COSTA MESA City firefighters could receive their first pay raise in eight years and contribute more toward their retirement under a new agreement between the city and their union.
The City Council voted unanimously Tuesday, Oct. 3 to move forward with the proposed four-year contract with the Costa Mesa Firefighters Association, which would expire on June 30,2021, during the first of two public hearings.
Under the terms of the contract, Firefighters Association members would see a 3 percent increase in base pay beginning the first pay period after its approval and subsequent 3 percent bumps on Jan. 1 and July 1 of next year and on Jan.1,2019.
In addition, all union members would gradually pay an additional 9 percent into their retirement for a total of 14 percent. The contributions would come in 3 percent increases that would coincide with the pay raises.
Calling the agreement “frugal but functional,” Mayor Katrina Foley said the health provisions would benefit the fire employees and that the proposed retirement contributions are higher than that of fire employees in other cities.
The lifetime of the contract is estimated to cost the city $4.9 million.
“This is a fair and reasonable contract,” Foley said. “Should we continue to lose our first responders to other agencies and not have people to protect us?”
Health insurance contributions would increase from $556 to $2,119 each month, according to the proposed contract. Employees who opt out of health coverage or chose to receive lesser benefits would receive a monthly payout of $1,060.
Foley praised the health benefits, citing the Las Vegas mass shooting and the recent Canyon fire as examples of how police and firefighters put their health and lives at risk.
The maximum amount of vacation accrual will be capped at 448 hours and vacation, sick leave will no longer count as hours worked when calculating overtime pay and tuition reimbursement will increase from $1,250 to $1,500 each fiscal year, according to the contract.
Union members who go to school will see an increase in tuition reimbursement from $1,250 to $1,500 annually.
During the public portion of the meeting, some residents said no dollar amount was worth jeopardizing public safety while others voiced concerns over with the city’s pension debt, which is over $360 million.
The pension situation is unsustainable and “will sink us financially,” Councilman Allan Mansoor said.
Councilman Jim Righeimer, a frequent critic of the city’s police and fire unions, had issues with the amount the city contributes toward employee retirement, fire employees’ large compensation packages and the fire union’s tactics during contract negotiations.
He referred to Transparent California, which lists several public safety employees as the top earners in the city.
“The unions have taken our love (for police and fire) and converted it to cash,” he said. “This first thing you learn is when you’re in a hole, you stop digging. To sit there and say they’re out there saving your life and it’s great and there’s no dollar figure to put on it is just not what we should look at.”
In August, the council approved pay raises for upper-level fire employees.
A second reading to adopt the agreement will be held at a later date.

Der Fußball-Bundesligist FC Bayern ist auf der Suche nach einem neuen Trainer angeblich fündig geworden. Wie die Bild berichtet, soll Jupp Heynckes Nachfolger von Carlo Ancelotti werden. Der 72-Jährige soll die Mannschaft demnach bis zum Ende der Saison übernehmen. Auch der Kicker schreibt in seiner Online-Ausgabe, dass Heynckes ein ernsthafter Kandidat als Aushilfstrainer sei.
Es wäre die vierte Amtszeit von Heynckes bei den Münchnern, zuletzt war er dort bis 2013 beschäftigt. In jener Saison gewann er mit dem FC Bayern das Triple aus Deutscher Meisterschaft, Champions League und DFB-Pokal, in Anschluss wurde er von Pep Guardiola abgelöst und verabschiedete sich eigentlich in den Ruhestand.
Der FC Bayern war zunächst nicht für eine Stellungnahme zu erreichen. Der Klub hatte sich in der vergangenen Woche vom Italiener Ancelotti getrennt und Co-Trainer Willy Sagnol interimsweise übernehmen lassen. In den vergangenen Tagen waren vor allem Thomas Tuchel und Julian Nagelsmann als mögliche Trainer genannt worden.
Doch nach Informationen der Bild soll sich die Vereinsführung um Uli Hoeneß und Karl-Heinz Rummenigge wegen der aktuellen sportlichen Situation gegen einen «Bayern-Neuling» entschieden haben. Der FC Bayern hat in der Bundesliga fünf Punkte Rückstand auf Tabellenführer Dortmund und verlor in der Champions League zuletzt 0:3 bei Paris St. Germain.
Heynckes wurde mit dem FC Bayern in seiner ersten Amtszeit zwischen 1987 und 1991 zwei Mal Meister, 2009 übernahm er die Mannschaft übergangsweise für fünf Spiele. Aus der Meistermannschaft von 2013 sind bis heute Spieler wie Manuel Neuer, Jérome Boateng, Thomas Müller, Arjen Robben und Franck Ribéry im Verein aktiv.

Tom Petty's death is under investigation, despite autopsy

Despite a completed autopsy, rocker Tom Petty’s exact cause of death has yet to be determined.
The autopsy was conducted Tuesday, Los Angeles County coroner spokesman Ed Winter told the Associated Press. While no foul play is suspected, Winter says the coroner investigates all deaths where the deceased hadn’t seen a doctor in six months.
Petty, 66, was found unconscious and in cardiac arrest at his Malibu home Sunday. He died at the UCLA Medical Center on Monday evening.
Results of the toxicology screening — to determine whether Petty had any drugs in his system — could take several weeks.
Petty was a longtime smoker. As he told Men’s Journal in 2015, he smoked from the time he was 17, though he had gone down to less than a pack a day.
In June 2010, he was trying to quit, even taking up electric cigarettes, which helped his wife, Dana, quit smoking.
«I’ve cut way down,» he told USA TODAY. «You get vapor and a shot of nicotine, nothing burning.»

– Президент України вважає, що Верховна Рада не повинна брати участь у цьому законотворчому процесі. Процес, коли не депутати стають авторами цього проекту, а закордонні дипломати, якісь експерти – це, як на мене, неправильно. Чому іноземні колеги мали змогу робити правки, але народні обранці не мали такої можливості?
Зараз порушуються терміни регламенту Верховної Ради. Адже дається 14 днів на розгляд альтернативних законопроектів. Президент свідомо порушив цю процедуру та спонукатиме проголосувати за законопроекти. Потрібно раніше було внести ці документи, щоб відбулась здорова дискусія. Бо парламент – місце для дискусій, а не філія Банкової.
– Вчора ми не бачили ні тексту законопроектів, і його положень. Тобто ми так гіпотетично поговорили про якісь фейки, які ширяться в Інтернеті. Мені здається, що це ганебна і непрофесійна політика стосовно депутатів. Коли ж цей законопроект дебютувався в комітеті, було фахове, якісне, прозоре обговорення, коли кожен експерт, журналіст, держслужбовець міг озвучити свою думку. В такому разі про документ чують люди і розуміють прогнозованість влади. А в нас, на жаль, українці очікують якихось підступних дій від влади.
Існує юридична колізія, коли наші війська не можуть застосовуватись у мирний час. Є Римський статут, до якого ми повинні долучитись, та за яким, можливо, у військовослужбовців будуть проблеми. В такому разі треба захистити тих, хто зі зброєю обороняє Україну. Тому в законопроектах йдеться про легалізацію військової місії. Ми повинні були зробити це давно.
– Досвідчені політики говорять, що вся ця стратегія потрібна Петру Порошенку для того, щоб не реінтегрувати Донбас, а отримати ці 2 – 4 мільйони голосів, які йому пообіцяли на виборах. Адже за останніми даними, він не лідирує в рейтингу, його перемагають інші люди. Тому це його стратегічна мета: коли будуть вибори, використати голоси із Донбасу. А намалювати там їх буде легко.

HARRISBURG, Pa. (AP) — Republican Congressman Tim Murphy of Pennsylvania has announced plans to retire at the end of this term — amid tawdry revelations of an extramarital affair.
Murphy, who is in his eighth term, says in a statement Wednesday that he will «take personal time to seek help as my family and I continue to work through our personal difficulties.»
Murphy’s statement comes a day after a local newspaper published text messages indicating that the congressman, who opposes abortion, asked his mistress to get an abortion when he thought she was pregnant. It turned out she wasn’t.
Murphy had recently acknowledged his affair with Shannon Edwards, which became public as a result of her divorce proceedings.
Murphy represents a safe Republican district. He has focused on mental health issues in the House.

Появились главные посылы законопроекта президента Украины Петра Порошенко о Донбассе. Их в среду, 4 октября, опубликовала Страна.
Так, целью закона является освобождение территории Донбасса.
Отмечается, что слово «агрессия» и его производные встречаются в тексте закона 42 раза. В то же время словосочетания «страна-агрессор» в отношении России закон не содержит. Тем не менее, авторы прямо заявляют, что именно РФ осуществляет вооруженную агрессию на территории Украины.
В мотивировочной части к закону заявляется, что Россия оккупировала часть территории Украины.
Границы этих территорий определяет Генеральный штаб Минобороны Украины. По данным СМИ, уже в этом видно перераспределение функций управления этими территориями в сторону военных.
В законе Порошенко непризнанные Луганскую и Донецкую «народные республики» в законе президента официально называют «оккупационной администрацией Российской Федерации».
В тексте закона написано, что Украина гарантирует все права собственности своим гражданам, проживающим на временно оккупированной территории – закон подтверждает права на то, чем люди в Донбассе владели до войны. Одновременно не признавая любых законов и постановлений, принятых сепаратистами.
В случае возвращения Украины на эти территории те, кто купил квартиру или создал бизнес по нормам ЛДНР, однозначно теряют свою собственность.
Отмечается, что в тексте закона речь идет и об Минских соглашениях. Так, статья 7 подтверждает участие в Минских соглашениях. При этом декларируется «приоритетность выполнения безопасности положений Минского протокола».
Как сообщает СМИ, по сути это первый случай, когда в украинском законодательстве упоминаются Минские соглашения.
Важным посылом закона о Донбассе является пункт о руководстве силовиками. Согласно закону, руководить всеми силовиками в зоне конфликта теперь будет армия.
Для этих целей создается Объединенный оперативный штаб Вооруженных Сил Украины. Ему будут подчиняться все остальные ведомства, включая Нацгвардию и Нацполицию (сейчас входят в структуру МВД). Таким образом президент, как главнокомандующий, замкнул на себя полное руководство силовиками в зоне конфликта.
«Объединенный оперативный штаб Вооруженных Сил Украины осуществляет планирование, организацию и контроль выполнения задач по обеспечению национальной безопасности и обороны, сдерживания и отпора российской вооруженной агрессии в Донецкой и Луганской областях, направление, координацию и контроль за деятельностью военно-гражданских или военных администраций (в случае их образования) в Донецкой и Луганской областях по вопросам национальной безопасности и обороны», – говорится в законе.
Согласно закону, без изменений остается специфика поездок из Донбасса и обратно. Как и было раньше, движение людей и товаров – только через КПВВ. По ним решения принимает также глава Объединенного комитета – по согласованию с СБУ и министерством по делам оккупированных территорий.
Таким образом торговля в АТО остается за тремя ведомствами с главенствующей ролью военных.
Также закон о военном положении дополнен пунктом, по которому на территории, где вводится ВП, автоматически прекращаются полномочия всего местного самоуправления – городских, районных и сельских советов. А также областных советов.
Согласно тексту закона, Порошенко хочет продлить действие особого статуса Донбасса ради миротворцев. Об этом говорится в мотивировочной части законопроекта №2 — «Про створення необхідних умов для мирного врегулювання ситуації в окремих районах Донецької та Луганської областей», который президент сегодня внес в Раду.
Согласно тексту закона, продление особого статуса проводится, «создавая необходимые условия для развертывания в отдельных районах Донецкой и Луганской областей миротворческой операции ООН».
Напомним, ранее сообщалось, что в Верховной Раде в среду, 4 октября, зарегистрировали законопроект «Об особенностях государственной политики по обеспечению государственного суверенитета Украины над временно оккупированными территориями в Донецкой и Луганской областях» под номером 7163 .

A man caught carrying numerous weapons including two submachine guns and 900 rounds of ammunition had lost custody of his children and written hostile letters to local judges, authorities said Wednesday.
Washington County Sheriff Ed Graybeal said Scott Edmisten won’t talk, so officials are still trying to determine why he had the weapons, as well as a mask and black fatigues, when he was pulled over for speeding before dawn Monday.
Graybeal said guns and ammunition are common in Tennessee, but that it was «odd» for all the guns and clips to be loaded, and for Edmisten to have 900 more rounds and survival gear. In addition, he said, when people have survival gear with them, they are usually going hunting, but that didn’t seem to be the case. Graybeal said he has asked state and federal agencies to assist in the case since the automatic weapons aren’t registered and lack serial numbers.
«Whatever he had planned for that morning, that little traffic stop that one of my guys made all the difference in the world to someone, I believe,» Graybeal said. «It’s just one of those situations where nothing seemed right and we wanted to make sure that everyone was OK, especially since he’d been sending letters to the courts.»
Edmisten, 43, has been jailed without bond on charges of possessing prohibited weapons, speeding, and felony evading arrest. An attorney listed in court records as representing Edmisten didn’t immediately return a call seeking comment. A bond hearing was set for Oct. 11.
In addition to the guns in the car, authorities found another four rifles in Edmisten’s home Tuesday while executing a search warrant. Graybeal said one had been altered to make it fully automatic. Investigators also found about $6,000 worth of ammunition that hadn’t been opened.
Graybeal said he didn’t know why Edmisten lost custody of his children, but Edmisten made it clear he did not like the Department of Children’s Services or law enforcement.
Michael Knight, a spokesman for the U. S. Bureau of Alcohol, Tobacco, Firearms and Explosives, has confirmed that the agency is investigating and said authorities «don’t see a connection» to recent mass shootings.
Edmisten’s arrest came a day after Stephen Paddock opened fire on a music festival from a high-rise hotel suite in Las Vegas, leaving 59 people dead and more than 500 injured. When police stormed his room, they discovered that Paddock had killed himself.
