МКС планує відкрити перші справи щодо злочинів РФ в Україні та вимагати ордери на арешт кількох осіб – The New York Times

Щоправда, на це може піти немало часу.
Міжнародний кримінальний суд (МКС) планує відкрити справи про воєнні злочини, скоєні росіянами в Україні з початком повномасштабного вторгнення 24 лютого 2022 року, передає The New York Times. За словами нинішніх та колишніх чиновників, які знають про це рішення, суд вимагатиме ордери на арешт кількох осіб.
Видання підкреслило, що ці справи є першими міжнародними звинуваченнями, висунутими з початку збройного конфлікту та стали наслідком місяців роботи спеціальних слідчих груп. Зокрема, слідчі стверджують, що Росія викрадала українських дітей і підлітків і відправляла їх у російські табори для перевиховання, а також що Кремль навмисно завдавав ударів по цивільній інфраструктурі.
Головний прокурор МКС Карім Хан повинен спочатку представити свої звинувачення колегії суддів досудового провадження. Вони своєю чергою вирішать, чи були дотримані правові стандарти для видачі ордерів на арешт, чи слідчим потрібні додаткові докази.
Щоправда, лишається незрозумілим, кому суд планує пред’явити звинувачення в кожній справі. На прохання підтвердити запити про ордери на арешт, прокуратура відповіла: «Ми публічно не обговорюємо деталі, пов’язані з поточними розслідуваннями».
Деякі сторонні дипломати та експерти зазначили, що можливо МКС висунуть звинувачення президенту РФ Владіміру Путіну. Адже суд не визнає імунітет для глави держави у справах, пов’язаних із воєнними злочинами, злочинами проти людства чи геноцидом.
Проте, як пише NYT, ймовірність судового розгляду залишається малою. Адже за словами експертів, суд не може розглядати справи заочно, а Росія навряд чи видасть власних чиновників. Кремль продовжує заперечувати свою провину у воєнних злочинах, але міжнародні та українські слідчі зібрали вагомі докази низки звірств з перших днів вторгнення.
Перша справа, як повідомили офіційні особи, пов’язаний із широко розповсюдженим викраденням українських дітей, від малюків до підлітків. У рамках спонсорованої Кремлем програми їх вивозили з України та розміщували в будинках, щоб вони стали громадянами РФ, або відправляли в літні табори для перевиховання. Деякі з дітей приїхали з дитячих будинків чи групових будинків.
Головний прокурор МКС Хан публічно заявив про свої наміри продовжити цю справу. Він підкреслив, що незаконне переміщення дітей до Росії або на окуповані частини України є пріоритетом для його слідчих.
У звіті, опублікованому в лютому Єльським університетом і програмою Conflict Observatory Державного департаменту США, йдеться, що щонайменше 6000 дітей з України утримуються в 43 таборах Росії. При цьому фактична кількість вважається більшою. У Національному інформаційному бюро уряду України повідомили, що станом на початок березня це може бути понад 16 тисяч.
«Цьому питанню приділялася велика увага, і розгляд його як злочину спричинить велику реакцію. Примусово переправляти цивільних через кордон заборонено, а під час конфлікту це може бути воєнним злочином. Це також може вважатися злочином проти людства, якщо воно є частиною широко поширеної та систематичної політики. Депортація дітей може бути навіть частиною геноцидних намірів», – заявив виконавчий директор Міжнародної асоціації юристів Марк Елліс. 
У другій справі очікується, що головний прокурор МКС розгляне невпинні атаки Росії на цивільну українську інфраструктуру, включаючи водопостачання, газо- та електростанції, які знаходяться далеко від бойових дій і не вважаються законними військовими цілями.
Зокрема, уряд Сполучених Штатів має докази, які проливають світло на рішення Кремля щодо навмисного нападу на життєво важливу цивільну інфраструктуру. Водночас за даними ЗМІ багато хто в адміністрації Джо Байдена, виступає за те, щоб поділитися ними з судом, хоча він не є членом. Але Міністерство оборони блокує поширення розвідувальних даних, оскільки побоюється створення прецеденту, який може відкрити шлях для переслідування американців. За словами офіційних осіб, президент США Джо Байден ще не вирішив, чи схвалювати публікацію матеріалу.
При цьому видання підкреслює, що ордери на арешт підозрюваних у жодній із двох справ не очікуються найближчим часом.
У минулому судді міжнародного суду витрачали кілька місяців на розгляд звинувачень, перш ніж видати ордери на арешт або викликати повісткою. Але, додали в NYT, розруха, яка відбувається в Україні, змушує суд діяти швидко.
Понад 40 країн, які є сторонами суду, звернулися з проханням про його втручання. Сама Україна формально не є членом, але вона надала судову юрисдикцію на своїй території. Український уряд зараз проводить власні судові процеси щодо воєнних злочинів, і безліч інших міжнародних організацій також проводить розслідування. Але над розслідуваннями нависає питання про те, чи які-небудь справи проти Росії коли-небудь дійдуть до суду.
Останніми тижнями група урядів і міжнародних організацій активізувала переговори про необхідність створення окремого міжнародного суду з повноваженнями переслідувати Росію за злочин агресії, над яким МКС не має юрисдикції. Суд може притягнути окремих осіб, навіть лідерів, до відповідальності лише за воєнні злочини, злочини проти людства та геноцид у цьому випадку. Але прихильники нового суду стверджують, що агресія є головним злочином, з якого випливають усі інші. Він ефективний, тому що адресований безпосередньо політичним чи військовим лідерам, які вирішили розпочати війну.
Тим не менш, західні уряди вважають, що МКС відіграє певну роль і має продовжувати роботу. Видача будь-якого ордера на арешт, навіть якщо він не виконується, символічно важливий, тому що він може зробити когось ізгоєм, оскільки ці звинувачення не зникають, кажуть правознавці.
У березні 2023 року Кабмін підтримав створення Офісу Міжнародного кримінального суду в Україні. Головним напрямком роботи Офісу МКС у нашій державі є розслідування справ, які Суд розглядає з початку збройної агресії РФ проти України у 2014 році.
При цьому Україна формуватиме коаліцію на підтримку створення Спеціального міжнародного трибуналу щодо злочинів Росії у нашій державі.

Сразу в нескольких районах Москвы после Нового года началась активная вырубка заповедных парков и лесов. Эти площадки готовят для нужд российского Минобороны, в частности, для размещения систем противовоздушной обороны (ПВО).
Об этом информирует издание The Insider, специализирующееся на журналистских расследованиях.
Оккупанты, в частности, развернули зенитно-ракетные комплексы С-400 на полях Московской сельскохозяйственной академии имени Тимирязева, на севере города. По данным издания, эта площадка стала первой в пределах столицы РФ, где появились комплексы ПВО.
По наблюдениям издания, кроме пусковых установок, там развернута многофункциональная радиолокационная станция (РЛС) 92Н6Е, которая обнаруживает и сопровождает воздушные цели, а также РЛС 96Л6Е для измерения координат самолетов, вертолетов, БПЛА и ракет. Там же находятся и цистерны с топливом.
В местной патрульной службе сообщили журналистам, что системы ПВО там установили “для защиты Москвы”.
Размещать военную технику в этой локации оккупанты начали еще 31 декабря. На месте полей не было сплошного леса, поэтому почву там просто выровняли и залили асфальтом. Поля Тимирязевской академии окружены жилой застройкой: до ближайшего дома всего около 200 метров.
Зенитно-ракетные комплексы С-400 появились и в парке-заповеднике Лосиный остров, на северо-востоке Москвы. Там также развернуты радиолокационные станции и пункт боевого управления.
Расстояние от систем ПВО до жилых многоэтажек составляет около 200 метров. Окна местного жилищного комплекса выходят прямо на военный объект.
К тому же парк относится к особо охраняемой природной территории, поэтому вырубка деревьев там ограничена законом РФ. На запросы местных экоактивистов администрация парка сообщила, что “работы проводятся с целью обеспечения национальной безопасности и обороны РФ”.
По данным издания, настоящая экологическая катастрофа наблюдается в микрорайоне Курьяново на юго-востоке Москвы. Там для военных нужд, “в условиях строжайшей секретности” был вырублен огромный лесной массив на левом берегу Москвы-реки. Уничтожено около 100 га леса в охранной зоне музея-заповедника Коломенское для размещения систем ПВО. Протяженность лесной полосы превышала 2 км.
Там будут расположены 10 площадок, которые займут 55 га. По меньшей мере, на одной из них разместят системы ПВО. По данным The Insider, площадка под нужды Минобороны РФ займет 5 га в южной части бывшей лесополосы. Остальные территории будут занимать “производственные площадки” для разных российских компаний (таких как Гормост, Мослифт, Мосводосток и другие).
– Парадоксально, но самая таинственная стройка в Москве ведется в едва ли не самом обозримом месте — прямо напротив смотровой площадки в Коломенском, где установлена подзорная труба для туристов. Стройка практически не охраняется. Забор и информационный щит расположены только на одном участке в южной части, — пишет издание.
По словам источника The Insider, “есть вероятность того, что на этой территории будет находиться оборонный объект”. При этом российские активисты и экологи подозревают, что власти Москвы решили освоить эту территорию в собственных целях, прикрываясь приказом Минобороны РФ о подготовке инфраструктуры под ПВО.
Издание обращает внимание, что эта локация является охранной зоной объекта культурного наследия федерального значения Ансамбль усадьбы Коломенское, XVI-XVII вв. Там находится церковь Вознесения, которая включена в список памятников всемирного наследия ЮНЕСКО.
Еще одна площадка для установки ПВО появилась в Измайловском лесопарке. Еще в начале января там началась вырубка леса на входе в парк, всего в 500 метрах от метро Измайловская.
Были вырублены десятки лиственниц в возрасте более 50 лет.
Кроме того, системы ПВО появились на крупнейшей (по состоянию на 2013 год) в Европе свалке: полигоне Саларьево в Новой Москве. Отходы туда свозили с 60-х годов. К моменту закрытия свалки в 2007 году там размещалось 15 млн тонн мусора. Впоследствии свалку рекультивировали, накрыв специальным полотном, и засыпали грунтом.
Увидеть военную технику на мусорном полигоне можно из многоэтажек. На свалке россияне установили мобильную РЛС разведки П-18-2 Прима. Установка этой радиолокационной системы означает, что вместе с ней используются ЗРК малого или среднего радиуса действия, такие как Бук или Тор.
Если в спальных районах Москвы появились ЗРК С-400, то в центре россияне поставили несколько зенитных систем Панцирь-С1 среднего радиуса действия, которые можно использовать для защиты от самолетов, вертолетов, крылатых ракет. Такая система ПВО была замечена на здании Минобороны РФ.

Biden forced to bail out a banking system — and his donors — he endangered

President Biden loves to take credit where it isn’t due. His latest? 
“Thanks to the quick action of my administration over the last few days, Americans can have confidence that the banking system is safe,” the prez smugged Monday morning of his administration’s extraordinary move Sunday to make whole the depositors of Silicon Valley Bank, far above FDIC-insured amounts, to head off possible systemic failures.  
First, it’s been less than two days — far too soon to see if the wider danger is over. 
Worse, this “Joe to the rescue” schtick is completely disingenuous. Biden’s dismal economic leadership got us here. 
He dumped trillions into an economy already running hot in 2021. When inflation headed for the stratosphere, the White House first dismissed it as “transitory,” then insanely tried to pin the biggest blame on Russian President Vladimir Putin and greedy corporations for the price hikes punishing everyday Americans. 
The resultant rate hikes as the Federal Reserve moved belatedly and aggressively to tame inflation cratered the value of SVB’s “safe” long-maturity investments; when withdrawals forced premature liquidations, the overextended bank (yes, SVB management shares the blame too) was finished.
Meanwhile, Biden’s Treasury secretary has been busy trying to negotiate a global deal for higher taxes worldwide, while his other financial regulators have focused on pushing social justice priorities (including his energy price-hiking “climate change” agenda) in the corporate world.
One sign of just how skewed priorities have grown: Team Biden is encouraging retirement plan managers to use woke metrics for investments, rather than seeking the best returns. 
And SVB listened. The bank committed some $5 billion to back “sustainable finance and carbon neutral operations” in 2022; one of its risk-management honchos spent her time launching Pride Month celebrations as her employer rushed toward the cliff edge. 
That — and the fact that many of its depositors are tech firms that overwhelmingly give to Dems — accounts for how swiftly Biden moved to aid them. Those are the “small businesses” he vows to protect.  
This bailout will devour a massive piece of the FDIC’s insurance fund; the cost of replenishing it will fall on other banks. And guess who pays then? Average consumers, via hiked service fees. 
Biden (before jetting off to a West Coast fundraiser) demanded that Americans look at these bank failures in the “broader context.” 
Please do: The correct “context” is that this is largely the result of Biden’s preferred economic policies.

The suit was filed by a shareholder named Chandra Vanipenta, but it seeks class-action status for shareholders, naming the bank itself, CEO Greg Becker and CFO Daniel Beck as defendants.

The plaintiff argues the executives failed to disclose how rising interest rates would impact the bank’s business, claiming it was in a “particularly susceptible” position for a bank run after continually issuing reports suggesting the Federal Reserve’s rate hikes over the last year were not cause for concern.

The suit identifies shareholders who acquired SVB stock at any point between June 16, 2021 and Friday as eligible class members, as the 2021 date marked Federal Reserve Chairman Jerome Powell’s first public indication the Fed was planning to raise interest rates in an effort to cool inflation.

Nikki Haley Condemns Biden’s ‘Bailout’ of Failed Silicon Valley Bank

Republican presidential candidate Nikki Haley condemned President Biden on March 13 for what she termed a “bailout” of Silicon Valley Bank, which failed late last week after regulators seized its assets and vowed to repay depositors.
“Joe Biden is pretending this isn’t a bailout. It is,” Haley said following news of the White House’s decision.
“Now depositors at healthy banks are forced to subsidize Silicon Valley Bank’s mismanagement. When the Deposit Insurance Fund runs dry, all bank customers are on the hook. That’s a public bailout.
“Depositors should be paid by selling off Silicon Valley Bank’s assets, not by the public. Taxpayers should not be responsible.”
The government acted late on March 12 to employ emergency steps to enable depositors access to their entire cash, drawing from the Deposit Insurance Fund—a fund sponsored by the banking sector—so that taxpayers will pay no losses, according to the president.
“No losses will be—and … this is an important point—no losses will be borne by the taxpayers. Let me repeat that: No losses will be borne by the taxpayers. Instead, the money will come from the fees that banks pay into the Deposit Insurance Fund,” Biden said on March 13.
Biden has emphasized that the federal government is not bailing out the bank, reiterating Treasury Secretary Janet Yellen’s assurances; the president has emphasized that the U.S. financial system is safe despite the recent concern.
“The bottom line is this: Americans can rest assured that our banking system is safe. Your deposits are safe. Let me also assure you, we will not stop at this. We’ll do whatever is needed,” the president added.
Another presidential contender and biotech businessman, Vivek Ramaswamy stated that IT companies, which SVB mostly supported, assumed they would be bailed out in the same way that Washington did for Lehman Brothers during the 2008 financial crisis.
“I think more regulations are not the answer because that creates more room for crony capitalism,” Ramaswamy told FOX Business.
“I think what we really need here is fostering a culture of greater due diligence by market actors to not have to just rely on the government to do their work for them,” Ramaswamy said.
His remarks come only hours after the Treasury Department, Federal Reserve, and Federal Deposit Insurance Corporation said that all Silicon Valley Bank clients would be safeguarded and able to access their funds in an effort to restore trust in the banking system.
They also announced efforts to protect the bank’s clients and avoid more bank runs.
Depositors at Silicon Valley Bank and Signature Bank, including those whose balances are above the $250,000 insurance limit, will be allowed to retrieve their funds under the arrangement. Depositors at US institutions are generally covered up to $250,000 in FDIC-guaranteed deposits.
Ramaswamy was not in support of the move.
“I think it’s disappointing to see crony capitalism win again in America. We have a $250,000 limit. If you want to change the limit and change the rules, then change the rules. But don’t just wing it after the fact, which is exactly what they do here to save their darlings,” he said.
“And in the future, what this does is encourages more risk-taking at banks. It tells them that the government is going to be there for their depositors in the end anyway.”
The White House did not immediately respond to The Epoch Times’s request for comment.

Про це повідомив голова ХОВА Олександр Прокудін, пише Pravda Gerashchenko. За його словами, дія нової комендантської години – з 13 по 17 березня, заборона перебування на вулиці діятиме з 17:00 до 06:00.

За інформацією Прокудіна, є дані про перебування на території обласного центру диверсійно-розвідувальних груп Росії. Проводяться контрдиверсійні заходи.

Раніше петиція із закликом скоротити комендантську годину в Києві набрала необхідну кількість підписів, але її відхилили.

Також нагадаємо, що у Кривому Розі Дніпропетровської області з 13 грудня комендантська година стала коротшою – починається з 23:00, а не з 22:00.

Российские оккупационные войска в понедельник, 13 марта, нанесли ракетный удар по учебному заведению в Авдеевке Донецкой области, сообщил руководитель ОП Андрей Ермак в Telegram.
„Россияне двумя ракетными ударами обстреляли школу в Авдеевке. Погибла местная жительница“, – говорится в сообщении.
Накануне на донецком направлении враг обстрелял Курахово, а также нанес авиаракетные удары по Ласточкиному и Красногоровке Очеретинской громады. Утром россияне трижды ударили по Авдеевке из артиллерии. В том числе захватчики использовали кассетные боеприпасы. Также нанесли авиаракетный удар по территории Авдеевского коксохимического завода.
Всего за сутки оккупанты ранили семь жителей Донецкой области.
Ранее сообщалось, что Россия прислала пополнение боевых сил в Донецкую область.
