WASHINGTON—A titanic legal battle looms following House Judiciary Committee Chairman Jerrold Nadler’s (D-N.Y.) March 19 warning that President Donald Trump’s executive privilege claims on the forthcoming report of Special Counsel Robert Mueller were waived “long ago.”
Nadler’s warning came in response to a CNN claim based on unnamed sources that White House lawyers plan to review the report before Attorney General Bill Barr sends it to Congress. The review would be to identify passages to be excised under executive privilege.
Neither Trump nor Barr responded to the CNN report but Nadler issued a flurry of tweets, with the first declaring, “when he finishes his work, Special Counsel Mueller is required to report to the Attorney General, who is required to report to the House and Senate judiciary committees.”
And, Nadler said, “there is no provision in the regulations for White House review, and it would be unacceptable for President Trump—the subject, if not the target of the Special Counsel’s work—to edit the report before it goes public… any claims of executive privilege covering the material in Mueller’s report were waived long ago, when White House officials agreed to cooperate with the Special Counsel investigation.”
Trump told reporters Wednesday on the White House South Lawn “Let it come out.
