'So-called judge' derided by Trump known for fairness, work with youth

NewsHubIn a reaction that went viral on Twitter, Trump called the 69-year-old Robart a « so-called judge » whose « ridiculous » opinion « essentially takes law-enforcement away from our country.  »
To those who know Robart, who has been on the federal bench in Seattle for more than a decade after his appointment by another Republican, President George W. Bush, the ensuing drama surrounding the move was a far cry from the judge’s standard.
« He is relatively apolitical, » said Douglas Adkins, a private equity investor and former investment banker who has known Robart since childhood. « He’s not a conservative or a liberal. He’s a man interested in the law and fairness.  »
Late on Friday, Robart grabbed national headlines with his decision to temporarily lift Trump’s week-old travel ban for citizens of seven mainly Muslim countries and refugees. His ruling was just a first step in considering the merits of the case challenging the ban. The Justice Department on Saturday filed a formal notice that it intends to appeal the ruling.
As a candidate, Trump had criticized federal judge Gonzalo Curiel, who was overseeing a case against his Trump University – arguing Curiel could not be impartial because of his Mexican heritage and Trump’s vow to crack down on Mexican immigrants.
But by lashing out at Robart as president, Trump’s anti-judiciary stance takes on new importance: it hits at the very heart of the checks and balances system meant to protect the country from government abuse of power.
Coincidentally, in his wide-reaching ruling on Friday, Robart emphasized that the three branches of government – the executive branch, Congress and the judiciary – should function as equals.
« The work of the Judiciary, and this court, is limited to ensuring that the actions taken by the other two branches comport with our country’s laws, and more importantly, our constitution, » Robart wrote.
Reached by email, Robart declined to comment on Trump’s tweets.
A graduate of Whitman College in Walla Walla, Washington, and Georgetown University Law Center, Robart spent 30 years in private practice at the law firm now known as Lane Powell, before being appointed to the bench by Bush in 2004.
Adkins said Robart and his wife have no children but have been foster parents to several immigrant children over the years, primarily from Southeast Asia. Robart could not be reached for comment.
The judge served in the past as the president of the Seattle Children’s Home and was a former trustee of the Children’s Home Society of Washington, according to his official biography on the federal court website. Those organizations provide mental health services for at-risk youth and help troubled families.
« His involvement with children may have helped contribute to his understanding of the people impacted by this ruling but would not have shaped his interpretation of the rule of law, » said Paul Lawrence, who was one of the attorneys who filed an amicus brief backing Washington State in the immigration case.
During his confirmation hearing, Robart recalled providing pro-bono legal services early in his career to « people who in many times felt that the legal system was stacked against them.  » He said he learned that the law « could be, if properly used, an opportunity for them to seek redress if they had been wronged, » according to a transcript of the testimony.
Often sporting bow-ties with his black robes, Robart is known for saying from the bench in 2016 that « black lives matter.  » He cited the statement popularized by protesters during a hearing about a 2012 consent decree with the federal government that required the Seattle police department to address allegations of bias and excessive force.
In 2011, Robart put a temporary hold on a state rule change that would have cut government funding for disabled children and families in Washington.
« When faced with a conflict between the financial and budgetary concerns … and the preventable human suffering, » Robart wrote in that opinion, « the balance of hardships tips in the favor of preventing human suffering.  »
Adkins said he thought his friend would be able to take Trump’s attacks in stride.
« His view is that criticism is important, » said Adkins.

Fluglinien reagieren prompt auf Aufhebung der Visa-Sperren

NewsHubDie US-Regierung hat die von Präsident Donald Trump verfügten Visa-Sperren für zehntausende Ausländer am Samstag aufgehoben. Dies teilte ein Sprecher des Außenministeriums in Washington mit. Das Weiße Haus folgte damit der Anweisung eines Bundesrichters.
Richter James Robart hatte am Freitag mit einer einstweiligen Verfügung das erst vor einer Woche von Trump erlassene temporäre Einreiseverbot für Bürgerinnen und Bürgern aus sieben muslimischen Ländern gestoppt. Der Richter widersprach der Argumentation der Regierung, die als Begründung für den Erlass die Anschläge vom 11. September 2001 herangezogen hat.
Seither sei von Bürgern der betroffenen sieben Staaten kein Angriff auf dem Boden der USA verübt worden, erklärte Robart. Damit Trumps Dekret verfassungsgemäß sei, müsse es aber « auf Fakten basieren » und nicht auf Fiktion.
Die US-Regierung kündigte an, dass gegen den Entscheid bei einem Bundesberufungsgericht Widerspruch einlegen werde. US-Rechtsexperten waren über die Erfolgsaussichten des Vorstoßes geteilter Meinung.
Die Entscheidung des Bundesrichters ist ein schwerer Rückschlag für den neuen US-Präsidenten. Trump kritisierte die vorläufige Aussetzung seines Erlasses scharf und attackierte den Richter direkt. Wenn ein Land nicht länger sagen könne, wer, besonders aus Sicherheitsgründen, ein- und ausreisen dürfen – dann habe es ein « großes Problem!  »
Der Gouverneur von Washington, Jay Inslee, bezeichnete das Urteil als « riesigen Sieg ». Zugleich warnte er, die Schlacht für die Annullierung des Dekrets sei noch nicht gewonnen. Der demokratische Minderheitsführer im Senat, Chuck Schumer, forderte Trump auf, sein Dekret endgültig zurückzunehmen.
Die Grenzschutzbehörde reagierte nach Angaben eines Vertreters einer Fluggesellschaft umgehend auf das Urteil. Die Behörde teilte demnach in einer Telefonkonferenz mit Airlines mit, dass USA-Reisende mit gültigen Visa an Bord gehen dürften, auch wenn sie aus den vom Einreisestopp betroffenen Ländern stammten. Die Fluggesellschaften sollten sich so verhalten wie vor Trumps Erlass.
Auch bei Swiss-Flügen fallen die Einschränkungen vorerst wieder weg. Derzeit seien auf den Swiss-Flügen in die USA wieder alle Passagiere mit gültigen Reisedokumenten flugberechtigt, teilte die Fluggesellschaft am Samstagmorgen mit.
Als erste Fluggesellschaft hatte Qatar Airways angekündigt, wieder Staatsbürger aus Syrien, dem Iran, Irak, Libyen, Somalia, dem Sudan und dem Jemen mit gültigen Visa in die USA zu fliegen. Etihad, Emirates, Air France, Lufthansa und Iberia schlossen sich an.
Auch der Fahrdienst-Anbieter Uber, einer der schärfsten Kritiker des Einreiseverbots aus der US-Wirtschaft, reagierte umgehend auf die Neuregelung.
Sein Unternehmen kaufe gerade einen ganzen Haufen Flugtickets, um die in ihren Heimatländern gestrandeten Fahrer und deren Familien mit Wohnsitz in den USA so schnell wie möglich zurückzuholen, twitterte Uber-Chef Travis Kalanick. Uber beschäftigt viele Fahrer aus den betroffenen Ländern.
Trump hatte vor einer Woche per Dekret die Einreise von Bürgern der sieben muslimischen Länder für 90 Tage gestoppt. Flüchtlingen aus aller Welt ist zudem die Einreise für 120 Tage untersagt, syrischen Flüchtlingen sogar auf unbestimmte Zeit.
Trump stößt nach einer ganzen Reihe umstrittener Erlasse bei einer Mehrheit seiner Landsleute auf Ablehnung. Zwei Wochen nach seiner Amtsübernahme erhielt er die schlechtesten Umfragewerte, die je bei einem US-Präsidenten zu diesem Zeitpunkt der Amtszeit gemessen wurden: In der am Freitag veröffentlichten CNN-Umfrage kommt Trump derzeit auf eine Zustimmung zu seiner Amtsführung von 44 Prozent.

NFL: Tomlinson and Warner headline seven-man Hall of Fame class

NewsHubKurt Warner, a quarterback who led the St. Louis Rams to a Super Bowl title and won two NFL most-valuable-player awards, and LaDainian Tomlinson , a record-setting running back for the San Diego Chargers who won an NFL MVP award, were voted into the Pro Football Hall of Fame on Saturday.
Warner and Tomlinson are part of a seven-member Hall-of-Fame class that also includes kicker Morten Andersen, running back Terrell Davis, safety Kenny Easley, Dallas Cowboys owner Jerry Jones and defensive end Jason Taylor.
Warner played for the Rams, New York Giants and Arizona Cardinals during a 12-year career. He was the most valuable player of Super Bowl XXXIV, a 23-16 Rams’ victory over Tennessee.
He also led the Rams to Super Bowl XXXVI in the 2001 season, and the Cardinals to Super Bowl XLIII in the 2008 season.
“I just want to say thanks to all the Rams fans,” Warner said in a video posted to Twitter. “Rams fans in St. Louis, in L. A. You guys have supported me unconditionally for so many years, even when I wasn’t playing for the Rams.
“You guys have meant so much to me and my family and my career. Can’t say thanks enough, and I’m happy to represent you all in the hall of fame.”
Warner played in college at Northern Iowa. The Green Bay Packers signed him as an undrafted free agent in 1994 but Warner did not make the team. He worked in a grocery store and played in the Arena Football League before the Rams signed him in 1998.
He became the starter after Trent Green suffered a knee injury during the 1999 exhibition season and was the triggerman for teams known as “The Greatest Show on Turf.” He was also a Hall of Fame finalist in 2015 and 2016.
“Kurt Warner will always be remembered as one of the NFL’s most outstanding quarterbacks,” Rams owner Stan Kroenke said in a statement. “His journey from working the aisles of a grocery store to winning two NFL MVP awards serves as a reminder to never stop pursing your dreams.
“The Rams enjoyed an incredible run, which included our first Super Bowl title, in large part to his leadership and toughness. Off the field, he and his wife, Brenda, devoted their lives to serving others, and thousands continue to benefit from their outreach initiatives. For these reasons and many more, we congratulate Kurt and his family on this ultimate honor.”
Tomlinson played nine seasons for the Chargers and two for the New York Jets. He was voted into the Hall of Fame in his first year of eligibility.
Tomlinson played in college at Texas Christian and the fifth pick in the 2001 draft. He rushed for more than 1,000 yards in each of his first eight seasons.
In 2006, Tomlinson rushed for a career-best 1,815 yards and 28 touchdowns and was the league MVP. He repeated as the NFL’s rushing leader in 2007, running for 1,474 yards and 15 touchdowns.
He finished with 13,864 yards rushing and 145 touchdowns.
“I couldn’t be happier for LT, his family and all Chargers fans who witnessed his amazing career,” Chargers owner Dean Spanos said in a statement on the team’s website. “Obviously I had the pleasure of knowing LT and seeing him grow into one of the greatest running backs ever to the play the game.
“It was never a doubt in my mind that he would be a first-ballot Hall of Famer. This is the pinnacle for every NFL career, and I’m so excited for him, LaTorsha and their entire family. We are unbelievably proud and honored that LT earned this highest recognition as a member of the Chargers family.”
Matt Ryan and the Dallas Cowboys were big winners Saturday night.
The Atlanta Falcons quarterback was voted the Associated Press 2016 NFL’s most valuable player and top offensive player. Cowboys quarterback Dak Prescott took offensive rookie of the year and Jason Garrett was selected coach of the year by a nationwide panel of 50 media members who regularly cover the league.
On the eve of the Super Bowl in which he will face off with two-time league MVP Tom Brady, who finished second in this year’s balloting, Ryan easily outdistanced Brady, 25-10, for MVP. He beat Green Bay quarterback Aaron Rodgers 15 1/2 to 11 for Offensive Player of the Year.
Ryan, of course, was not on hand at the “NFL Honors” TV show.
Garrett drew 25 votes for best coach, beating out New England’s Bill Belichick (14).

That’s an uptick on the low end from a year ago, when Denver played Carolina, and the tickets ranged from $1,040 to $23,913. However, the average ticket price for this year’s marquee game is down 15% overall from Super Bowl 50.

BMW recalls 230,000 U. S. vehicles over potential air-bag issues

NewsHubBERLIN—BMW AG is recalling more than 230,000 vehicles in the U. S. due to potentially dysfunctional air-bag inflaters produced by troubled Japanese manufacturer Takata Corp.
The recalls affect some BMW 3-series cars produced between 2000 and 2002, 5-series cars produced from 2001 to 2002, and sport-utility vehicles made between 2001 and 2003, according to a safety recall report from the U. S. National Highway Traffic Safety Administration.
Takata is facing financial pressure after millions of its rupture-prone air bags were recalled around the world. The air bags can explode and spray shrapnel. The problem has been linked to 11 deaths and roughly 180 injuries in the U. S., according to federal regulators.

Washington – US President Donald Trump lashed out on Saturday at a court ruling suspending his controversial ban on travellers from seven Muslim countries, dismissing it as « ridiculous » and vowing to get it overturned.
The order blocking the ban, issued late on Friday by Seattle US District Judge James Robart, is valid across the United States, pending a full review of a complaint filed by Washington state’s attorney general.
The travel restrictions, which went into effect a week ago, have wreaked havoc at airports across America, sparked numerous protests and left countless people hoping to reach the United States in limbo.

« The opinion of this so-called judge, which essentially takes law-enforcement away from our country, is ridiculous and will be overturned!  » Trump wrote in a flurry of early morning tweets.
« When a country is no longer able to say who can, and who cannot, come in & out, especially for reasons of safety &.security – big trouble!  » Trump wrote, less than 12 hours after the ruling was issued in Seattle.
« Interesting that certain Middle-Eastern countries agree with the ban. They know if certain people are allowed in, it’s death & destruction!  » said Trump, who was in Florida for the weekend.
The White House said in a statement late on Friday that the Department of Justice would fight the court to defend the travel ban, « which we believe is lawful and appropriate.
« The president’s order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people, » said the statement from White House spokesperson Sean Spicer.
Trump’s executive order blocks citizens of Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entry into the US for 90 days.
Syrian refugees are barred indefinitely and refugees from other countries are barred from entry for 120 days.
Targeted countries
Friday’s ruling by the federal court in Seattle was not the first to challenge the travel ban, but it was the most sweeping as it effectively vacated the main tenets of the order.
Washington state’s attorney general, Bob Ferguson, said the order technically means that anyone with a valid visa must be allowed entry into the country by Customs and Border Protection (CBP).
« The constitution prevailed today, » Ferguson said, describing the judge’s decision as historic. « No one is above the law — not even the president.  »
« It is not the loudest voice that prevails in a courtroom, it’s the constitution, » he added, pointing out that Robart was appointed by Republican president George W Bush.
The State Department said on Friday that up to 60 000 people from the seven targeted countries had their visas canceled as a result of the order. A Justice Department attorney, however, told a court hearing in Virginia that about 100 000 visas had been revoked.

Sure, they might have been funny at first, with Ellen Degeneres sharing a hilarious, badly photoshopped image on The Ellen Show Instagram, or Australian author Zoë Foster Blake sharing her less-than-happy, but funny recreation. Things have gone too far.
She might be the « Queen-Bey, » but it’s not necessary to mimic, recreate or parody everything she does.

The point is, things really shouldn’t have escalated to this point.

再建にあたって、大口債権者である自動車メーカーが法的整理を求めていると4日に伝わったが、「自動車メーカーの意向は了知していない」とコメントした。「製品の安定供給を最優先に考えている」として、裁判所が関与しない私的整理をめざす方針を改めて強調。外部専門家委員会を通じて、自動車メーカーら関係者と今後協議するとした。

NewsHub日本学術会議は4日、東京都内で安全保障と学術との関係を巡り、軍事研究を行わないとしてきた過去の声明の取り扱いなどについて議論するシンポジウムを開いた。検討委が1月、中間とりまとめで軍事研究に慎重姿勢を示したことに参加者が相次いで支持を表明。検討委は今回の討論を踏まえ、今春の最終とりまとめを目指す。
約340人が集まった会場ではまず、検討委委員長で法政大教授の杉田敦氏が中間とりまとめの背景を説明。防衛装備庁が2015年から始めた大学などへの研究助成制度について、同庁の介入の度合いが大きく、学問の自由や開かれた場としての大学への影響が懸念されるとした。
続いて意見表明を申し出て講演した科学史、技術戦略、物理学、医学の各分野の4人とメディア代表の1人が中間とりまとめを支持。一方、未来工学研究所政策調査分析センター研究参与の西山淳一氏はミサイル開発の経験から軍民両用研究に理解を求めた。
その後、参加者と検討委委員との公開討論があり、防衛装備庁の研究助成制度について科学史の研究者が「大学も研究室も大学院生も巻き込むことになる。大学は教育する場でもあり、個人がやりたいから、というのは良くない」と意見を述べ、別の大学研究者も「応募しないことが望ましいと明記してほしい」と発言した。

佐賀で殺処分開始 江北の養鶏場6.9万羽

NewsHub佐賀県は4日、同県江北町上小田の養鶏場の鶏から遺伝子検査で、H5型の高病原性鳥インフルエンザウイルスを検出したと発表した。県は家畜伝染病予防法に基づき、この農家が近くで経営する別の農場も含め、飼育する計約6万9000羽の殺処分を始めた。九州農政局や県によると、国内の家畜の感染は今季10例目で、九州では熊本県、宮崎県(2例)に続き4例目。
佐賀県によると、農場の10棟の鶏舎のうち1棟で4日までの3日間で52羽が死に、農家が4日に県西部家畜保健衛生所に通報した。簡易検査した7羽すべてで陽性反応が出て、遺伝子検査で同日夜に高病原性と確定した。
県は、鶏と卵について農場から半径3キロの4農場(飼育数約5万8000羽)で移動を、3~10キロ圏の12農場(9万8000羽)で搬出を制限した。陸上自衛隊に出動を要請し、確定から24時間以内の殺処分、72時間以内の埋却完了を目指す。
佐賀の鶏の飼育数は149農場約460万羽。うちブロイラーは約380万5000羽で全国7位。「みつせ鶏」などのブランド鶏も飼育されている。県内では2015年にも有田町の養鶏場で高病原性鳥インフルエンザが発生した。
10キロ圏の同県多久市の養鶏農家の女性は「ショックです。どの農家も消毒などに気をつけていた中での発生で、人ごとと思えない」と話した。【池田美欧】
