 50 percent, with the remaining land broken up into three separate areas.
A group of Native American tribes immediately filed suit against President Trump and administration officials, claiming that Trump’s decision to shrink Bears Ears National Monument is “in violation of the United States Constitution and the Antiquities Act of 1906.”
Representatives from the Hopi, Zuni, Ute Mountain Ute, the Navajo Nation and the Ute Indian tribes accused Trump of exceeding “the limited authority delegated to his office,” violating “the Antiquities Act and the separation of powers established in the Constitution” and circumventing the law by “attempting to evade that strict limitation” of his power.
The lawsuit, the first against Trump’s decision to shrink the monument, was filed at the same time that a group of environmental organizations sued Trump and Interior Secretary Ryan Zinke for slashing Utah’s Grand Staircase-Escalante National Monument, attacking the proclamation as an abuse of the president’s authority.
Earthjustice is representing eight organizations in a suit charging that the president violated the 1906 Antiquities Act by stripping monument protections: The Wilderness Society, the Grand Canyon Trust, the Sierra Club, Defenders of Wildlife, Great Old Broads for Wilderness, Center for Biological Diversity, WildEarth Guardians and Western Watersheds Project.
The Southern Utah Wilderness Alliance and Natural Resources Defense Council are co-plaintiffs in the lawsuit and are represented by in-house counsel.
“President Trump has perpetrated a terrible violation of America’s public lands and heritage by going after this dinosaur treasure trove,” said Heidi McIntosh, managing attorney in Earthjustice’s Rocky Mountains office.
“While past presidents have used the Antiquities Act to protect unique lands and cultural sites in America, Trump is instead mangling the law, opening this national monument to coal mining instead of protecting its scientific, historic, and wild heritage,” said McIntosh. “We will not let this stand. We will use the power of the law to stop Trump’s illegal actions.”
The Grand Staircase-Escalante contains dinosaur fossils found nowhere else in the world. Since its designation, 21 new dinosaur species have been unearthed by scientists in the monument, leading some to call these lands a “Dinosaur Shangri-la,” and a “geologic wonderland.”
Grand Staircase holds one of the richest collections of fossils from the Late Cretaceous Period, which gives scientists and the public alike an unparalleled window into the dinosaurs that lived in these lands 10 million years ago.
In mid-October, scientists airlifted one of the most complete tyrannosaur skeletons ever found out of Grand Staircase. These fossils are found in the Kaiparowits Plateau, where the coal industry has long coveted access for coal mining that would wreak havoc on this dinosaur treasure trove that belongs to the American people.
“I’m a resident of Kanab, and there are a lot of local businesses that are completely dependent on tourism related to Grand Staircase-Escalante,” said Laura Welp of Western Watersheds Project, and a former botanist at Grand Staircase-Escalante National Monument with the Bureau of Land Management.
“The entire staircase of spectacular geological layers, with its world-class fossil resources, deserves to be protected intact from the threat of coal mining and other types of commercial exploitation,” said Welp.
Trump’s executive order to shrink Grand Staircase-Escalante National Monument followed a review conducted by Secretary Zinke.
Over 2.7 million Americans voiced their support for national monuments across the country, and public participation in the comment period was overwhelmingly in favor of keeping these public lands and waters protected just as they are.
“President Trump is attempting an unauthorized remodel of the Grand Staircase, knocking out not only geologic steps but cornerstones of the evolution of species, human history, and our cultural heritage as well,” said Tim Peterson, Utah Wildlands Program Director with the Grand Canyon Trust. “We’ve spent 20 years working to preserve Grand Staircase, and now we’re asking the courts to help us reconstruct what was torn down today.”
“The Trump administration’s effort to sell out our public lands is deeply unpopular and goes against American values,” said Michael Brune, executive director of the Sierra Club. “We will work to ensure our lands and waters remain open to the public and protected for future generations to explore and enjoy.”
“For more than two decades, through Democratic and Republican Administrations alike, we have worked with the BLM, paleontologists, local landowners, ranchers and business owners to ensure the monument’s resources are protected,” said Nada Culver, senior counsel for The Wilderness Society. “This unlawful, short-sighted action by President Trump is an affront to that collaborative work happening and to the benefits the monument provides to research, the local economy, and all Americans.”
“Despite the call for public comments, Trump never cared that we, the public, wanted him to keep his hands off our monuments,” said Chris Krupp, Public Earth Guardian at WildEarth Guardians. “He’s not concerned with those of us that camp, hike, fish and hunt. He’d rather give another handout to oil, gas and coal companies.”
President Bill Clinton protected the lands of Grand Staircase as a national monument on September 18,1996 using the Antiquities Act, a century-old law that has been used by 16 presidents since Theodore Roosevelt to protect some of our nation’s most cherished landscapes and cultural heritage.
Congress enacted the law in 1906, granting presidents the authority to create national monuments on federal lands to protect significant natural, cultural, historic or scientific features. The Antiquities Act does not, however, grant presidents the authority to diminish or rescind the monument designations of their predecessors.
“Grand Staircase is a cradle of biodiversity and losing even an acre would be a crime,” said Taylor McKinnon of the Center for Biological Diversity. “Scientists have identified nearly four dozen new species of butterflies here. We must protect this monument’s wildlife, stunning landscapes and cultural treasures for future generations. Trump and the fossil-fuel industry have picked the wrong battle.”
“If the Trump administration thinks Grand Staircase-Escalante can be sold out without a fight, they’re in for a huge surprise,” said Jamie Rappaport Clark, president and CEO of Defenders of Wildlife and a former director of the U. S. Fish and Wildlife Service. “We’ll be seeing them in court.”

США вимагають від України діяти в рамках закону у справі Саакашвілі.
« Якщо вона (українська влада) затримує, заарештовує когось, то це повинно бути відповідно до законів і норм цієї країни, а також відповідати міжнародним зобов’язанням у сфері прав людини, і ми закликаємо Україну поважати верховенство права », – підкреслила представник Держдепу США.
Нагадаємо, 5 грудня в Києві затримали колишнього президента Грузії, екс-главу Одеської обласної державної адміністрації Міхеїла Саакашвілі в рамках справи про сприяння учасникам злочинних організацій та їх укритті. Однак пізніше прихильникам політика вдалося його звільнити під час транспортування.
Генеральний прокурор України Юрій Луценко заявив, що протягом наступних 24 годин правоохоронці зроблять все можливе, щоб Саакашвілі був доставлений в слідчі органи.
Генеральна прокуратура підозрює, що політичну діяльність Саакашвілі спонсорував український олігарх Сергій Курченко, який разом з іншим оточенням Віктора Януковича втік з України. Гроші мали піти на організацію « акцій непокори » для усунення чинної влади в Україні.

Европейская служба внешних действий во вторник, 5 декабря, распространила заявление за подписью спикера Майи Косьянчич о ситуации в сфере борьбы с коррупцией в Украине.
Документ опубликован на официальном сайте ЕСВД, передает « Европейская правда ».
В заявлении Евросоюз впервые четко занял сторону НАБУ в конфликте между украинскими правоохранительными органами и положил вину за обострение на Генеральную прокуратуру.
« Раскрытие информации о расследовании фактов коррупции со стороны Генеральной прокуратуры существенно ослабляет возможности Национального антикоррупционного бюро проводить эффективные расследования, а также подрывает веру людей в возможность эффективного противодействия коррупции », – заявили в ЕС.
Киев призывают « усилить свои усилия для того, чтобы обеспечить независимость, операционную способность и эффективность антикоррупционных институтов ».
« Работу этих органов надо усиливать, а не подрывать », – подчеркнули в ЕСВД.
Как сообщал « Апостроф », директор НАБУ заявил о повреждении имущества сотрудников НАБУ при проведении у них обысков сотрудниками ГПУ и СБУ.

У цій заяві Євросоюз вперше чітко зайняв сторону НАБУ у конфлікті між українськими правоохоронними органами та поклав вину за загострення на Генеральну прокуратуру.
«Публічне розкриття розслідування фактів корупції з боку Генеральної прокуратури суттєво послаблює можливості Національного антикорупційного бюро проводити ефективні розслідування, а також підриває віру людей у можливість ефективної протидії корупції», – йдеться у заяві речниці ЄСЗД.
В Брюсселі нагадали, що боротьба з корупцією залишається «ключовим елементом розвитку відносин України та ЄС», і наголосили, що від ефективності антикорупційної компоненти залежить успіх всіх інших реформ.
В Євросоюзу закликали українську владу «посилити свої зусилля для того, щоб забезпечити незалежність, операційну спроможність та ефективність антикорупційних інституцій». «Роботу цих органів треба посилювати, на не підривати», – дорікнули в ЄСЗД.
