‘Worst ever seen’: European leaders view devastated islands
France’s president and the Dutch king visited Caribbean territories on Tuesday that have been hammered by Hurricane Irma, trying to quell accusations by residents that European governments were unprepared, slow to react and sometimes even racist in their responses to the devastation.
French President Emmanuel Macron flew into Guadeloupe and was heading to the hard-hit French-Dutch island of St. Martin to meet with residents. His plane brought water, food, tons of medicine and emergency equipment, doctors and recovery experts to an island demolished by the power of the Category 5 hurricane.
In a news conference in the Pointe-a-Pitre airport, Macron said the government’s “top priority” is to help island residents return to normal life.
“We have put in place one of the biggest air bridges since World War II” to bring emergency aid and rescuers to the islands of St. Martin and St. Barts, he said.
Macron said 11 people were killed in the French side of St. Martin, up from a previous death toll of 10. The government did not release details about the victims. The Dutch prime minister says four people were killed on the Dutch side of the island.
About 1,900 French police and troops are now on the ground to ensure security in St. Martin and power has been restored in about 50 percent of its homes, the French president said.
Residents on the island have spoken of hunger, homelessness, a lack of water and a feeling of abandonment after the hurricane pummeled the region on Wednesday. Some felt the French government spend more efforts rescuing white tourists than black or mixed-race islanders.
French authorities said they gave priority to injured, sick and elderly people.
Macron said 2,000 people have already been evacuated from St. Martin’s French territory and new flights are going to be organized by the end of the week.
Irma left entire islands and tens of thousands of people in the Caribbean without water or electricity and reduced many homes to splinters. The French, British and Dutch governments sent warships, planes and security forces to keep order and deliver aid but some of that aid was slowed down further by Hurricane Jose, which passed north of the region over the weekend.
A medical center was being set up Tuesday in the stadium of Marigot, a port on St. Martin, and a French military ship will provide additional medical facilities in coming days, French Prime Minister Edouard Philippe said.
Dutch King Willem-Alexander arrived on St. Martin on Monday and said the scenes of devastation were the worst he has ever seen. The island is shared between a French territory and the former Dutch colony of St. Maarten, a largely autonomous part of the Dutch kingdom with a population of around 40,000.
“I’ve never experienced anything like this before and I’ve seen a lot of natural disasters in my life. I’ve seen a lot of war zones in my life. but I’ve never seen anything like this, ” Willem-Alexander said on the Dutch national network NOS.
Willem-Alexander said he was encouraged to see residents already working together to rebuild the shattered capital of Philipsburg.
“It’s been very useful to see for myself what terrible damage this storm has done and in this way to also show the population of St. Martin and the governor and prime minister that we stand together here as a kingdom and that we will solve this together, ” he told reporters.
Willem-Alexander was flying Tuesday to the nearby Dutch islands of Saba and St. Eustatius, which also were hit by Irma but suffered less damage than St. Martin.
Meanwhile, British Foreign Secretary Boris Johnson will be visiting the British Virgin Islands and Anguilla to see the relief effort firsthand. He was expected to reach Barbados on Tuesday.
Johnson has defended the British government’s response amid claims it was slow to help the British overseas territories, saying there had been an “unprecedented” effort to deal with the aftermath of the storm. At least five people died in the British territories.
Dutch Foreign Minister Bert Koenders said he believes the European Union should send relief funds to both the French and the Dutch sides of St. Martin, and said he would also appeal to the United Nations to help the islands.
“Everybody should benefit from that money, ” he told reporters after a Cabinet meeting called to discuss the fallout from Irma.

Deutschland hat unter allen Mitgliedsstaaten der Organisation für wirtschaftliche Zusammenarbeit und Entwicklung (OECD) den höchsten Anteil der jungen Hochschulabsolventen in den sogenannten MINT-Studienfächern: 37 Prozent der deutschen Absolventen machen ihren Abschluss in Fächern wie Mathematik, Informatik, Naturwissenschaften und Technik.
Damit steht Deutschland nicht nur besser da als seine europäischen Nachbarländer, sondern auch als andere hoch entwickelte Staaten wie die USA, Japan, Israel oder Australien. Das ergibt die Studie “Bildung auf einen Blick”, die jährlich im Auftrag der OECD die Bildungssysteme in den 34 Mitgliedsstaaten und Parnerländern vergleicht.
Nachholbedarf hat Deutschland laut der Studie allerdings immer noch, was den Frauenanteil bei den “MINT-Fächern” angeht, denn der liegt nur bei 28 Prozent. In Deutschland sei ein stärkerer Einfluss des Geschlechts auf die Wahl des Studienfachs zu beobachten als in anderen OECD-Ländern, kritisiert die Studie. Der Durchschnitt liege OECD-weit bei 30 Prozent.
Dieses Manko sieht auch Bundesbildungsministerin Johanna Wanka. Deutschland dürfe und könne nicht auf das Potenzial der jungen Frauen verzichten, sagte sie bei der Vorstellung des OECD-Berichts. “Insbesondere in der beruflichen Bildung müssen wir die Möglichkeiten technischer Berufe jungen Frauen näher bringen”.
Dieses Näherbringen könne aber nicht auf die Zeit der Berufswahl beschränkt bleiben, sagt Corinna Bath, Professorin für Gender und Technik an der TU Braunschweig. Studien zeigten eindeutig, dass Mädchen und Jungen zunächst gleiches Interesse und Fähigkeiten an und in den MINT-Fächern hätten. “Doch sobald die Geschlechterollen in der Pubertät immer wichtiger werden, orientieren sich Mädchen mehr in Richtung Geisteswissenschaften und Sprachen und Jungs in Richtung Naturwissenschaft und Technik”, so Bath im Gespräch mit tagesschau.de. Das Umdenken müsse also schon in der Familie und in den Schulen passieren.
Oft zeigten junge Frauen auch kein Interesse an MINT-Fächern, weil sie ein falsches Bild von dem Beruf haben, der dahinter steht, sagt Barth. Der Stereotyp bei Informatikern sei zu Beispiel, dass sie den ganzen Tag hinter dem Bildschirm sitzen und wenig mit Menschen zu tun haben. Kommunikationsfreudige Frauen hätten darauf keine Lust. Dabei sei gerade die Softwareentwicklung viel mit Kundenkontakt und Teamarbeit verbunden, so die gelernte Informatikerin Bath. Das müsse bei der Berufswahl stärker vermittelt werden.
Doch der Frauenanteil in den MINT-Fächer scheint nur ein Dauerproblem zu sein, das Deutschland schlecht in den Begriff bekommt. Auch bei der Durchlässigkeit des Bildungssystems zwischen den sozialen Schichten hapert es laut der OECD-Studie weiterhin. Noch immer gilt: Kinder aus Arbeiterfamilien studieren selten. Der Anteil der Hochschulabsolventen, deren Eltern nicht über einen Hochschulabschluss verfügen, habe sich in Deutschland – anders als im OECD-Durchschnitt – über die Generationen nicht verbessert, stellt der Bericht fest. Bei den 45-59-Jährigen sei er genauso groß wie bei den 30-44-Jährigen – und das, obwohl Bildung in Deutschland zum Großteil staatlich finanziert ist.
Die Zahlen seien aber nicht nur negativ zu deuten, heißt es in der Studie. Die niedrige Mobilität zwischen den Schichten sei zum Teil auch auf das erfolgreiche deutsche Berufsbildungssystem zurückzuführen, das eine solide Alternative zum Studium böte. Bildungsministerin Wanka kündigte an, dass die Bundesregierung die berufliche Bildung weiter modernisieren werde. Diese schaffe ebenso wie die akademische Bildung verlässlich individuelle Chancen und Lebensperspektiven.
Die Zahl der Schüler in Deutschland ist aufgrund des demographischen Wandels zurückgegangen, um sechs Prozent zwischen 2010 und 2014. Die Bildungsausgaben in Deutschland spiegeln das laut der Studie aber nicht wider. Sie sind im gleichen Zeitraum nur um zwei Prozent gesunken.
In den Hochschulen ist das Bild umgekehrt. Die Zahl der Studienanfänger in Deutschland ist gestiegen, zwischen 2010 und 2014 um 23 Prozent. Das sei der höchste Anstieg in allen verglichenen Ländern, heißt es in der Studie. Die Ausgaben für den Hochschulbereich haben damit allerdings nicht Schritt gehalten. Sie stiegen im gleichen Zeitraum nur um neun Prozent.
Gute Nachrichten gibt es aus dem Bereich der Lehrerschaft. Laut der Studie werden Lehrer in Deutschland im Gegensatz zu vielen anderen OECD-Ländern wettbewerbsfähig bezahlt. 2015 verdienten Lehrkräfte im Sekundarbereich I in etwa genauso viel wie andere Beschäftigte mit Hochschulabschluss, im Sekundarbereich II sogar teilweise mehr. Eine Ausnahme sind allerdings die Grundschullehrer. Sie verdienten sechs Prozent weniger als andere Beschäftigte mit vergleichbarem Bildungsabschluss. Dadurch werde die Wettbewerbsfähigkeit des Lehrerberufs auf dieser Stufe verringert.
Insgesamt hat sich die Lehrerschaft in Deutschland leicht verjüngt. In den vergangenen zehn Jahren ist der Anteil der Lehrkräfte, die mindestens 50 Jahre alt sind, im Primar- sowie im Sekundarbereich I und II um jeweils sieben Prozentpunkte gesunken. Dennoch sind die Lehrer im OECD-Vergleich nur in Italien älter als in Deutschland.

Reaktionen auf den Tod Heiner Geißlers: "Brillant, streitbar und selbstbewusst"

Der CDU-Politiker Heiner Geißler ist im Alter von 87 Jahren gestorben. Er genoss über Parteigrenzen hinweg ein hohes Ansehen. Hier eine Auswahl von Reaktionen auf seinen Tod.
Kanzlerin und CDU-Chefin Angela Merkel hat den gestorbenen Ex-CDU-Generalsekretär Heiner Geißler als einen der markantesten Köpfe der Christdemokraten gewürdigt. Geißler sei “intellektuell herausragend, rhetorisch brillant, streitbar und selbstbewusst” gewesen, erklärte Merkel. Geißler habe der CDU von 1977 bis 1989 als Generalsekretär gedient, so lange wie niemand vor und nach ihm.
Geißler “war maßgeblich und mit großem Erfolg daran beteiligt, aus der Honorationenpartei CDU eine echte Mitglieder- und Programmpartei zu machen”, schrieb Merkel. So sei in seiner Amtszeit das erste Grundsatzprogramm “Freiheit, Solidarität, Gerechtigkeit” beschlossen worden. Auch die eigene Partei habe er nicht mit offenen Worten geschont, wenn er dies für nötig gehalten habe, beispielsweise bei der Durchsetzung der neuen Frauenpolitik der CDU. “Dieses Rückgrat, diese politische Unabhängigkeit bewahrte er sich stets.” Auch deshalb habe Geißler über alle Parteigrenzen und politischen Lager hinweg höchste Anerkennung, Vertrauen und Respekt genossen.
Unions-Fraktionschef Volker Kauder (CDU) hat den gestorbenen Ex-CDU-Generalsekretär als Ausnahmepolitiker mit Weitblick, Scharfsinn und Redegewandheit gewürdigt. “Er war ein Modernisierer und Brückenbauer”, erklärte Kauder. Geißler habe die CDU und die Unionsfraktion “über Jahrzehnte geprägt wie nur wenige andere Politiker”.
“Heiner Geißler dachte und handelte eigenständig, eckte an und war offen für die Diskussion über Parteigrenzen hinweg”, schrieb Kauder. Auch nach dem Ausscheiden aus den politischen Ämtern sei Geißler den Christdemokraten wichtiger Wegweiser geblieben. “Er erinnerte uns immer wieder daran, dem ‘C’ als unserem Wertekompass die gebührende Beachtung zu schenken.” Er habe zudem gezeigt, wie der Glaube Richtschnur für die Politik sein könne.
CSU-Landesgruppenchefin Gerda Hasselfeldt nannte Geißler einen “engagierten, klugen und manchmal auch unbequemen Politiker”, der stets für ein hohes Ethos und christliche Werte wie die Nächstenliebe gestanden habe.
Kanzleramtschef Peter Altmaier (CDU) schrieb: “Heiner Geißler hat die CDU geprägt: Soziale & ökologische Verantwortung, Menschlichkeit. Ich bin tief erschüttert. Sein Vermächtnis bleibt.”
Der nordrhein-westfälische Ministerpräsident Armin Laschet (CDU) bezeichnete Geißler als “intellektuell brillant”. Er sei einer „unserer Besten“ gewesen.
Bundespräsident Frank-Walter Steinmeier hat den verstorbenen CDU-Politiker Heiner Geißler als Vorbild gewürdigt. Das Land verliere “eine unvergleichliche politische Persönlichkeit, die bis ins hohe Alter gerade auch für junge Menschen Vorbild war”, heißt es in einem Kondolenzschreiben Steinmeiers an die Witwe des Verstorbenen.
Geißler habe über Jahrzehnte das Land mitgeprägt, erklärte Steinmeier. “Er war mit einer Leidenschaft Politiker und mit einer Hingabe Mitgestalter unseres Gemeinwesens, die selten zu finden waren und sind”, schreibt das Staatsoberhaupt. Er hob Geißlers christliche Überzeugung hervor, die dessen Reden und Handeln geprägt habe.
“Dass er im demokratischen Streit gelegentlich seine polemische Begabung einzusetzen wusste, hat ihm Ärger eingebracht, aber letztlich oft zur Klärung politischer Fragen beigetragen”, schrieb der Bundespräsident weiter.
SPD-Chef und Kanzlerkandidat Martin Schulz schrieb: “Mit Heiner Geißler verliert Deutschland eine einzigartige politische Persönlichkeit, einen streitbaren Geist und klugen Analytiker der Bonner und der Berliner Republik.” Geißler habe “die bundesrepublikanische Demokratie mitgeprägt.”
“Heiner Geißler war freundlich und liebenswürdig im Wesen und unbequem und häufig unkonventionell in seiner politischen Haltung. Wir werden ihm, der viele Jahrzehnte die politische Bühne geprägt hat, ein ehrendes Andenken bewahren”, schrieb Schulz weiter.
Außenminister Sigmar Gabriel (SPD) würdigte Geißler: “Er war für seine Partei und für viele Bürger unseres Landes eine prägende politische Gestalt der ersten Jahrzehnte der Bundesrepublik. An der Auseinandersetzung mit seiner pointierten Sicht auf die Linke und die Sozialdemokratie ist die Diskussionskultur Deutschlands gewachsen.”
Bundesfamilienministerin Katarina Barley (SPD) würdigte ihren Vorgänger im Amt als streitbaren Sozialpolitiker, “dem der soziale Ausgleich in unserem Land immer ein Herzensanliegen war”. Barley weiter: “Heiner Geißler hat sich um die Familien in unserem Land verdient gemacht. Meine Gedanken sind bei seiner Familie und seinen Freunden.”
Die Grünen würdigten Geißler als einen Gesinnungsgenossen. Mit den Jahren sei Geißler den Grünen immer näher gekommen, erklärten die Spitzenkandidaten Katrin Göring-Eckardt und Cem Özdemir. Als Mitglied des globalisierungskritischen Netzwerks Attac habe der frühere CDU-Generalsekretär den Marktradikalismus kritisiert und sich für ökologische Belange eingesetzt.
Die Grünen-Spitzenkandidaten erinnerten aber auch daran, dass sie es nicht immer leicht mit Geißler hatten. “Seine scharfe Kritik an der Friedensbewegung ist uns noch in Erinnerung”, betonten Göring-Eckardt und Özdemir. Sie nannten Geißler einen „echten Freigeist“ und einen „klugen Demokraten“, der die Politik über Jahrzehnte geprägt habe.
Baden-Württembergs Ministerpräsident Winfried Kretschmann (Grüne) erinnerte an Geißlers Schlichtung im Streit um das Bahnprojekt Stuttgart 21. “Mit seiner Vermittlerrolle in Konflikten wie bei S21 hat er mit die Grundlage für unsere Politik des Gehörtwerdens gelegt”, betonte Kretschmann.
Oskar Lafontaine hat den Verstorbenen als einen der “profiliertesten Politiker der deutschen Nachkriegszeit” gewürdigt. Geißler habe sich “Zeit seines Lebens der christlichen Soziallehre verpflichtet gefühlt”, sagte der Linken-Politiker und einstige SPD-Chef. “Wie kaum ein anderer kritisierte er die Fehlentwicklungen des globalen Kapitalismus. You may be understandably skeptical about apps that claim to replicate artistic styles, and it makes sense – the ‘drawing’ and ‘painting’ filters included in many photo editors are downright terrible. Prisma is the exception though and, once you’ ve tried it, we think you’ ll be convinced.
Although additional filters are available as in-app purchases, there’s a very generous selection included free of charge.
You can share your creations on a special Prisma feed, which works in a similar way to Instagram, save it to your device, send it via messaging or email, or share it on any social media app.
Even if you decide to keep the results to yourself, Prisma is great fun to play around with, and the results are very impressive.

VSCO is kind of like a more advanced version of Instagram, it has a community feature that lets you follow other VSCO photographers. You can search for contacts and Facebook friends to follow, but since it’s a relatively niche app, you might not know many other users.
VSCO offers all of the tools that you’ d expect from a high quality Android photo editing app, including exposure, contrast and temperature correction, as well as a very useful alignment tool for straightening horizons. There are also fade settings, and tools for skewing your image and adjusting tints.
The selection of ambient filters isn’ t huge, but the ones provided are very atmospheric and are adjustable via a simple slider.
Once you’ re done, you can share your image with VSCO’s community, send it straight to Facebook, or share it via any social networking or messaging app.
The only disadvantage is that you can’ t simply save it to your device; instead, you have to email it to yourself or save it to a cloud storage service.

A lawsuit over who owns the copyright to selfie photographs taken by a monkey was settled before a federal appeals court could answer the novel legal question.
SAN FRANCISCO — Attorneys announced a settlement Monday in a lawsuit over who owns the copyright to selfie photographs taken by a monkey before a federal appeals court could answer the novel legal question.
Under the deal, the photographer whose camera was used to take the photos agreed to donate 25% of any future revenue from the images to charities dedicated to protecting crested macaques in Indonesia, lawyers for an animal-rights group said.
Attorneys for the group and the photographer, David Slater, asked the San Francisco-based 9th U. S. Circuit Court of Appeals to dismiss the case and throw out a lower court decision that said animals cannot own copyrights.
Andrew J. Dhuey, an attorney for Slater, declined to comment on how much money the photos have generated or whether Slater would keep all of the remaining 75% of future revenue.
There was no immediate ruling from the 9th Circuit.
The People for the Ethical Treatment of Animals sued on behalf of the macaque monkey in 2015, seeking financial control of the photographs for the benefit of the monkey named Naruto that snapped the photos with Slater’s camera.
“PETA and David Slater agree that this case raises important, cutting-edge issues about expanding legal rights for non-human animals, a goal that they both support, and they will continue their respective work to achieve this goal, ” Slater and PETA said in a joint statement.
Lawyers for Slater argued that his company, Wildlife Personalities Ltd., owns worldwide commercial rights to the photos, including a now-famous selfie of the monkey’s toothy grin.
The photos were taken during a 2011 trip to Sulawesi, Indonesia, with an unattended camera owned by Slater.
U. S. District Judge William Orrick said in a ruling in favor of Slater last year that “while Congress and the president can extend the protection of law to animals as well as humans, there is no indication that they did so in the Copyright Act.” The 9th Circuit was considering PETA’s appeal.
The lawyers notified the appeals court on Aug. 4 that they were nearing a settlement and asked the judges not to rule. A three-judge panel of the 9th Circuit heard oral arguments in the case in July. Associated Press writer Paul Elias in San Francisco contributed to this report.

London — British engineers say they have launched a “sewer war” against a giant fat blob clogging London’s sewers.
Thames Water officials said Tuesday it is likely to take three weeks to dissolve the outsize fatberg.
They caution against expecting quick results as the fatberg is 250 yards long and weighs as much as 11 double-decker buses.
The unsavory blob consists of congealed wet wipes, diapers, fat and oil.
Thames Water’s Matt Rimmer says the fatberg is “a total monster and taking a lot of manpower and machinery to remove as it’s set hard.”
He said the task is “basically like trying to break up concrete.”
Eight workers are using high powered jet hoses to break up the blob before sucking it out into tankers for disposal at a recycling site.

North Korea boasts it has conducted a sixth underground nuclear test

North Korea on Sunday confirmed that it has conducted its sixth underground nuclear test — the detonation of a hydrogen bomb of “unprecedented power” designed to be transported by an intercontinental ballistic missile.
The latest brash move threatens to heighten an already tense situation on the Korean Peninsula and raises new questions about how the Trump administration will respond to Pyongyang’s latest provocation.
In just over a week, North Korea has test launched at least four ballistic missiles — including one that flew over Japan, causing serious alarm on the island — and boasted about creating a warhead that could, in theory, be used against the United States.
North Korean officials released a statement a few hours after the launch confirming that they had successfully completed testing of major portions of their ideal nuclear system — a missile that, in theory, could reach the United States.
“Today’s event was meaningful, for we’ ve reached our goal of completion of national nuclear power, ” said an announcement read on North Korean state television.
The statement said the test marked a “significant occasion in attaining the final goal of completing the state nuclear force.”
In a Sunday morning tweet, President Trump called North Korea a “rogue nation” and a threat to the United States.
“North Korea has conducted a major Nuclear Test, ” said the tweet. “Their words and actions continue to be very hostile and dangerous to the United States.”
Tremors from the blasts could be felt in Yanji, a Chinese city of 650,000 on the North Korean border, according to China’s official New China News Agency. The agency tweeted a short video of a crystal chandelier, its hanging crystals swinging.
China’s online social networks lit up with news of the tests; a post by China’s earthquake-monitoring authorities announcing the seismic activity garnered nearly 23,000 “likes” and 17,000 comments.
China’s ministry of foreign affairs expressed “resolute opposition” and “intense condemnation” to the latest test.
“Realizing a nuclear-free Korean peninsula and safeguarding systems of nuclear nonproliferation and peace and stability in [China’s] northeast is the firm position of the Chinese side, and the common will of the international community, ” the ministry said in a statement.
Others in China expressed concern about possible radiation from the powerful blast.
“What I really care about is the safety of the northeastern provinces, ” posted Hu Xijin, editor in chief of the Global Times, a state-run tabloid. “I believe that the country’s emergency response authorities have already moved on this. If there was indeed a nuclear test, I’m most concerned by whether there was a radiation leak, and I believe the government feels the same.”
U. S. and South Korean officials say the detonation caused an unnatural seismic tremor detected by sensors, a tell-tale sign of a nuclear test. Initially, U. S. and Korean officials believed the blast to have occurred in a village in northeastern North Korea known as Punggye-ri — a site closely watched by international nuclear experts.
North Korean state television later confirmed the test occurred at Punggye-ri. The country’s five previous tests, including two last year, also occurred there.
The magnitude of the nuclear test, North Korea’s first since last September, was estimated at 5.6, according to South Korean officials. Other reports put the magnitude at 6.3. The seismic wave occurred about 12: 30 p.m.
The latest experiment — a clear violation of international resolutions, though not unexpected by United States officials — raises new concerns that North Korea continues to advance as a nuclear state, despite years of effort by the international community to curb its atomic program.
The detonation was felt just hours after North Korea boasted that a hydrogen bomb had been mounted on a new intercontinental ballistic missile and that leader Kim Jong Un had inspected the device.
North Korea, one of the world’s most isolated and unpredictable states, appears to be violating global norms with increased impunity.
In August, President Trump was blunt in his warning about the nuclear program.
“North Korea best not make any more threats to the United States, ” Trump told reporters. “They will be met with fire and fury like the world has never seen.”
Later, he said that North Koreans “better get their act together or they’ re going to be in trouble like few nations ever have been in trouble in this world.”
The rogue state is still technically at war with South Korea, a United States ally that has roughly 28,000 American forces stationed on bases, largely within a few hundred miles of the shared Korean border.
Provocations in recent years, under dynastic young ruler Kim, have included numerous ballistic missile tests; the lengthy prison sentence given to an American tourist, who later died after being released; and a land mine incident along the border in 2015 that severely injured two South Korean soldiers.
The test is the latest provocation by the North, which in April paraded a massive battery of military hardware before the world in a recent celebration — including, perhaps, long-range devices capable of striking targets outside Asia.
In July the country test launched what the international community now believes were intercontinental ballistic missiles — devices in theory capable of reaching the United States.
“I’ m not shocked by what North Koreans have done in the last few days at all, ” said Harry Kazianis, director of defense studies at the Center for the National Interest. “The North Koreans over the last few months have really ramped up their testing schedule, with their missiles. So a nuclear test was going to happen.”
Kazianis added that “we shouldn’ t be shocked anymore. They’ ve been working toward nuclear weapons. This has been their goal. It’s something they’ ve stated for years.”
North Korea, which security experts say could have more than a dozen nuclear devices, first conducted an underground test in 2006. The tests’ power has increased over time, and last year state media reported advances in the miniaturization and manufacturing of nuclear warheads in addition to its strongest experiment to date last September.
“The standardization of the nuclear warhead will enable the DPRK to produce at will and as many as it wants a variety of smaller, lighter and diversified nuclear warheads of higher strike power, ” the government said last September, using the initials of North Korea’s formal name, the Democratic People’s Republic of Korea.
Security experts in recent years have begun to shift their focus away from disarming the country to studying methods for deterring the country’s desire to use or share nuclear weapons.
At the same time, the North has made steady progress in its land- and sea-based missile programs, which already have the ability to strike regional American allies in Seoul or Tokyo. In a televised New Year’s Day message this year, Kim boasted that the country was also making significant progress in its effort to launch intercontinental ballistic missiles capable of striking American targets in the Pacific Ocean, or perhaps even the U. S. mainland.
Kim’s New Year’s address pushed then President-elect Trump to tweet: “North Korea just stated that it is in the final stages of developing a nuclear weapon capable of reaching parts of the U. S. It won’t happen!”
Trump’s administration is still adapting to its new policy of pressure and engagement on North Korea. Such efforts toward North Korea have baffled the last three American presidents who watched, with few good options for intervention, as the country became a nuclear state.
In a visit to Seoul in March, Secretary of State Rex Tillerson called for a “different approach” for dealing with the North’s nuclear ambitions, acknowledging that previous administrations’ efforts to apply pressure and use covert actions have failed. It’s unclear what that approach might be, however, though Tillerson did suggest that military intervention was still an option.
A looming concern for American officials is the extent to which China can — or is willing to — apply additional economic pressure to persuade the North to denuclearize, or perhaps to talk about it. Trump has said that the United States would tackle the problem alone, if needed, a posture questioned by experts who note the issue’s regional complexity.
Some in South Korea, whose densely populated capital is within striking range of conventional weapons like artillery, see the recent provocations as a test for China. Its leaders, including President Xi Jinping, have urged restraint.
Last month, members of the United Nations Security Council, including China, voted to impose a new round of sanctions targeting North Korea’s primary exports, including iron and coal, in retaliation for missile tests. North Korea said the United States will “pay dearly” for the sanctions, estimated to be worth about $1 billion to the North Korean economy.

SN odmówił we wtorek odpowiedzi na pytanie prawne Sądu Apelacyjnego w Warszawie ws. umocowania sędzi Julii Przyłębskiej jako prezesa TK w procesie cywilnym. Trzech sędziów SN zbadało we wtorek, na rozprawie pytanie prawne ws. umocowania sędzi Przyłębskiej “do dokonywania czynności za prezesa TK, jako stronę albo uczestnika postępowania cywilnego”. Sprawa miała swój początek, gdy Rzepliński – jako ówczesny prezes TK – wniósł w 2016 r. o udzielenie przez sąd, w myśl prawa cywilnego, tzw. zabezpieczenia pozwu poprzez nakazanie sędziom TK, wybranym przez Sejm w grudniu 2015 r. (Mariuszowi Muszyńskiemu, Henrykowi Ciochowi i Lechowi Morawskiemu) powstrzymania się od orzekania w TK – do czasu prawomocnego rozstrzygnięcia zapowiadanego pozwu.
W listopadzie ub.r. Sąd Okręgowy w Warszawie odrzucił wniosek, wskazując na niedopuszczalność drogi sądowej. Rzepliński zażalił się do SA. 19 grudnia ub.r., przed rozpoznaniem zażalenia, upłynęła jego kadencja w TK, a 21 grudnia prezydent Andrzej Duda powołał sędzię Przyłębską na prezesa TK. 11 stycznia br. złożyła ona oświadczenie o wycofaniu zażalenia Rzeplińskiego. Jego pełnomocnicy kwestionowali w SA skuteczność tej czynności i podważali jej pełnomocnictwo w tym procesie, wskazując na naruszenie przepisów przy powołaniu jej na prezesa. W związku z tym SA w lutym br. zadał z urzędu pytanie prawne SN.
“Trzeba stwierdzić, że rozstrzygnięciem sprawy, tej sprawy, w której przedmiotem był wniosek o zabezpieczenie, w ogóle nie jest kwestia czy prezes TK został właściwie, czy niewłaściwie powołany, tylko czy posiada zdolność sądową” – mówił we wtorkowym uzasadnieniu decyzji SN sędzia Maciej Pacuda.
Jak podkreślił, jeśli prezes TK “nie ma takiej zdolności”, to bez względu na to, kto pełni ten urząd – i jak został powołany – to “i tak zachodzi w odniesieniu do takiej osoby negatywna przesłanka procesowa, która musi powodować odrzucenie wniosku”. “Trzeba stwierdzić kategorycznie, że prezes TK nie ma zdolności sądowej, i to w sposób oczywisty” – podkreślił SN. Dodał, że zdolność taką mają albo osoby fizyczne, albo osoby prawne, albo “jednostki organizacyjne, którym ta zdolność została przyznana na podstawie ustawy”.
Sędzia Pacuda zaznaczył w tym kontekście, że prezes TK takich uprawnień nie ma, bo nie jest wymieniony jako organ o zdolności sądowej w żadnym z przepisów Kodeksu postępowania cywilnego, takiej zdolności nie nadają mu też przepisy o Trybunale.
Dlatego trzeba – według SN – uznać, że rozstrzygnięcie Sądu Okręgowego w Warszawie odrzucające wniosek Rzeplińskiego było prawidłowe.
